In United States law, state, federal and tribal governments generally enjoy immunity from lawsuits.[47] Local governments typically enjoy immunity from some forms of suit, particularly in tort.

In the US, sovereign immunity falls into two categories:[48]

Absolute immunity:[49] pursuant to which a government actor may not be sued for the allegedly wrongful act, even if that person acted maliciously or in bad faith; and

Qualified immunity: pursuant to which a government actor is shielded from liability only if specific conditions are met, as specified in statute or case law.[50]

In some situations, sovereign immunity may have been waived by law.[51]

Judicial immunity is a specific form of absolute immunity.
