Appeals Court Rules Biden Regime Cannot Enforce Covid Vaccine Mandate on Federal Contractors

 

On Monday, a federal appeals court ruled on Monday that the Biden regime’s COVID-19 vaccine mandate for federal contractors could affect as many as 20% of American workers.

 

Joe Biden’s executive order on contractor vaccinations from September 2021 and was challenged in court by the states of Louisiana, Indiana, and Mississippi. A panel of the 5th Circuit Court of Appeals voted 2-1 to uphold a lower court ruling to block this executive order.

 

Judge Kurt Engelhardt, appointed by former President Donald Trump, said in the majority ruling that the “close nexus test combined with appropriate deference to presidential determinations leaves [Biden] with nearly unlimited authority to introduce requirements into federal contracts.”

He illustrated his point by saying that Biden could “hypothetically” mandate that all third-party federal contractors’ employees reduce their BMI (body mass index) below a certain number based “on the theory that obesity is a primary contributor to unhealthiness and absenteeism.”

 

The U.S. government has contracts with hundreds of third-party contractors, and judges have indicated that the issue might affect up to 20 percent of American employees.

 

Indiana Attorney General Todd Rokita touted the ruling as a legal victory against what he called President Joe Biden’s executive overreach.

 

Rokita, who joined with two other plaintiff states in the legal action, decried Biden’s “truly unprecedented” use of the federal Procurement Act to wield executive power to impose the mandate on third-party contractors.

 

“Hoosiers and all Americans should have the liberty to make their own decisions on whether to get vaccinated,” Rokita said in a statement. “That includes individuals who happen to work as federal contractors. No one should have to fear losing their jobs just because they opt against getting a shot.”

 

Louisiana Attorney General Jeff Landry called the appeals court’s decision a “victory for freedom.”

 

“We will continue to stand up against these abuses of power that threaten us now and in the future,” he said in a statement.

 

Earlier this month, the U.S. Sixth Circuit Court ruled unanimously to uphold a class action injunction protecting Air Force personnel who declined the COVID vaccine from punitive measures.

 

In the ruling, Judge Murphy wrote, “Under RFRA, the Air Force wrongly relied on its ‘broadly formulated’ reasons for the vaccine mandate to deny specific exemptions to the Plaintiffs, especially since it has granted secular exemptions to their colleagues. We thus may uphold the Plaintiffs’ injunction based on RFRA alone. The Air Force’s treatment of their exemption requests also reveals common questions for the class: Does the Air Force have a uniform policy of relying on its generalized interests in the vaccine mandate to deny religious exemptions regardless of a service member’s individual circumstances? And does it have a discriminatory policy of broadly denying religious exemptions but broadly granting secular ones? A district court can answer these questions in a ‘yes’ or ‘no’ fashion for the entire class. It can answer whether these alleged policies violate RFRA and the First Amendment in the same way. A ruling for the class also would permit uniform injunctive relief against the allegedly illegal policies. We affirm.”

Zelensky participated in a bilateral meeting with Joe Biden earlier in the day after his red carpet welcome.

 

Biden and Zelensky held a joint press conference before the Ukrainian president went over to the Capitol to lecture Congress.

 

Speaker Pelosi invited Volodymyr Zelensky to address Congress Wednesday evening.

 

“This flag is the symbol of victory of this war,” Zelensky said as he presented the Ukrainian flag to Speaker Pelosi and Kamala Harris.

Liberals are furious with Neil Tyson after he defends Elon Musk: 'What in the god dn F* neil'

 

Famed astrophysicist Neil deGrasse Tyson issued a tweet defending billionaire entrepreneur Elon Musk, and many on the left responded with furious castigation.

 

"While casting shade on @elonmusk for what he’s done, is doing, or will do, try to pause & remember that he made electric cars a normal thing in society and he commercialized space — for cargo, satellites, & people," Tyson tweeted Tuesday.

 

"Count him among those who are inventing civilization’s future," he added.

 

Tyson's sentiment was very popular, with more than 183k people "liking" the message and nearly 23k people retweeting it.

 

But many on the left were less than enthused.

 

"I will always have issues with those who abuse their power and amplify racism, antisemitism, and misinformation. He is empowering the divide in our country and signed on to this platform without a clue on how to run it, as misinterpreting our country's values," read one tweet from a user identifying himself as a liberal democrat.

ABC reporter Kristen Hentschel paid thousands by lobbying firm to make hit pieces on politicians: report

 

An ABC producer used her credentials to churn out fake hit pieces on local politicians in Florida while raking in thousands from a political lobbying firm, a report said.

 

Freelance producer Kristen Hentschel — who mostly worked for “Good Morning America” — was paid at least $14,350 by an Alabama-based political consulting firm Matrix LLC to sandbag the environmentally-friendly politicians with bogus questions, according to a report released Wednesday by NPR and Floodlight.

 

Hentschel claimed to be working for ABC while filming the hit piece. The company said she had not been assigned to the story.

 

“Kristen Hentschel was a freelance daily hire who never worked for ABC News on the political stories referenced in the NPR article,” the network said in a statement.

 

Hentschel, who has been fired from the network, primarily did freelance work for “Good Morning America,” the same show plagued by rumors of an affair between hosts Amy Robach and T.J. Holmes.

Sadiq Khan refuses to make London police declare if they are Freemasons after Hillsborough questions raised

 

London mayor says a compulsory register of Masons in the police would be illegal under human rights law

 

London mayor Sadiq Khan has refused to force Metropolitan Police officers to declare membership of the Freemasons, saying such a move would be illegal.

 

The mayor’s statement comes despite the Independent Police Complaints Commission (IPCC) revealing that it is now investigating whether Freemasonry played a part in South Yorkshire Police’s handling of the Hillsborough stadium disaster and subsequent cover-up.

 

The refusal is also unlikely to calm decades of anxiety about the possibility of police corruption stretching back to at least to the 1960s when Detective Chief Superintendent Bill Moody, then head of the Obscene Publications Squad, reportedly helped a pornographer join his lodge.

 

Mr Khan ruled out a compulsory register of Freemasonry in the Met, the largest police force in the country, after Caroline Pidgeon, leader of the Liberal Democrats in the London Assembly, asked him to consider such a move in the light of the Hillsborough investigation, “to improve public confidence”.

 

In his written response, Mr Khan said: “The Met is bound by the legislation of the Police Regulations Act 2003 which states that no restrictions other than those designed to secure the proper exercise of the functions of a constable shall be imposed on the private life of members of a police force.”

 

Adding that an Italian case showed that a compulsory Metropolitan Police freemasonry register would breach human rights laws, he added: “In 2007, a European Court of Human Rights judgement was made in relation to an Italian lodge and a local authority which ruled that any requirement to declare [membership of Freemasonry] is in violation of Article 11 (the right of lawful association) taken in conjunction with Article 14 (the right not to be discriminated against) of the European Convention on Human Rights."

 

Criticising Mr Khan’s response, Ms Pidgeon told The Independent: “It is long overdue that police officers routinely declared that they were Freemasons. Public confidence could only be improved through routine publication of such information.”

 

Currently the 31,000 officers in the Met are only required to declare associations with people who have the potential to conflict with their duties as a police officer. They do not automatically have to declare membership of Freemasonry.

 

The Met does not collect information about how many officers are Masons and has never banned officers from joining the all-male fraternity, despite long-held fears that its ideals of mutual help could be twisted into collusion between police and criminals.

US government links Alzheimer’s to racism

 

“Inequities” put non-white Americans at higher risk of dementia-related diseases, health ministry claims

 

Non-white Americans have relatively high rates of Alzheimer’s disease and dementia partly because of racism, President Joe Biden’s administration now says.

 

“Entrenched systemic racism” must be addressed and prioritized, rather than focusing on individual behaviors, the US Department of Health and Human Services (HHS) said this week in its annual report on dealing with Alzheimer’s and related dementias. HHS Secretary Xavier Becerra called for “interventions” to reduce disparities in Alzheimer’s rates, tailoring the government’s efforts “with cultural competence and equity as the primary focuses.”

 

Racism-rooted “structural inequities,” such as underinvestment in education, unwalkable communities and subpar access to nutritious foods, are an “important cause” of the disparities in dementia cases, HHS said. Black people are about twice as likely as whites to develop Alzheimer’s or dementia, while Hispanics are about 1.5 times as likely.

 

The Chicago-based Alzheimer’s Association lists age, family history and genetics as the top risk factors for developing a dementia-related disease. Suffering head injuries or poor heart health also can increase the odds. Elderly people who eat a healthy diet, exercise, stay socially active and avoid smoking and alcohol abuse may be able to reduce their Alzheimer’s risks.

 

However, unlike the Biden administration, the not-for-profit group hasn’t found a link between Alzheimer’s and racism. “The reason for these differences is not well understood, but researchers believe that higher rates of vascular disease in these groups may also put them at greater risk for developing Alzheimer’s,” the association said.

 

The HHS document argued that disparities in risk factors are “grounded in generations of structural racism and inequality.” Making matters worse, the department said, non-white people suffering from Alzheimer’s also have subpar access to medical care and resources and are less likely than whites to receive proper diagnosis and treatment.

 

“It is therefore of critical importance that research, interventions and infrastructure to address modifiable risk factors…are culturally responsive and grounded in improving equity by addressing the social determinants of health,” the report said.

 

More than 6 million Americans suffer from Alzheimer’s, and that total is forecast to jump to 13 million by 2060 in view of the country’s aging population, according to HHS. The disease slowly destroys brain function, leading to cognitive decline, as well as behavioral and psychiatric disorders.
