this isn't a jury trial, anon. doesn't matter if disorganized, or if the judge corrected them. the judge is trier of fact and law. law is on the papers. fact is what is presented and accepted into evidence. does the evidence prove facts that meet the elements needed to establish the count(s)? judge has lots of discretion on facts/evidence. law seems pretty clear.
all comes down to the judge.
would be helpful if AZ. anon could give an indication of how the appellate court and AZ Supreme Court leans, since that is where it will head afterward.
Regardless, from teh little I've watched and paid attention, seems like Kari's team did what they needed to do. The 19" vs 20" issue and Runbeck chain of custody (or lack thereof) seem like dispositive facts to this anon.
