§ 129
Formation of criminal associations
(1) 1 A person who forms an association or participates as a member in an association whose purpose or activity is directed towards the commission of criminal offences punishable by a maximum term of imprisonment of at least two years shall be liable to a custodial sentence not exceeding five years or to a monetary penalty. 2 A person who supports such an association or recruits members or supporters for it shall be liable to a custodial sentence not exceeding three years or to a monetary penalty.
(3) Paragraph 1 shall not apply,

if the association is a political party which the Federal Constitutional Court has not declared unconstitutional,
