We can only speculate. The government is not involved as a party to the Brunson petition. The petition was reviewed by the Office of the Solicitor General and the SG waived a response. This is to be expected for petitions with a low chance of making it through conference. We could also speculate that the SG represents the government, and the Brunson petition addresses individual office holders, so the SG waived comment because the 'US' is not a party to the litigation. In any event, the waiver by the SG should not be seen as favorable to Brunson. It's neutral at best.
