Meta is 'freeing the nipple' at its Oversight Board's recommendation that theban on bare breasts violated 'human rights' of women, transgender and non-binary people.
The board's recommendation focused on Instagram's ban of two posts by a couple, one of whom is transgender and the other non-binary, who posed topless but covered their nipples to raise awareness around top surgery.
The board said that 'the [old] policy is based on a binary view of gender and a distinction between male and female bodies,' which makes rules about baring nipples 'unclear' for those who do not identify as women.
But it also affects women, who have long fought to desexualize images of bare breasts while arguing that men are allowed to share their bare chests.
Naked protestors - both men and women - marched to Facebook's New York headquarters in 2020 to demand the policy on bare breasts be changed.
The board, which is funded by Meta but operates independently, said in a ruling that the company's adult nudity policy is based on a binary view of gender, making it unclear how the rules apply to intersex, non-binary and transgender people.
Facebook and Instagram were criticized in 2013 for removing images of women breastfeeding, but the platforms apologized for 'the mistake' and said it encouraged such images on their platforms.
'Such an approach makes it unclear how the rules apply to intersex, non-binary and transgender people and requires reviewers to make rapid and subjective assessments of sex and gender,' the board said.
However, the new policy to allow bare breasts has been a long time in the making.
In 2016, women took to the streets in the 'free the nipple' movement to desexualize images of bare breasts.
And it came about when pictures of women breastfeeding were censored or flagged as nudity.
The movement gained traction in 2013 after Facebook removed clips from the actor/director Lina Esco's documentary Free the Nipple, which sparked protests outside of Facebook headquarters.
And many women argue that, while hate speech goes uncensored, their nipples are flagged as 'dangerous.'
CEO Mark Zuckerberg tried to justify this in 2018, saying: 'It's easier to build an AI system to detect a nipple than what is hate speech.'
Meta was recently criticized for banning professional nude photography by activists who stated the images are art.
In 2020, protesters swarmed Facebook's headquarters in New York City - all naked and holding up pictures of enlarged nipples.

House Rep. George Santos reportedly dressed as a drag queen named “Kitara” while living in Brazil more than a decade ago as more details of the congressman’s convoluted identity continue to emerge.
Santos, who’s reportedly gone by a number of aliases in his truth-challenged past, appears to be depicted in a photo in a drag costume from 2008, according to an article from the Substack site “The Handbasket” by reporter Marisa Kabas.
The latest look into Santos’ younger years was revealed to Kabas by Eula Rochard, a drag queen in Brazil and former friend of Santos.
Santos and Rochard met when Rochard was already an established drag queen in a Brazilian city next to Rio de Janeiro, according to the report.
“I think I met him when he was around 16 or 17 years old,” she said of Santos, who used to go by Anthony back then. “He used to hang out in my house while his mom was playing Bingo.”
Santos has reportedly used the pseudonyms Anthony Devolder and Anthony Zabrovsky.
The freshman congressman became a national punch line after he was caught in a series of lies about his college education, employment history and Jewish heritage, among other tall tales that keep tallying up.

The eco-warrior warned the crowd of 'rain bombs' and boiling oceans while discussing the concerns facing Earth if drastic changes aren't made to address the environmental concerns.
Gore, who also voiced support for climate activist Greta Thunberg after her recent arrest for protesting a coal mine in Germany, said the world would soon fall into peril if citizens continue to treat the atmosphere as an 'open-air sewer.'
The video of his speech has ignited criticism online from those claiming the former politician has been 'wrong about everything' and calling him a 'shill.'
