The Constitution mentions no where in Article 1 Section IV about a governor, court, county commission, election board etal…………….."shall be PRESCRIBED in each State by the Legislature thereof". Doesn't say pass legistlation and signed into law by the Governor. This is a "resolution" and carries the same weight as a law.

 

The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.
