• Rod: “I went to check my status for housing. I was number 20 on the list, but now it went to 67 because they had to prioritize the illegal immigrants, and I’m like, that’s so unfair. I’ve been waiting three years on this list.”

• Homeless Shelter Worker: “They [immigrants] get placed first because they got nothing…they [Americans] will get placed after, once it’s open.”

Newsom attacks judge overseeing California assault weapons ban

California Gov. Gavin Newsom is attacking the character of the federal judge who is expected to soon release a decision soon about the state's assault weapons ban, based on a news report that the judge handcuffed a teen girl to scare her away from committing a crime.

 

Southern District Roger Benitez had the 13-year-old girl handcuffed by a U.S. marshal during a Feb. 13 hearing for her father, according to a transcript of the court proceedings obtained by a local outlet.

 

The judge told the girl that the exercise was meant to scare her away from doing drugs and being in court like her father.

 

"Judge Benitez on full display," Newsom tweeted Wednesday with a link to a San Diego Union-Tribune article about the incident. "THIS is the man who is deciding the fate of CA’s assault weapons ban. A man that will handcuff innocent kids in a courtroom for the sake of humiliation."

 

The U.S. 9th Circuit Court of Appeals on Tuesday said it is reviewing the incident.

 

Benitez struck down California's decades-old assault weapons ban in 2021. He is expected to make another ruling soon to overturn the state's assault weapons ban again, according to Sacramento's ABC 7.

Homeland Security awards $350 million to communities to deal with 'costs of noncitizen arrivals'

Major metropolitan areas across the country have said they are having difficulties dealing with the influx of migrants.

The Department of Homeland Security announced it is awarding $350 million from December's omnibus spending package to "help local communities around the country better manage the costs of noncitizen arrivals in their communities," amid record migration numbers.

 

"With today’s funding of $350 million for the Emergency Food and Shelter Program, DHS is delivering on our commitment to provide needed support to communities across the country that receive noncitizens who are in immigration enforcement proceedings," Homeland Security Secretary Alejandro Mayorkas said when announcing the program Tuesday.

 

The $1.7 trillion omnibus spending bill established a new Homeland Security grant known as the Shelter and Services Program by having Customs and Border Protectiontransfer $800 million to the Federal Emergency Management Agency to create the program, officials said.

 

Denver, New York City, Washington, D.C., and other major metropolitan areas across the country have said they are having difficulties dealing with the influx of migrants.

 

Last fiscal year, nearly 2.4 million illegal migrants were encountered by U.S. officials at the southern border, according to government data. Every month this fiscal year has had more migrant encounters than the previous year, putting the U.S. on track for another record-breaking year for immigration.

Nonprofit organization Empower Oversight Whistleblowers & Research (EMPOWR) announced Wednesday the appointment of new president Tristan Leavitt.

 

"I can’t wait to hit the ground running rooting out waste, fraud, abuse, mismanagement, and politicization, which erode trust in our vital public institutions," Leavitt said in a statement. "That wouldn’t be possible without whistleblowers who put their livelihoods at risk in the name of transparency, and we will leave no stone unturned in ensuring they are protected."

 

The Chairman of the Board Jason Foster said that he welcomes Leavitt and that he is perfect for the new role.

Rep. Gaetz: Navy leader's testimony on military vaccine mandates contradicts IG reportBlanket denial memorandums were given to service members from the Air Force and the Navy.

The Undersecretary of the Navy “misrepresented material facts” in his testimony given at a congressional hearing, lawyers for Navy and Marine service members told The Center Square.

His testimony under oath contradicted a Department of DefenseInspector General report that said the Navy was violating the Religious Freedom Restoration Act, U.S. Rep. Matt Gaetz, R-Florida, said. A federal judge last year chastised the DOD and Marine Corps for refusing to grant religious accommodation requests (RARs), adding it was the court’s responsibility to uphold the law when generals won’t.

At a hearing before the Military Personnel Subcommittee of the House Armed Services Committee, Gaetz asked Erik Raven, undersecretary and Chief Operating Officer and Chief Management Officer of the Navy, “Did the Navy send out form letters in response to people’s requests for religious exemptions” from the DOD vaccine mandate.

Raven replied, “I’d have to get back to you on that.”

“This is really important,” Gaetz said. “The law requires an individual assessment of people’s request for a religious exemption, right?”

Raven answered, “The process we followed there was individualized review at multiple levels.”

“You believe there was individualized review?” Gaetz asked.

“Yes sir,” Raven said.

“Well the Inspector General disagrees with you,” he said, referring to a report that RARs weren’t individually reviewed and the average amount of time each was considered was 12 minutes.

However, the DOD-IG report found “a trend of generalized assessments rather than the individualized assessment that is required by federal law and DoD and Military Service policies.”Blanket denial memorandums were given to service members from the Air Force and the Navy, the report found, which didn’t “reflect an individualized analysis demonstrating that the Senior Military Official considered the full range of facts and circumstances relevant to the particular religious accommodation request.” Instead, they included “similar, if not identical, wording.”

Mat Staver, founder and chairman of Liberty Counsel, who’s representing Navy and Marine service members who faced repercussions for not getting vaccines, told The Center Square, “The total lack of candor and the misrepresentation of material facts is disturbing. The testimony presented to the committee is contradicted by the Inspector General’s report and the documents and sworn testimony presented in our ongoing litigation.”

Last September, Judge Steven Merryday of the U.S. District Court Middle District of Florida Tampa Division granted a classwide preliminary injunction for active and reserve duty Marines whose RARs were denied. Merryday said, “the record reveals the substantial likelihood of a systemic failure by the Marine Corps to discharge the obligations established by RFRA.”

In an earlier ruling, Merryday addressed the fact that Marines had been charged additional monthly rent for noncompliance and given two days’ notice to be discharged and ordered to leave their military housing, which he said “suggests retribution and retaliation.”

He also maintains that military leaders must comply with RFRA, saying it applies to “everyone from the President to a park ranger … from the Chief Justice of the United States to a probation officer … from the Chairman of the Joint Chiefs of Staff to a military recruiter – even if they don’t like it and even if they don’t agree with it. The Free Exercise Clause and RFRA are the law of the land.”

So the DOD has no active plan to do proactive outreach to these individuals and get them back into the military?” Gaetz asked. Cisneros replied, “Our plan is the same as it’s always been,” which Gaetz said meant “no plan.”

Staver told The Center Square, “The Department of Defense and high-ranking military brass act as though they are above the law.They appear to have little to no concern for the truth, the law, and for the dedicated service members. The arrogant, lawless, and abusive actionsare the reason retention and recruitment has dropped to an alarming rate. There needs to be a complete transformation of the system beginning with the Secretary of Defense and the top Pentagon brass.”

South Carolina GOP Rep. Ralph Norman on Wednesday implied that someone other than President Joe Biden was directing the administration's policies on the world stage.

 

"With any of the Biden interviews, he's not coherent," Norman said during a Wednesday segment of the "Just the News, No Noise." television show. "Andwhoever's running this country is doing a lot of damage to us."

 

Biden has taken flak for his performance on the world stage, particularly in light of his handling of the incursion of a suspected Chinese spy balloon into U.S. airspace.

 

"He sold out to China," stated Norman. "That's pretty obvious. I mean, look at TikTok. Look at what they're doing to the youth in this country. Look at the trade imbalance that we have now. Look at the medical devices that we're dependent on China for. China is not our friend. They're our enemy."

 

Norman further indicated that U.S. plans to take the initiative when it comes to Chinese violations of U.S. airspace airspace amid the fallout from the suspected spy balloon's trip across the U.S. without interference until its downing off the coast of the Carolinas.

 

"We're gonna hopefully put the screws to China," he said. "I went to look at a document just a little bit ago in the scare phone and what the plan was if any other object violated the airspace. They're getting the message."

A bipartisan group of lawmakers on Wednesday proposed legislation to strengthen railway safety regulations in the wake of a major train derailment in Ohio last month that saw toxic materials leak from the railcars.

 

Ohio Sens. Sherrod Brown, D, and J.D. Vance, R, led the group of senators backing the measure, which wouldrequire a minimum two-person crew for all trains and imposes regulations on railcar wheel bearings, the Washington Times reported. Apart from Vance, Republican Sens. Marco Rubio, Fla., and Josh Hawley, Mo., are theonly Republicans who have signed on to the bill thus far*.

 

"Congress has a real opportunity to ensure that what happened in East Palestine will never happen again. We owe every American the peace of mind that their community is protected from a catastrophe of this kind," Vance said of the bill.

 

The Feb. 3 derailment of a Norfolk Southern train near the town of East Palestine, Ohio, prompted an evacuation of the town and authorities had to implement a controlled release of the toxic materials to avert an explosion. The derailment attracted national attention and directed considerable scrutiny toward Transportation Secretary Pete Buttigieg for his seemingly sluggish response. The bill would urge the DOT to review its existing guidelines on optimal train weight and size.

 

Brown lamented that such a tragedy had predicated progress on the measure, saying "it shouldn’t take a massive railroad disaster for elected officials to put partisanship aside and work together for the people we serve," per the Times. "Rail lobbyists have fought for years to protect their profits at the expense of communities."

 

"These commonsense bipartisan safety measures will finally hold big railroad companies accountable, make our railroads and the towns along them safer, and prevent future tragedies so no community has to suffer like East Palestine again," he concluded.

FBI: More than 6-year wait for thousands of pages of emails from FBI director on Trump

The FBI said if the scope of the FOIA were narrowed and the response was less than 50 pages, it could be released in four months.

The FBI says that it would take nearly 6 1/2 years for it to release the thousands of pages of FBI Director Christopher Wray's emails that contained the word "Trump" over a four-month period that were requested in a Freedom of Information Act request.

 

The Center Square submitted the FOIA on Aug. 8, after former President Donald Trump's home in Florida was raided by the FBI. Agents were seeking classified federal documents being stored at Mar-A-Lago.

 

The Center Square requested any emails with the word "Trump" in it on the email account of FBI Director Wray from April 1, 2022 through August 8, 2022.

 

Nearly 5 1/2 months later, the FBI responded with its findings.

 

"The FBI locatedapproximately 5074 pages potentially responsive to your request," the FBI stated in an email. "The current average time to complete your extra-large track request is at least 77 months."

 

The FBI said if the scope of the FOIA were narrowed and the response was less than 50 pages, it could be released in four months. If the response was more than 50 pages, the response time varied from 35 months to 77 months.

 

The FBI raided Trump's Mar-A-Lago home in August and found classified documents. Classified documents were also found at the homes and offices of former Vice President Mike Pence and President Joe Biden.

Ukrainian saboteurs hit by ‘massive strike’ – Moscow

A cross-border raid by Kiev’s operatives has been thwarted, the Russian Federal Security Service has said

 

Kiev's operatives, who had crossed into Russia’s Bryansk Region on Thursday, have been forced back into Ukrainian territory and hit with a “massive artillery strike,” the Russian Federal Security Service (FSB) has said.

 

Earlier, the Russian military and security services reported that saboteurs had crossed into the Bryansk Region bordering Ukraine and launched raids on several local villages. At least two civilians were killed in those attacks, which also left a child injured, the local authorities said.

 

In order to avoid civilian casualties as well as damage to civilian infrastructure, the enemy was pushed back to Ukrainian territory, where they were hit with a massive artillery strike,” the FSB told the Russian media. “A raid by the Ukrainian nationalists in the Klimovsky District of the Bryansk Region has been thwarted.”

 

In a separate statement earlier the same day, the FSB said that a large number of explosive devices of various types had been found in the area.

 

Bomb squads were deployed to disarm the explosives. Bryansk Governor Aleksandr Bogomaz also reported artillery and mortar strikes in the area.

Russian President Vladimir Putin branded the incident a “terrorist attack,” calling people responsible for such acts “neo-Nazis and terrorists.” He also suggested that those behind Thursday's raids might have also been behind the assassination of Russian journalist Darya Dugina, whose car was blown up near Moscow in August.

 

Russian regions bordering Ukraine have regularly come under attacks by Kiev’s forces since the start of the ongoing conflict. The local authorities in

Bryansk and Kursk Regions have repeatedly reported shelling by the Ukrainian forces, which has sometimes resulted in civilian casualties.
