ty but slight correction re: >>18438648, it is the SUSPENSION of the writ of habeas corpus.

 

the writ of habeas corpus means people have a right to question in a court of law whether or not their detention is lawful. if the government suspends that right, then a person can be detained without a trial. But, the only conditions in which the government can do this is under rebellion (check), or invasion (also check).

 

i think the reason someone might be skeptical that this is what Q was referring to is it falls under Article 1, which covers congress, not the executive.
