In Schenck v US, SCOTUS Justice Oliver Wendell Holmes wrote for the majority that opposing the draft was likely to cause a panic, "Like yelling fire in a crowded theater," and therefore opposing the draft is not protected by the 1st Amendment because it presents a, "Clear and Present danger to the government's war efforts."
The case was later partially overturned by Brandenburg v. Ohio in 1969, which limited the scope of banned speech to that which would be directed to and likely to incite imminent lawless action (e.g. a riot).
Curtailing the speech of One, because another 'might' over-react in a certain way, is the definition of 'predictive-policing'.
