Former Harvard law professor Alan Dershowitz claimed Alvin Bragg could lose his law license — if the Manhattan district attorney does go ahead with indicting former President Donald Trump, and uses Michael Cohen’s testimony to do it.

 

Fox News’ Maria Bartiromo spoke to Dershowitz on Sunday Morning Futures about the ongoing question of whether Trump will be indicted over the Stormy Daniels hush money scandal. Dershowitz has repeatedly denounced the potential indictment as an affront to liberties, and he began by hypothesizing “I don’t think an indictment can actually come forward now after the comments made by [Robert] Costello.”

 

This was a referral to the news that Costello, a Trump ally and former legal adviser to Michael Cohen, went before the Manhattan grand jury to testify against Cohen’s credibility. Costello testified that Cohen took the initiative in arranging the hush money agreement with Daniels, even as Cohen maintains that he did so at Trump’s direction and was reimbursed for it while the Trump Organization tried to cover it up.

 

While charges have yet to be filed against Trump, Dershowitz used Costello’s testimony to declare “he has proved that the main witness is going to be a perjuring liar on the witness stand, and that puts the district attorney in a terrible position.”

 

If he uses Cohen as a witness, he could actually lose his bar license. It’s unethical to put a witness on the stand who you know is lying, and he has to know that Cohen will be lying. Or he tries the case without Cohen, which would be very difficult, or he does the right thing: he drops the case.

 

Cohen has previously pleaded guilty to lying to Congress, but while such a witness might have credibility issues with a jury, Cohen’s prior plea does not automatically disqualify him from testifying under oath in future legal proceedings.

 

Dershowitz added, “maybe grand jurors would finally wake up and say ‘No, we’re not ham sandwiches here. We’re gonna stand up for the law and the law says you don’t indict under these circumstances.”

Sarah Longwell, a Republican strategist who is anti-Trump, attributes the shift to Trump's supporters returning to him, as well as his barrage of attacks on DeSantis.

 

Advisors to DeSantis, according to the Washington Post, have said the governor's candidacy - which many believed would begin in May - has gone from a dead-cert 'coronation' to a lengthy, 50-state fight for delegates.

Florida Gov. Ron DeSantis’s donors and supporters are beginning to question if the potential 2024 Republican presidential candidate should run in the next election cycle — a bid that would put him against former President Donald Trump — or wait until 2028, according to reports.

 

According to a report from NBC News, donors and supporters of DeSantis are having second thoughts on the prospect of the governor’s potential presidential bid. Per the report, one main issue seems to be the governor’s ability to take Trump — who has been criticizing the governor for months — head on.

 

Ron DeSantis may be missing his moment.

 

A number of the Florida governor’s donors and allies are worried his recent stumbles suggest he may not be ready for a brutal fight against Donald Trump. Some feel DeSantis needs to accelerate his timeline to run for the GOP presidential nomination and begin directly confronting Trump if he’s to have any chance of thwarting the former president’s momentum. Others believe DeSantis should sidestep Trump altogether and wait until 2028 to run.

 

At a Sunday luncheon following the annual Red Cross ball in Palm Beach, Florida, a group of 16 prominent Republicans, described by one attendee as a mix of DeSantis backers and Trump “skeptics,” discussed misgivings about the governor’s standing for the future if he tussles with the former president.

 

“They liked him — many of them might even support him,” the person who was at the event said of DeSantis. “But they thought on balance that his long-term future was better without him trying to take Trump head on.”

 

“He will get scarred up” by Trump, the person added.

 

Then there’s conservative billionaire shipping goods magnate Richard Uihlein and his wife, Elizabeth, whose $500,000 in combined contributions ranked them among the most generous donors to DeSantis’ 2022 re-election campaign.

 

DeSantis’s recent snarky remarks about President Trump while the Soros-backed corrupt DA in New York was threatening an arrest on totally bogus and made up charges may have been the end of DeSantis.

 

After waiting two days DeSantis came out and slammed President Trump. This was the beginning of the end.

 

Then later in the week, DeSantis said he was an executive guy, indicating he didn’t want to be President Trump’s VP pick, and that was it for Ron.

House GOP Challenges Weaponization of Government

 

A committee on the subject is making progress against the DOJ, the Air Force, and NewsGuard.

 

The weaponization of government really began under Barack Obama, who masterfully used federal agencies to punish and persecute his political opponents. His understudy, the ostensibly mild-mannered moderate Joe Biden, has continued this banana republic hackery. Republicans in the House are busy challenging it and working to, as House Speaker Kevin McCarthy recently put it, “hold the Swamp accountable.”

 

Right off the bat once taking control of the House in January, Judiciary Committee Chairman Jim Jordan established and is leading the Select Subcommittee on the Weaponization of the Federal Government. That subcommittee, wrote our Douglas Andrews at the time, “will investigate, among other things, the FBI’s effort to censor and ban conservative Twitter users, and the Justice Department’s probe of ‘threats’ from parents who’ve had the temerity to speak out at local school board meetings against wokeness and rampant leftism.”

 

How goes that work?

 

Earlier this week, the subcommittee released a damning report regarding the Justice Department’s targeting of parents concerned over woke indoctrination in public schools. Republicans made official what we already knew:

 

Although the Biden Administration declined to cooperate with this oversight in the 117th Congress, whistleblower disclosures and a report commissioned by the National School Boards Association (NSBA) shed some light on how the Biden Administration colluded with the NSBA to create a justification to use federal law-enforcement and counterterrorism resources against parents.

 

The bottom line: Having “no compelling” justification for targeting parents, the subcommittee concluded that “the Biden Administration misused federal law-enforcement and counterterrorism resources for political purposes.”

 

Unfortunately, Attorney General Merrick Garland stubbornly rejects accusations of wrongdoing and refuses to revoke the DOJ memo.

 

In other news, the subcommittee is investigating the U.S. Air Force over the improper release of Official Military Personnel Files to Due Diligence Group, LLC, which did opposition research against 11 Republican political candidates leading up to the 2022 election. An Air Force spokeswoman recently admitted that USAF “employees did not follow proper procedures,” but she insisted “there was no evidence of political motivation or malicious intent.” Jim Jordan and his fellow Republicans aren’t convinced.

 

Recruitment is hard enough under the woke regime headed by this commander-in-chief. Unlawfully releasing private information against military service personnel who belong to a certain political party is unlikely to help matters.

Finally, one of our humble team’s “favorite” organizations, NewsGuard, is under the weaponization subcommittee’s scrutiny. The New York-based company was started by some former journalists with the ostensible goal of objectively evaluating news reporting.

 

Predictably, it soon became apparent — including through our own experience — that NewsGuard would be better named LeftGuard or Praetorian Guard. It’s “fact-checkers” and evaluation team do little but use leftist opinion games to discredit, suppress, and censor conservative news organizations for reporting inconvenient facts. NewsGuard is a key part of what journalist Michael Shellenberger of Twitter Files fame told the committee is the “censorship industrial complex,” and he rightly says it’s been “caught spreading disinformation.”

 

We’ve likened the Left’s censorship scheme to racketeering.

 

It would be bad enough if only web users were paying for NewsGuard’s browser add-on, or if only social media sites were using its work. Yet the truth is that you, dear taxpayer, are helping to fill the coffers of these fact-checking thugs. The House committee learned that NewsGuard took in $750,000 from the Defense Department in 2021, after collecting $25,000 from DOD and the State Department in 2020.

 

NewsGuard cofounder Gordon Crovitz insists this doesn’t mean his company is “government-funded” because “government entities [simply] pay to license our data.”

 

If the federal government is using taxpayer dollars to pay a company that is demonstrably a part of the Democrats’ censorship industrial complex, that constitutes weaponizing government.

 

Perhaps worse is this from The Washington Times: “House Republicans previously raised questions about NewsGuard after it signed a deal with the American Federation of Teachers to put the rating tools on devices of millions of American teachers and schoolchildren.”

 

“Fact-checkers” like Crovitz may conveniently hide behind a phony wall of separation here if his company’s supposedly nonpartisan work is going to teachers and students without being directly paid for with tax dollars. Yet that’s a distinction without a difference. Ask those concerned parents above if they don’t see this infiltration into public school classrooms for what it truly is.

 

In short, House Republicans are doing important oversight work via this Select Subcommittee on the Weaponization of the Federal Government. It’s an incredible uphill battle, however, and it remains to be seen what will come of it other than a few sternly worded memos.

The Democrats’ unending criminalization of our political differences poses a grave threat to our United States.

 

Years from now, the history books may well record this as the week during which the Still-Somewhat-Loosely-United States of America walked up to the edge, stared into the abyss of banana republicanism, shook its collective head, and said, “No thanks.”

 

But we doubt it.

 

After a steady stream of will-he-or-won’t-he churn about hard-left Manhattan DA Alvin Bragg’s Herculean efforts to indict Donald Trump for a seven-year-old nuisance payment to a porn star, Bragg’s office canceled the grand jury’s Wednesday meeting to regroup and, it seems, to quell dissension within his camp about the ridiculousness of his endeavor.

 

As Matt Margolis at PJ Media quipped, “It looks like their dreams of seeing him in handcuffs are slipping away faster than a greased pig at a rodeo.”

 

Somehow, though, we don’t think we’ve heard the last of this guy. Nor have we heard the last of Jim Jordan and his House Judiciary Committee.

 

“House Republicans,” as the Washington Examiner reports, “have slammed the potential indictment as being politically motivated and … have also requested documents and testimony from [Bragg] related to the investigation. Bragg responded to the request Thursday by arguing doing so would interfere with law enforcement and that Republican leaders only became interested in the investigation once indications had been given that Trump may be indicted.”

 

Funny, not funny, how Soros DAs like Bragg are notoriously soft on crime, except when they can claim a Republican scalp. That this scalp would be the first ever of a former president is all the more alluring. And corrupting.

 

Noted defense attorney, Harvard Law professor emeritus, and author of the book Get Trump Alan Dershowitz was, shall we say, less than enthusiastic about the merits of the case:

 

I have never seen a case in my 60 years of practice which has so many holes in it. Start with the statute of limitations. It’s seven years before he committed the crime. The New York State statute says the only exception for that is if his whereabouts are unknown. I have to tell you, even Bragg could have found that he was in the White House. … I don’t see how you can twist and turn to make the statute of limitations disappear. And then you have all the other. How many holes are there? Shall I count the ways? …

 

I think he’s worried that if he brings this case and he uses a witness who he has to know is lying, there are going to be investigations of him and there should be investigations. … So I hope he comes to his senses and doesn’t bring this case.

 

Another sharp legal mind, constitutional law professor Jonathan Turley, put it this way: “One would say Bragg is outside of his lane, but in this case, he’s on a completely different highway. This is an effort by a state official to effectively prosecute a federal crime, a crime that the Department of Justice decided not to prosecute. … This has the feeling of a thrill kill for many on the left, and they need to think seriously about what this [means] for the legal system.”

What’s ahead is hard to say. But if there’s one good thing about the criminalization of politics, it’s that it tends to distract our elected representatives from passing bad legislation. Don’t just do something, we say. Stand there.

 

When one considers the all-consuming nature of the Democrats’ war on Donald Trump — from phony Russia collusion hoaxes to nuisance lawsuits to probes of his tax returns to illegitimate impeachments — it’s a wonder the man was able to accomplish all he did while in office.

 

One might’ve thought that the Democrats would’ve learned their lesson. But one would’ve been wrong.

 

Here, we’re reminded of the sad truth of an animal fable — the one in which the frog finally agrees to ferry the scorpion across the river, only to be stung by the deadly arthropod halfway across, causing both of them to drown.

 

“I’m sorry,” said the Democrat scorpion after agreeing with the Republican frog that the criminalization of our politics will be the end of us, “but I can’t help it. It’s in my nature.”

 

So it likely goes.

 

If any lesson can be learned, any warning can be heeded, from the efforts during the past seven days of a hard-left district attorney to bring a weak, petty, pathetic, gymnastically contorted, grotesquely partisan case against Donald Trump, it’s this: We’re lost as a nation if we continue to criminalize our political differences.

 

Sadly, though, one thing is clear: Nothing short of a prison sentence will satiate the Democrats’ sick, twisted, remorseless, Ahabian quest to GET TRUMP!!

 

That bodes ill for our politics. And our nation.

The Left’s Long March Into Despotism

 

The Left has become so certain of its moral superiority that previously sacrosanct principles have been sacrificed.

 

Author and Christian apologist C. S. Lewis once wrote: “Of all tyrannies, a tyranny sincerely exercised for the good of its victims may be the most oppressive. It would be better to live under robber barons than under omnipotent moral busybodies. The robber baron’s cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end, for they do so with the approval of their own consciences.”

 

We are witnessing the consequences of this insufferable and pernicious ideology, primarily on the political and cultural left. The American right and left have often disagreed about societal objectives, or the best method by which to achieve those objectives, but they at least shared a commitment to certain principles: the sanctity of life and of the nuclear family, the protection of children, the primacy of truth, the importance of the rule of law and due process, the punishment of criminals, freedom of speech, religion and other civil liberties, the dignity of work, and a free press charged with the responsibility for holding the powerful accountable.

 

Over time, however, the Left has become so certain of its moral superiority that those previously sacrosanct principles have been sacrificed, one by one, on the altar of whatever utopic visions Leftists have for perfecting society. The hills Leftists have decided to die on now include abortion and infanticide, pornography and gender confusion in schools, exploiting children in dangerous and irreversible medical experimentation, homeless encampments and drug use in our cities, incentivized theft and other unpunished crime, open borders and unlimited illegal immigration, lack of election integrity, censorship of medical professionals, scientists and journalists who dare to question the prevailing government narrative, the politicization of law enforcement, and political persecution.

 

An overly powerful government is eventually populated with arrogant, greedy and unprincipled people who will stop at nothing to get what they want. The Founders understood this, which is why they drafted the Constitution to leave most power within the state governments (and thus more accountable to the people), and to further diffuse federal power by dividing it between three more or less co-equal branches.

 

The moral busybodies on the Left, to their chagrin, are not omnipotent; they resent that their objectives for a perfected society are continually thwarted by the limitations imposed by the Constitution; therefore they seek to undermine the Constitution wherever possible: by eliminating the Electoral College, changing the composition of the United States Senate, “packing” the U.S. Supreme Court, federalizing elections and removing laws that protect election integrity, permitting illegal immigrants to vote, bypassing Congress and having a president issue countless executive orders.

 

The country’s descent into destruction and depravity is being facilitated by leftists in media who defend the crooks and malfeasors, even as they grab power and engage in oppressive and unlawful practices without fear of legal sanction or citizen pushback. Millions of law-abiding Americans who oppose the Left’s takeover nevertheless do not realize the risks of our current trajectory; ordinary people never think things will get that bad — until they do.

In fact, American media has a long history of cheering for leftist movements and ignoring or justifying their grievous human rights abuses. They supported Lenin and then Stalin in the former Soviet Union, covering for their political purges, mass imprisonment and murder, the starvation of their own people. (Pulitzer Prize-winning New York Times journalist Walter Duranty infamously defended Stalin’s actions, saying, “To put it brutally — you can’t make an omelet without breaking eggs.”) They cheered for Mao Zedong and his Cultural Revolution in China that cost tens of millions of Chinese people their lives. They celebrated Fidel Castro’s Communist regime in Cuba. They praised the Khmer Rouge in Cambodia — at least until that army of university-educated malcontents and barely post-pubescent adolescents armed with Kalashnikovs drove millions of their countrymen into rice paddies and Phnom Penh prisons, where they were starved, tortured and shot to death, their bodies left to rot in piles in the “killing fields.” They praise Venezuelan dictators Hugo Chavez and his successor, Nicolas Maduro, despite their socialist policies having driven the country into abject poverty.

 

So we should be suspicious when today’s Left — including and especially the media — demands support for movements dressed up in lofty language and pithy phrases like “antiracist,” “Black Lives Matter,” “diversity, equity and inclusion” and the big kahuna, “climate change.” These ideologies share a number of disturbing traits with their Marxist predecessors:

 

No. 1: Their adherents insist that implementation of these policies requires the dismantling of our constitutional order, including the elimination of freedom, individual liberties, private property and the rule of law.

 

No. 2: Their leaders do not live by the standards they demand of everyone else; instead, they grow rich on guilt-driven donations, corporate sponsorships, and book deals; they purchase expensive real estate, travel around the world on private jets and enjoy first-class accommodations.

 

No. 3: Argument, disagreement and proof of the failure of the proffered policies is never permitted; the theories are treated as religious dogma, and the authors are viewed as prophets.

 

C. S. Lewis was right — the moral busybodies never sleep. They already have too much power; history shows us what can take place if they acquire more.

On Monday, House Republicans sent a letter to Bragg’s office warning him that a politically motivated prosecution of a former president would constitution election interference.

 

“You are reportedly about to engage in an unprecedented abuse of prosecutorial authority: the indictment of a former President of the United States and current declared candidate for that office,” the letter stated. “This indictment comes after years of your office searching for a basis—any basis—on which to bring charges, ultimately settling on a novel legal theory untested anywhere in the country and one that federal authorities declined to pursue. If these reports are accurate, your actions will erode confidence in the evenhanded application of justice and unalterably interfere in the course of the 2024 presidential election. In light of the serious consequences of your actions, we expect that you will testify about what plainly appears to be a politically motivated prosecutorial decision.”

 

Bragg’s general counsel Leslie Dubeck has refused to comply with a House Oversight Committee probe, calling it “an unprecedented inquiry into a pending local prosecution.”

 

“The Letter’s requests are an unlawful incursion into New York’s sovereignty,” Dubeck argued. “Congress’s investigative jurisdiction is derived from and limited by its power to legislate concerning federal matters.”

 

We “request an opportunity to meet and confer with committee staff to better understand what information the DA’s Office can provide that relates to a legitimate legislative interest and can be shared consistent with the District Attorney’s constitutional obligations,” she wrote.

On Saturday, House Republicans shot back a letter to Bragg’s office insisting on its constitutional authority to probe the matter.

 

“Our Committees are conducting oversight of your reported effort to indict a former President of the United States and current declared candidate for that office,” the letter states. “On March 20, 2023, we wrote to you requesting that you voluntarily cooperate with our oversight by providing relevant documents and testimony.”

 

“We received a reply letter sent on your behalf dated March 23, 2023, which set forth several purported reasons for why you could not cooperate with our investigation,” the letter continued.

 

“Notably, your reply letter did not dispute the central allegations at issue—that you, under political pressure from left-wing activists and former prosecutors in your office, are reportedly planning to use an alleged federal campaign finance violation, previously declined by federal prosecutors, as a vehicle to extend the statute of limitations on an otherwise misdemeanor offense and indict for the first time in history a former President of the United States. Moreover, you are apparently attempting to upgrade a misdemeanor charge to a felony using an untested legal theory at the same time when you are simultaneously downgrading felony charges to misdemeanors in a majority of other cases in your jurisdiction,” the letter added.

 

“Contrary to the central argument set forth in your letter, this matter does not simply involve local or state interests,” the letter went on. “Rather, the potential criminal indictment of a former President of the United States by an elected local prosecutor of the opposing political party (and who will face the prospect of re-election) implicates substantial federal interests, particularly in a jurisdiction where trial-level judges also are popularly elected. If state or local prosecutors are able to engage in politically motivated prosecutions of Presidents of the United States (former or current) for personal acts, this could have a profound impact on how Presidents choose to exercise their powers while in office.”

 

The grand jury trial of Donald Trump’s case was abruptly suspended last week after surprise defense witness Robert Costello obliterated the testimony of Bragg’s star witness, former Trump attorney and convicted perjuror Michael Cohen.

Idaho law bans transgender students from using bathrooms inconsistent with biological sex

 

Under the new law, students who encounter a person of the opposite sex in the restroom or changing facility may take private legal action against the school.

 

Idaho Republican Gov. Brad Little signed legislation prohibiting transgender students from using public school bathrooms and changing facilities that do not align with their biological sex.

 

The law, which takes effect July 1, does not apply to single-occupancy restrooms and changing facilities and even requires schools to make a "reasonable accommodation" for students who are "unwilling or unable to use a multi-occupancy restroom or changing facility" that aligns with their biological sex.

 

The law states that requiring "students to share restrooms and changing facilities with members of the opposite biological sex generates potential embarrassment, shame, and psychological injury to students, as well as increasing the likelihood of sexual assault, molestation, rape, voyeurism, and exhibitionism."

 

Under the new law, students who encounter a person of the opposite sex in the restroom or changing facility may take private legal action against the school if the school gave that person permission to use the facilities of the opposite sex or if the school failed to take reasonable steps to stop that person from using those facilities.

 

Little has not made a public statement on the legislation, which he signed into law Thursday.Similar bills were signed into law in Arkansas and Iowa this week, while at least three other states have enacted similar legislation since 2021
