That would be how it may work in an ideal situation and time, that there would be a system in place before actual citizens are deprived their rights but if they use this in conjuntion with the patriot act they can deny you any of your rights immediately with out any court case to hear it, and even if there was it is secret court that denies you of your rights before you are even made aware. Hell if this was already passed in theory talking about it is a crime. Especially if you are trying to figure out how to get around it either legally or illegally in some cases.
