Former Arizona AG Attorney Denounces Maricopa County’s ‘Lackluster’ Investigation

Dismissing the Printer Issues in the 2022 Election

 

Maricopa County officials tapped former Arizona Supreme Court Justice Ruth McGregor to investigate the printing problems in the 2022 election, and on Monday, the county released her report blaming the thickness of the ballot paper. Jennifer Wright, who was the Election Integrity Unit civil attorney for the Arizona Attorney General’s Office during the election and who performed her own investigation of Maricopa County’s election problems going back to the 2020 presidential election, told The Arizona Sun Times the report was “meaningless” since it did not include an analysis of the printer logs.

 

Wright tweeted on Monday, “The report proves printers failed, but doesn’t identify WHY some Oki printers experienced more problems than others. It seems to ‘exonerate’ MC without determining the ROOT cause of failure. It’s surface level stuff. It’s embarrassing. It would fail cross-examination.”

 

She further explained, “When a report simply confirms a problem exists but can’t explain why — it isn’t an investigative report, it’s an incident report. Would an insurance company end an investigation after determining the brakes failed? No! They’d find out why. Maintenance? Defect? Sabotage?”

 

Wright disagreed that the thickness of the paper was the problem. “Note the report confirms WILDLY different error rates on seemingly identical machines,” she tweeted. “If the root cause was simply paper thickness and ballot length, you’d expect substantially similar error rates. This report would not be enough to prove causation in a basic tort claim.”

 

She called it a “lackluster” investigation, stating, “Transcribing interviews is not an independent investigation,” and “You can’t find what you don’t look for.”

 

She also expressed concern that the report did not look into other aspects of the problem: on-site tabulator logs, system logs, and actual Election Day ballots in 2022.

Recent press stories and social media posts concerning NARA’s actions in relation to the Department of Justice (DOJ) investigation into materials held by former President Donald J. Trump at his Mar-a-Lago property allege that NARA has been untruthful about our activities. This is not accurate. These allegations confuse NARA’s statutory role in providing access to records under the Presidential Records Act (PRA) with the DOJ investigation and the FBI’s subsequent search of Mar-a-Lago.

 

NARA routinely makes Presidential records in our legal custody available to all three branches of the federal government via the “special access” provision of the PRA (44 U.S.C. 2205(2)). This provision authorizes Executive branch agencies, such as the Department of Justice, to make requests through the sitting President.

 

NARA’s core mission is to make records available for access. By providing records under the PRA, NARA does not consider itself to be involved in the work of, or investigations by, the requestors. This stands true whether the requestor is the President, an Executive branch agency, Congress, or a Court (including via grand jury subpoenas).

 

As NARA publicly disclosed more than seven months ago, NARA provided the FBI with access to the 15 boxes of materials from Mar-a-Lago in accordance with the PRA. As we have stated previously, NARA had no prior knowledge of, or involvement in, the FBI’s search of Mar-a-Lago, which occurred months after NARA first provided the FBI with access to the 15 boxes.

 

The PRA special access request process for the Mar-a-Lago boxes was described in the May 10, 2022, letter from Acting Archivist of the United States Debra Steidel Wall to Evan Corcoran, one of former President Trump’s PRA representatives, which NARA posted on its website in August 2022. This letter states that the Department of Justice asked “the President to request that NARA provide the FBI with access to the boxes at issue so that the FBI and others in the Intelligence Community could examine them. On April 11, 2022, the White House Counsel’s Office — affirming a request from the Department of Justice supported by an FBI letterhead memorandum — formally transmitted a request that NARA provide the FBI access to the 15 boxes for its review within seven days, with the possibility that the FBI might request copies of specific documents following its review of the boxes.” The Acting Archivist’s letter addressed the privilege issues raised by the representative of President Trump and concluded that: “NARA will provide the FBI access to the records in question, as requested by the incumbent President, beginning as early as Thursday, May 12, 2022.”

WASHINGTON, D.C. – Today, America First Legal (AFL) released the following statement in response to the National Archives and Records Administration’s (NARA) statement issued yesterday regarding their involvement in the unprecedented raid of President Trump’s home, Mar-a-Lago.

 

Earlier this week, our investigation into the circumstances of the Mar-a-Lago raid uncovered that the Biden White House was, in fact, involved with the raid by way of a “special access request” and that NARA misled Congress as to their involvement in the matter. Read our explosive findings here.

 

Statement from Gene Hamilton, America First Legal Vice President and General Counsel:

 

“Recent statements by NARA allege that it has been truthful about its activities. This is not accurate, and if it is, NARA has more significant problems than it realizes. NARA’s allegations belie a misunderstanding of its statutory role in providing access to records under the Presidential Records Act (PRA) and indicate a belief that it was not used by the Biden Administration (whether knowingly or unknowingly) as a means to an end.

 

NARA has limited authority to make Presidential records in its custody available via the “special access” provision of the PRA (44 U.S.C. § 2205(2)). The plain text of subsection (2)(B) allows the records to be made available “to an incumbent President if such records contain information that is needed for the conduct of current business of the incumbent President’s office and that is not otherwise available.” Not whenever DOJ requests them as part of a fishing expedition–only if the records are “needed for the conduct of current business of the incumbent President’s office.” And those records must not be “otherwise available.”

 

Alternatively, NARA has authority under (2)(A) to make those records available “pursuant to subpoena or other judicial process issued by a court of competent jurisdiction for the purposes of any civil or criminal investigation or proceeding.” That is not what occurred here, based on all available information. NARA cannot mix and match its statutory authorities to drum up an after-the-fact justification for failing to follow the law.

 

NARA’s core mission is to follow the law, safeguard records, and make them available for access under certain circumstances delineated by the law. By providing records under the circumstances here, NARA was either used knowingly or unknowingly as part of a law enforcement investigation–without the necessary court order specified in (2)(A).

 

NARA’s statement also failed to explain two crucial discrepancies. First, why did it need to process a special access request when its Inspector General had already made a referral? And second, why was it involved with FBI review after the August 8, 2022, raid at Mar-a-Lago, as the documents reveal?

 

NARA failed to follow the law and permitted access to the records based on erroneous legal determinations made by the White House Counsel’s Office and the Office of Legal Counsel at the Department of Justice. In short, NARA either should have known it had no authority to do what it did under the circumstances, or to use plain English, NARA got played.” said Gene Hamilton.

AUSTIN, Texas (AP) — A federal appeals court ruled that the abortion pill mifepristone can still be used for now but reduced the period of pregnancy when the drug can be taken and said it could not be dispensed by mail.

 

The decision late Wednesday temporarily narrowed a ruling by a lower court judge in Texas that had completely blocked the Food and Drug Administration’s approval of the nation’s most commonly used method of abortion. Still, preventing the pill from being sent by mail amounts to another significant curtailing of abortion access — less than a year after the reversal of Roe v. Wade resulted in more than a dozen states effectively banning abortion outright.

 

In response Thursday, the Justice Department said it will ask the U.S. Supreme Court for an emergency order to put any action on hold.

 

“We are going to continue to fight in the courts, we believe the law is on our side, and we will prevail,” White House Press Secretary Karine Jean-Pierre said Thursday, speaking to reporters from Dublin during a visit by President Joe Biden.

 

Opponents that brought the Texas lawsuit against the drug last year cast the decision by the 5th U.S. Circuit Court of Appeals as a victory.

 

Mifepristone was approved by the FDA more than two decades ago and is used in combination with a second drug, misoprostol.

The National Archives (NARA) has denied responsibility for White House involvement with the raid on former President Donald Trump’s Mar-a-Lago residence.

 

According to documents obtained from the National Archives by America First Legal, President Joe Biden’s White House was involved in the raid of Trump’s Mar-a-Lago residence through a “special access request” to the Archives on behalf of the Department of Justice.

 

In a statement issued Wednesday, the Archives said they only complied with the “special access request” from the White House.

 

“NARA routinely makes Presidential records in our legal custody available to all three branches of the federal government via the “special access” provision of the PRA (44 U.S.C. 2205(2)),” the agency said. “This provision authorizes Executive branch agencies, such as the Department of Justice, to make requests through the sitting President.”

 

“By providing records under the PRA, NARA does not consider itself to be involved in the work of, or investigations by, the requestors,” it continued. “This stands true whether the requestor is the President, an Executive branch agency, Congress, or a Court (including via grand jury subpoenas).”

 

On August 8, 2022, the Federal Bureau of Investigation raided Mar-a-Lago on the grounds of retrieving alleged classified documents from Trump.

 

While the Biden administration officials said they were “stunned” to hear of the unprecedented action, contradicting the Archives’ documents obtained by America First Legal, the Archives claimed it had “not been involved in the DOJ investigation.”

 

The Archives also claimed Wednesday it did not mislead Congress as to its involvement in the matter, a point refuted by America First Legal by quoting the subsection of the provision:
