Dr. John Eastman is a constitutional conservative and legal scholar who currently serves as the Senior Legal Fellow at The Claremont Institute. Dr. Eastman started his legal career as a clerk to Justice Clarence Thomas and, as a practicing attorney, quickly learned that working as counsel to conservative causes and clients was often frowned and ultimately blocked by big law firms and then in 2020, even the judiciary.
Throughout this episode of the Podcast, John and Cleta share “war stories” of their experiences with ideological (leftwing) roadblocks representing conservative advocacy or issue groups during their years as lawyers in big law firms and working to uphold constitutional rights and authority. Both have had efforts to enforce election laws or to bring election challenges to be adjudicated by courts thwarted by judges and partisan activists.
Dr. Eastman and Cleta discuss specific examples of how legal cases in 2020 that raised issues of election law violations were not welcome in the courts. The fallout since 2020 is that judges have continued to ignore and refuse to hear cases brought by conservative candidates, such that election codes have been turned on their heads without any remedy in the judicial system.
They also discuss the pattern over the past decade of leftist voting groups’ attacking the lawful authority of state legislators exercising their power and authority under the US Constitution to enact the election codes, but which have been overturned by judiciary often in collusive lawsuits, which has torn the fabric of the entire election system in state after state.
In a conversation on court requirements to determine “standing” (the right to bring a lawsuit), John and Cleta note that under federal rules of procedure, one must be able to prove injury to achieve standing. However, such standing requirements have seemingly been disregarded in election cases, as described by Dr. Eastman.
And, sadly, Dr. Eastman has been punished by leftists who have attacked him mercilessly for his representation of President Trump in the days following the 2020 election – and he now faces a challenge to his right to practice law in a proceeding before the California Bar Association filed by partisans who want all attorneys associated with the Trump 2020 presidential campaign to be permanently silenced and sidelined.
