Nun sues Fort Worth Catholic diocese after bishop accuses her of violating chastity vow

 

A reverend mother who oversees cloistered nuns at an Arlington monastery is in a legal battle with Bishop Michael Olson and the Fort Worth Catholic Diocese after he launched an investigation into allegations she violated her chastity vows with a priest.

 

Reverend Mother Superior Teresa Agnes Gerlach has sued Olson and the diocese, seeking more than $1 million in damages. She accuses the bishop of abuse of power and overstepping his authority.

 

Gerlach, along with Sister Francis Therese, filed the lawsuit May 3 in Tarrant County district court. The dispute is playing out in court and with canonical lawyers who handle ecclesiastical matters.

 

Matthew Bobo, an attorney representing the nuns, said the accusations are “absolutely false and have no basis.”

 

“Per canon law, he doesn’t have the authority to start an investigation or take any action. This is an independent religious organization which answers directly to the Pope,” Bobo said.

 

The nuns have lived quietly on 72 wooded acres near South Bowen Road and West Sublett Road since 1958.

 

The Sisters of Carmel are withdrawn from the world and spend much of their day in silent prayer. The order has existed since 1562.

 

The diocese posted a statement on its website that said: “Bishop Michael Olson received a report in April 2023 that the Reverend Mother Teresa Agnes of Jesus Crucified Gerlach, O.C.D., committed sins against the Sixth Commandment and violated her vow of chastity with a priest from outside the Diocese of Fort Worth. The priest’s superiors have been notified. An ecclesiastical investigation into the report of the grave misconduct was initiated at the Monastery of the Most Holy Trinity in Arlington, Texas, on April 24, 2023. During this time, Mass is being offered for the sisters on Sundays. The Reverend Mother Teresa Agnes has responded by initiating civil litigation against Bishop Olson and the Diocese of Fort Worth. Please pray for the sisters at the Monastery.”

 

A spokesperson for the diocese said there would be no further comment and that the bishop was not available for in interview.

 

However, attorneys representing the diocese wrote in a motion to dismiss the lawsuit on Thursday that Gerlach admitted to violating her chastity vows and that secular courts did not have jurisdiction over ecclesiastical matters and investigations.

 

“The focal point of this entire dispute is an ecclesiastical investigation into sexual misconduct in violation of the Sixth Commandment — considered “grave misconduct” within the Catholic Church,” wrote the attorneys with Kelly Hart & Hallman in Fort Worth. “Plaintiff Reverend Mother Teresa Agnes has admitted to violating her vow of chastity, with a priest — a patently ecclesiastical, non-secular matter. The crux of Plaintiffs’ live pleading is that Defendants exceeded their authority by initiating and conducting investigatory and disciplinary proceedings.”

 

The sixth commandment states, “You shall not commit adultery.”

 

Asked to comment on the motion to dismiss the case, Bobo said the reverend mother was forced to confess under duress following surgery.

 

“This ‘admission’ was forced out of her under dire interrogation while she was under heavy medication from a procedure by the bishop with no advance notice,” Bobo said. “She does not recall what she admitted to doing she was so under the influence of medication. Further, they are making it sound like she had some sexual liaison affair with another priest, and that did not happen.”

 

Meanwhile, Bobo said that Olson violated canonical law by posting information about the investigation into Gerlach and what she is accused of on a public website.

 

According to court documents, the Disculced Carmelite Nuns Inc. is an independent nonprofit organization also listed as Monastery of the Most Holy Trinity.

Supreme Court Justice Ketanji Brown Jackson tells law students 'Survivor' offers helpful lessons

 

WASHINGTON (AP) — Supreme Court Justice Ketanji Brown Jackson called herself a “Survivor superfan” on Saturday and offered an audience of graduating law school students lessons from thereality TV show.

 

The show has been on television for23years and is now in its44thseason. Jackson said she has seen every episode since the show's second season.

 

“I watch it with my husband and my daughters even now, which I will admit it’s not easy to do with the demands of my day job. But you have to set priorities, people. And that’s exactly the first lesson that I have for you today,” she told the graduating class of American University’s law school in Washington.

 

Jackson, the court’s first Black female justice, is coming to the end of her first term on the court. The justices are done hearing arguments for the term and are expected to issue all their remaining opinions by the end of June before going on summerbreak.Major decisions on affirmative action and President Joe Biden's student loan forgiveness plan have yet to be announced.

 

In her address, Jackson described “Survivor,” in which contestants are deposited in a remote tropical location and undertake challenges in the hopes of ultimately winning $1 million, as “great fun to watch.” But she also said it holds “a number of broader lessons that are helpful for becoming a good lawyer.”

 

One lesson, she said, is to “make the most of the resources that you have," drawing a parallel to when she was a federal public defender and prosecutors always seemed to have more resources. Jackson said she knows “what it is like to commit to moving forward even when the deck is stacked against you” and also talked about a Survivor contestant with a prosthetic leg who nonetheless prevailed at a difficult challenge involving a balance beam.

 

“My advice to you is to do your best to shut outdistractions,use your time wisely and figure out how to make the most of what you have,” Jackson said.

 

Other lessons from the show are to“know your strengths”and to“play the long game,”she said.

 

That last piece of advice could serve the liberal justice well on the Supreme Court, where her colleagues include six conservatives and two other liberals, making it unlikely her views will prevail in some of the term’s most contentious cases when they are announced over the next several weeks.

Paul Simon opens up about his 'sudden' hearing loss: 'Nobody has an explanation for it'

 

It's unlikely that Paul Simon will be returning to live performances anytime soon.

 

In a new interview with the Sunday Times, the legendary singer-songwriter, 81, opened up about losing part of his hearing while working on his latest album, Seven Psalms, which has put any performing plans on pause.

 

“Quite suddenly I lost most of the hearing in my left ear, and nobody has an explanation for it. So everything became more difficult," Simon explained. "My reaction to that was frustration and annoyance; not quite anger yet, because I thought it would pass, it would repair itself.”

 

But his hearing has yet to be restored. According to Simon, it's part of a string of health challenges he's faced in recent years.

 

“Boy, have I been beaten up in these last couple of years,” he noted, pointing out a tough struggle with COVID-19. “But I look good, right?”

 

The changing tide for his fellow musical luminaries weighs heavily on Simon. He recognizes that "it’s just the age we’re at," and cited the recent deaths of Gordon Lightfoot, who passed away earlier this month, and Jeff Beck, who died in January. "My generation’s time is up.” But with his journey into his 80s also comes the ability to strictly pursue things that inspire him. That means avoiding certain songs from his past.

 

“The songs of mine that I don’t want to sing live, I don’t sing them. Sometimes there are songs that I like and then at a certain point in a tour, I’ll say, ‘What the f*** are you doing, Paul?’ Quite often that would come during 'You Can Call Me Al,'" he explained. "I’d think, ‘What are you doing? You’re like a Paul Simon cover band. You should get off the road, go home.’”

 

Luckily, the "Graceland" maestro has found peace in his personal life. He's very happy living on a sprawling Texas ranch with his wife, musician Edie Brickell, and he's not particularly interested in returning to his East Coast roots.

 

“I’m not drawn back to New York at all,” Simon said. “I’m happy here or winter in Hawaii (where he has a house). I don’t want to be in cold weather if I can help it.”

The "Flowers" singer, 30, said she "can't" tour in an interview for the June cover of British Vogue. Her last global endeavor was her 2014 Bangerz tour, which included more than 70 shows across North America, Europe, Latin America, Australia and New Zealand.

 

Cyrus added that she "not only 'can't' tour," she doesn't want to. "Do I want to live my life for anyone else’s pleasure or fulfillment other than my own?"

 

The pop star played five music festival dates last year and has otherwise performed publicly since her Bangerz tour, including a tribute concert for Taylor Hawkins last fall, as musical guest on "Saturday Night Live" in 2021, a Grammys performance with Dolly Parton in 2019 and more.
