Federal prosecutor Karen Gilbert, in Trump probe reprimanded in earlier case for secretly recording defense lawyer
The prosecutor has been identified as Karen Gilbert, who has been identified as a U.S. Attorney's Office's lawyer in the 2009 case.
AJustice Department prosecutor who helped secure last weekās indictment of former President Donald Trump was publicly reprimanded by a judge in 2009 for āgross negligenceā in connection with secretly taping a defense lawyer and an investigator, an agency source has confirmed to Just The News.
The prosecutor, Karen Gilbert, is now serving as a deputy to Special Counsel Jack Smith, who on Thursday issued the 37-count indictment of Trump.
In the 2009 case, Gilbert was head of the U.S. Attorney's Office's narcotics division in Miami and was attempting to prosecute Dr. Ali Shaygan for allegedly prescribing medications illegally, court records show.
Gilbert and colleague in the case Sean Cronin launched a witness tampering investigation and got two witnesses to record conversations between Shaygan's defense lawyer and the investigator, the records show.
However, according to a stinging ruling by U.S. District Judge Alan Gold, the pair failed to get authorization to tape the conversations and did not inform the defense team that the witnesses were "cooperating with the government," thereby violating discovery obligations.
In addition, Gilbert didn't inform her bosses that the duo had launched the investigation in violation of policy. When asked later about the matter in the sanctions hearing, she testified under oath that āshe thought she had.ā
The judge determined Gilbert was "grossly negligent in her treatment" of the "significant and unique witness tampering investigation against defense counsel" and said there was no basis to have even started the probe.
Gilbert was found to have failed to seek "necessary information" about the witness tampering investigation and to have failed to have gotten proper approval for it. She failed to "independently verify the basis for Cronin's belief" that the witness probe was ever needed, according to records.
In the "Findings of Fact" part of Gold's document, he said the probe happened because of "personal animus against the defense" on behalf of Cronin, who answered to Gilbert.
The judge also concluded Gilbert pursued the witness tampering investigation "despite no evidence of wrongdoing."
Shaygan was eventually acquitted of all charges.
As a result of what the judge called the "bad faith" effort to prosecute Shaygan, he granted the doctor's request for sanctions and entered a "public reprimand" against the U.S Attorney's Office that specifically applied to Gilbert, Cronin and another prosecutor.
The Justice Department admitted at the time to "misconduct" and that it had made "serious mistakes" throughout the probe, but denied "bad faith" in the numerous policy and ethics violations.
Neither Gilbert nor the Justice Department responded to a request for comment for this story.
Former senior Trump adviser and federal prosecutor Kash Patel last week called Gilbert āone of the most corrupt prosecutors to ever come out of the southern district of Miami.ā
āGilbert, who is likely to be the trial attorney in the Southern District of Florida, in 2009 was so reprimanded in a narcotics trafficking case that she had to retire from her position,ā Patel told Fox News on Friday. āShe has been pulling the reins on this investigationā into Trump, he added.
The court document notes that Gilbert "resigned" from the Narcotics division, but appears to have never left her government employer. According to her LinkedIn, she's been a DOJ attorney since July 1999 with no gap at any point in her tenure.

Burisma Holdings founder Mykola Zlochevsky, who allegedly paid a total of $10 million in bribes to Joe and Hunter Biden in 2015 and 2016 in exchange for then-Vice President Joe Bidenās assistance in getting Ukrainian prosecutor Viktor Shokin fired, is believed to be an asset of Russiaās Foreign Intelligence Service (SVR) by the United States intelligence community, according to a national security source speaking to RedState on condition of anonymity. The official said:
āThe US intelligence community has a high degree of confidence in their assessment of Zlochevsky as SVR. This is not a new assessment; the intelligence community under Obama knew this, and Obama was briefed on it. Joe Biden and Victoria Nuland were briefed as well.ā

It was revealed by Sen. Chuck Grassley (R-IA) on Monday that the āforeign nationalā mentioned in an FD-1023 form by a confidential human source (CHS) not only claimed to have bribed Hunter and Joe Biden but possessed a total of 17 audio recordings of his conversations with them about the arrangement. He created the recordings as a sort of āinsurance policy.ā It was not clear whether the FBI had copies of the audio recordings or not.

Last week Reps. Marjorie Taylor Greene, Anna Paulina Luna, and Nancy Mace said that the foreign national identified in the FD-1023 form is Zlochevsky.
In addition to forming Burisma, Zlochevsky was Ukraineās Ecology and National Resources Minister from July 2010 through April 2012, and Deputy Secretary of the National Security and Defense Council from April 2012 through February 2014. He appointed Hunter Biden to the Burisma board in April 2014, and later that month his assets in the UK were seized by the Serious Fraud Office as part of a corruption investigation into Ukraineās former President Viktor Yanukovich. Also on Monday, House Oversight Committee Chair Rep. James Comer issued a subpoena to Devon Archer, who was also named to the Burisma board and was Hunter Bidenās business partner during the timeframe in question.

The bottom line on this for me is that even if Trump did something wrong here or even egregious, I canāt get past the overarching politics being involved in this prosecution from the beginning. Itās not just the fact that itās blatantly selective partisan prosecution. Itās also that this is part of Democratsā years-long agenda to destroy Trump and now Biden is trying to take out one of his main competitors in the 2024 election.

Itās not a new claim, but Donald Trump is correct in accusing the legal actions against him as politically motivated. There are two competing camps here. One is that the legal actions are meant to pressure him to quit the 2024 race, though another argument is to be made that these indictments are intended to infuriate the GOP base. Itās a move that will consolidate support around the former president, ushering him to be nominated as the official 2024 nominee for the Republican Party. The Democrats want this, as they feel heās easier to beat than Ron DeSantis.
The overarching theme is that the Justice Department and the FBI have been off the rails for years. What keeps them in the shade, hidden from any accountability, is that the media provides Iron Dome-like protection. Donald Trump indicted: Judge denies motion to allow cameras in courtroom

Magistrate Judge Jonathan Goodman denied a motion by various media companies to allow cameras inside of the federal courthouse in Miami, Florida, for former President Donald Trump's arraignment on Tuesday.
The late Monday filing by Goodman denied the argument by the media companies that the court appearance by Trump is a "special proceeding" and therefore regular rules on recording would be followed.
"The 'special proceedings' term referenced in the Local Rule is analogized to a proceeding akin to a naturalization proceeding," Goodman wrote in the filing. "Tomorrowās proceedings are undoubtedly 'special' in that they are genuinely historic and of huge importance, but they are not in any way similar to a naturalization proceeding."
"The motion does not cite any case or legal authority which would support the view that photographs are permitted tomorrow because the first appearance and arraignment are 'special proceedings,' as that term is used in the rule," he added.
Goodman cites rule 77.1 for the U.S. District Court for the Southern District of Florida as basis not nto allow photography, with the rule only allowing exceptions for "special proceedings" or "following a declaration of a local, state, or national emergency."
"All forms of equipment or means of photographing, audio- or video- recording, broadcasting or televising within the environs of any place of holding court in the District, including courtrooms, chambers, adjacent rooms, hallways, doorways, stairways, elevators or offices of supporting personnel, whether the Court is in session or at recess, is prohibited," the rule said.
The media companies included in the "Press Coalition" which filed the motion included CNN, ABC News, the Associated Press, CBS News, The Los Angeles Times, The New York Times, NBC News, and the Washington Post, among other news outlets.
In addition to the motion for the Tuesday hearing, Goodman denied the motion to allow any photography in further court proceedings arguing that he will "follow the 'stay in your lane' philosophy" and not rule on procedures for later court appearances. Goodman said he will only be handling Tuesday's court appearance in the case and after that "it is highly unlikely that I will be asked to remain involved."
Goodman said in the order he "coordinated with the court reporter to provide an expedited transcript" of the hearing he expects will be available on Tuesday.
Goodman told the media outlets to refile their motion on further court proceedings to Judge Aileen Cannon, who will oversee the case.
Trump is scheduled to appear in court at 3 p.m. on Tuesday, after he was indicted by a federal grand jury last week on charges related to his alleged mishandling of classified documents. He is the first former or current president to be federally indicted.

Trump to be arraigned in federal court in Miami, security measures tightened
The FBI raided Trump's Mar-a-Lago estate in August 2022 in search of classified documents.
Former President Donald Trump's arraignment takes place Tuesday in a Miami federal courthouse where he faces 37 counts as part of Special Counsel Jack Smith's investigation into alleged mishandling of classified documents at his Mar-a-Lago property.
The FBI raided Trump's Mar-a-Lago estate in August 2022 in search of classified documents.
Trump has referred to the charges as an abuse of power by the Justice Department, as he begins his campaign to become president again in 2024.
"The ridiculous and baseless indictment of me by the Biden administration's weaponized 'Department of Injustice' will go down as among the most horrific abuses of power in the history of our country," Trump recently said. "This vicious persecution is a travesty of justice."
Trump has continued to argue that he was protected under the Presidential Records Act to continue to negotiate with the National Archives about which documents he could keep.
Among Smith's charges is that Trump has violated the federal Espionage Act in taking at least some of the documents.
Judge Aileen M. Cannon, who Trump appointed as a federal judge in 2020, will oversee the case.
Meanwhile, President Joe Biden is facing an investigation into similar concerns about his handling of classified documents.
Classified documents were discovered in November at the Penn Biden Center in Washington by one of Bidenās lawyers. The documents were reportedly from when he served as former President Barack Obama's vice president, and additional documents were found at Biden's Wilmington, Del., home.
Attorney General Merrick Garland has appointed Special Counsel Robert Hur to look into Biden's handling of classified documents.
On Monday, in advance of his court appearance, Trump pledged on Truth Social to appoint a special prosecutor, if reelected, to investigate Biden and his family's business dealings.
During the 2016 presidential election, Trump vowed to appoint a special prosecutor to investigate his opponent, Hillary Clinton, but abandoned his plans when he took office. In July 2016, the FBI announced that Clinton was not facing charges for her use of a private email server while she was secretary of state under Obama.
Federal, state and local authorities are ramping up security at the courthouse ahead of Trumpās arraignment. Officials are reportedly monitoring social media and online forums for threats of violence.
In April, there were protests outside of the courthouse in New York during Trump's arraignment in a separate case involving hush money payments Trump allegedly made to porn star Stormy Daniels before he became president.
It is not clear if Trump's mugshot would be taken on Tuesday. Trump was not handcuffed and a mugshot was not taken after he was formally charged in the New York case.
