Utah Ritual Abuse Case: David Leavitt Caught in a Lie

New courtroom audio shows that David Leavitt was being less than truthful when he explained why charges were dropped in a sexual abuse case from 2012 involving a Utah therapist. Several news outlets have reviewed a 151-page victim statement from that case which names David Leavitt and about a dozen others as having been involved in the ritual abuse of children, including murder and cannibalism.

 

David Leavitt held a press conference specifically refuting those charges and he repeatedly described the author of the statement as “tragically mentally ill”. Sheriff Mike Smith in his own press conference objected to that characterization, saying “These are victims of crimes that have mustered the courage to come forward and this is what we call them is ‘mentally ill’. How dare you?”

 

David Leavitt went on to say that the charges in that case were dropped “because the allegations were so untenable and unbelievable.” Leavitt claimed he spoke to the original prosecutor, who told Leavitt “they dismissed it because the evidence was so outlandish.”

 

But according to court audio obtained by ksltv.com, attorneys in that case did not suggest that the allegations were unbelievable but that in fact they were very serious. The prosecutor for that case, David Sturgill, said in a hearing in 2013, “The allegations are some of the worst allegations of sexual abuse that I’ve come across in the many years that I’ve been prosecuting these types of cases.”

 

In a hearing in March 2014, Sturgill moved to dismiss the charges but with the intention of possibly refiling them at a later date. The charges were dismissed without prejudice, leaving that possibility open. Sturgill did not mention dropping the charges because they were outlandish but because of resistance from other agencies, difficulty in getting records and the age of the case. “There’s a lot more that needs to be done with this case, and it’s just not coming together,” Sturgill said. “I’m getting resistance from DCFS… and then there’s other medical records that we’re having some trouble gathering. A lot of it’s due to just the age of this case. It’s an extremely delayed disclosure.”

 

Meanwhile Mike Smith insists the investigation is ongoing and involves more than just the therapist.
