THEN ON JUNE 26 SCOTUS HANDS POTUS A BIG VICTORY ON IMMIGRATION EXEC. ORDER - AND JUDGE CLARENCE THOMAS RE-GIFTS IT WITH A HUGE GIFT TO POTUS AND ALL ANONS IN HIS CONCURRING OPINION

 

WHAT WAS IT? Thomas opened the door for a successful challenge to the out of control and partisan district court judges entering orders against the POTUS! Like us - he is sick and tired of it and pointed out to POTUS and Jeff Sessions - bring the case and we will strike down this over reach of District court power!!! This is yuge - NOW WE KNOW WHY THOMAS WAS JUST IN THE WHOITE HOUSE WITH A HAPPY POTUS JUST 3 DAYS AGO - COINCIDENCE? NO WAY.

 

Here is what Justice Thomas wrote - in part:

 

""Injunctions that prohibit the Executive Branch from applying a law or policy against anyone—often called “universal” or “nationwide” injunctions—have become increasingly common.

 

District courts, including the one here, have begun imposing universal injunctions without considering their authority to grant such sweeping relief. These injunctions are beginning to take a toll on the federal court system— preventing legal questions from percolating through the federal courts, encouraging forum shopping, and making every case a national emergency for the courts and for the Executive Branch.

 

I am skeptical that district courts have the authority to enter universal injunctions. These injunctions did not emerge until a century and a half after the founding. And they appear to be inconsistent with longstanding limits on equitable relief and the power of Article III courts. If their popularity continues, this Court must address their legality. ""

congress can pass a law limiting the scope of district court jurisdiction - ez and simple and 100% constitutional for them to do so

 

or DOJ can just insert that as a defense to the relief granted by the district court - frankly im surprised it hasnt already been done but with clear SCOTUS signal now it will

 

in history SCOTUS has initiated or encouraged congress and/or admin action in many ways many times

sometimes it works

sometimes not
