SAN FRANCISCO — The Catholic archbishop of San Francisco says the Archdiocese may seek bankruptcy protection because of claims of child sexual abuse filed against it.

 

Rev. Salvatore J. Cordileone, in a letter to parishioners posted Friday on the archdiocese's website, said that a Chapter 11 bankruptcy reorganization "is very likely."

"Chapter 11 would allow the archdiocese to reorganize its financial affairs to continue its vital ministries to the faithful and to the communities that rely on our services and charity," Cordileone said.

The archdiocese sold excess property and drew on insurance to pay about $68 million to about 100 plaintiffs to settle claims filed under a 2002 state law, the archbishop said.

 

In 2019, the state lifted a statute of limitations allowing about 500 additional sexual abuse claims to be filed, he said.

 

The bankruptcy move is coming now because "the judge assigned to us has set an imminent trial date for one of the initial cases," Cordileone said.

The archbishop cited the difficulty of trying to defend against the lawsuits.

 

"The vast majority of the alleged abuse occurred in the 1960s, 1970s, and 1980s and involved priests who are deceased or no longer in ministry,"

he said. "In addition to deceased individuals who can no longer defend themselves, a significant number of these claims include unnamed individuals or named individuals who are unknown to the Archdiocese."

A bankruptcy filing would cover only the legal entity known as "The Roman Catholic Archbishop of San Francisco, a Corporation Sole," he said.

 

"The operations of our parishes and schools should continue as usual without disruption, as should the activities of the archdiocese," the archbishop said.

 

"I am deeply saddened by the sinful acts and the damage caused to the lives of innocent children who put their trust in priests, staff, and volunteers of the church," Cordileone said.

"I pray for the survivors every day that they will someday find peace."

 

An organization known as the Survivors Network of those Abused by Priests criticized the bankruptcy proposal.

"It is all about protecting secrets first, and second, to reduce just compensation to the victims they have created," the organization said in a statement Friday.

 

"We seriously doubt that the Archdiocese of San Francisco does not have the assets to settle these lawsuits," said the statement, distributed by Melanie Sakoda, SNAP Survivor Support Director.

"But we do know that San Francisco is one of a handful of dioceses that has not published a list of abusers, and also that when such lists are published, there are always new perpetrators revealed from information in the 'secret files.'"

The San Francisco Archdiocese of the Roman Catholic Church is “very likely” to file for Chapter 11 bankruptcy protection due to the financial fallout after hundreds of sexual abuse lawuits against the church,

the archdiocese said Friday.

 

Archbishop Salvatore Cordileone issued a statement Friday afternoon, after questions from the Chronicle, saying:

“After much contemplation and prayer, I wish to inform you that a Chapter 11 bankruptcy reorganization is very likely.”

The archbishop said the Chapter 11 process would allow the archdiocese to deal with the cases collectively rather than one at a time and would allow the archdiocese to reorganize its finances and continue operations.

 

A bankruptcy filing by the San Francisco archdiocese would follow a similar action by the Diocese of Oakland, which filed for Chapter 11 bankruptcy protection on May 8,

saying it “could not shoulder the burden of litigating 330 cases.” Other dioceses and archdioceses across California and the rest of the country have also filed for bankruptcy.

 

The San Francisco Archdiocese faces more than 500 civil lawsuits related to sexual abuse cases. The archbishop said the majority of those cases “occurred in the 1960s, 1970s,

and 1980s and involved priests who are deceased or no longer in ministry.”

Cordileone’s statement, followed by a series of questions and answers, appeared on a page on the archdiocese’s website titled “Protecting Children.”

The archbishop said the bankruptcy would cover only the corporate legal entity, the Catholic Archbishop of San Francisco, and not its parishes and schools.

 

“The operations of our parishes and schools should continue as usual without disruption, as should the activities of the Archdiocese,”

he wrote. “The Archdiocese would join a growing list of dioceses in the United States and California that have filed for protection under the bankruptcy laws.

Some of these dioceses have already restructured and emerged from this process.”

 

The archbishop said the Chapter 11 proceedings would allow lawsuits to be resolved quickly, easily and fairly.

 

A representative of the nonprofit Survivors Network of those Abused by Priests, Dan McNevin, criticized the archdiocese for the potential move.

 

“San Francisco’s bankruptcy will stiff-arm survivors who have the courage to tell their stories.” he said. “If it is allowed to stand, bankruptcy halts trials, testimony, legal discovery,

and the release of the files of priests and other perpetrators that, if released could be used to assess who in the organization helped to cover up crimes.

So for the San Francisco (archdiocese), it’s a double bottom line benefit; they keep their secrets and they keep more of their wealth.”

 

A Chapter 11 filing, the archdiocese acknowledged, would freeze litigation and make their collective settlement part of the financial reorganization plan determined by the bankruptcy court.

Chapter 11 is commonly referred to as a “reorganization bankruptcy.” It allows the debtor to continue to operate while it works with the court and creditors to work out payment plans.
