I think I finally figured out why the military is the only way. When Bonging said that the Secret Service would never let Trump go to jail because they have responsibility for his safety, it occurred to me that they will not let anyone under their protection go to prison. That means that all presidents and whoever else is protected by SS cannot be tried through our criminal justice system for any crimes deserving prison time. They will never receive jail time under the criminal system for civilians.
The only way for them to be tried and be punished is the military justice system. This is what Lindsay Graham was questioning Kavanaugh about.
