Wouldn't a citizen who contracted a previously eradicated disease from an illegal immigrant/invader have standing in court, having suffered damages, to sue the government to enforce immigration laws already on the books?

Couldn't a group of victims inflicted by demonstrably imported diseases be able to mount a class action suit, citing damages?

Couldn't we crowd fund such a suit to force the government to close the border and expel the illegals? If's the governments negligence in due diligence enforcing immigration law and defending the border that has caused the "damages" which give the victims clear "standing" to mount court cases against the government.
