A watchdog group filed a lawsuit to ban former President Donald Trump from the Colorado Republican primary ballot, arguing that his candidacy is prohibited under a clause in the U.S. Constitution that disqualifies officials from public office if they have participated in an "insurrection."

 

The group, Citizens for Responsibility and Ethics in Washington, which was founded in 2003 to counter the conservative Judicial Watch, filed the lawsuit Wednesday on behalf of six Republican and unaffiliated Colorado voters. The group is arguing that under Section 3 of the 14th Amendment, "Trump must be removed from the ballot" because he "violated" his oath to the U.S. by "recruiting, inciting and encouraging a violent mob that attacked the Capitol on January 6, 2021 in a futile attempt to remain in office."

 

Section 3 states that no state or federal official who has taken an oath to support the U.S. "shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof." The amendment, which was passed during post-Civil War Reconstruction, also allows for the House to impeach such a person.

The Justice Department on Thursday released the results of a report finding that the state of New Jersey "failed" veterans in two state-run nursing homes during the COVID-19 pandemic.

 

The veterans were placed in "serious risk of harm" during the COVID pandemic in the New Jersey Veterans Memorial Homes at Menlo Park and Paramus because facility leadership did not implement safety policies such as asking and handwashing, the Justice Department said in a 43-page report.

 

The conditions were so abhorrent that they violated the U.S. Constitution's 14th Amendment, officials said, citing how the residents faced "unreasonable harm and risk due to inadequate infection control practices and inadequate medical care."

 

For example, before the COVID pandemic, about 100 residents died in each of the veterans homes every year. "In April 2020 alone, 98 Menlo Park residents and 92 Paramus residents died, of all causes," the Justice Department also said.

The consumer goods company 3M agreed to pay more than $6.5 million to resolve charges that it violated the Foreign Corrupt Practices Act after its China-based subsidiary took Chinese government officials on overseas trips in an attempt to convince them to purchase 3M products, the U.S. Securities and Exchange Commission said.

 

From 2014 to 2017, 3M's Chinese subsidiary took Chinese government officials on trips for overseas conferences and health care facility visits, which included guided tours, shopping excursions, day trips to nearby attractions and other leisurely activities, the SEC said when announcing the agreement late last week.

 

The employees of the subsidiary had created a travel itinerary with legitimate events along with alternate itineraries featuring tourist activities near the main events. The employees had asked the travelers to remain quiet about the alternate agenda and they falsified internal compliance documents, according to the SEC.

A court in Arizona ruled that the Secretary of State office's ballot signature verification guidance does โ€œnot have the force of law,โ€ dealing a blow to the stateโ€™s Democrat leaders.

 

The ruling in the Superior Court of Yavapai County came after an election integrity group challenged Arizonaโ€™s new Elections Procedures Manual (EPM).

 

โ€œThis portion of the EPM and the instruction from the Secretary do "not have the force of law," Judge John Napper wrote in the Sept.1 ruling.

 

Napper decided not to dismiss a complaint filed by an election integrity group, Restoring Integrity and Trust in Elections (RITE) against Democrat Secretary of State Adrian Fontes.

 

The complaint alleges that Arizonaโ€™s EPM does not have lawful signature-match guidance. These manuals determine how Arizona runs elections.
