Julia Ormond Sues Harvey Weinstein for Battery, CAA and Disney as Enablers of Sexual Assault (EXCLUSIVE)

 

Julia Ormond, the actress known for '90s films such as “Legends of the Fall,” is suing Harvey Weinstein with CAA, Disney and Miramax as enablers.

 

Ormond is additionally suing CAA, The Walt Disney Company and Miramax. While Weinstein has been named as the defendant in numerous sexual assault lawsuits since exposes published in 2017 in The New York Times and New Yorker uncovered his alleged patterns of misconduct toward dozens of women in the entertainment industry, it is rare for business partners that profited from Weinstein’s work to be named as defendants for supposedly enabling his behavior.

 

In a lawsuit filed Wednesday morning in New York Supreme Court, obtained by Variety, Ormond claims that Weinstein sexually assaulted her in 1995 after a business dinner when he lured her into giving him a massage, climbed on top of her, masturbated and forced her to give him oral sex.

 

After the alleged assault, Ormond informed her agents Bryan Lourd and Kevin Huvane what had happened with Weinstein, according to the lawsuit, which states that the CAA agents cautioned her from speaking out and did not protect her. (Lourd and Huvane, who today are co-chairmen of CAA, are not named as defendants, but are frequently mentioned throughout Ormond’s suit as her representatives at the time.)

 

Ormond is suing CAA for negligence and breach of fiduciary duty.

 

Miramax, the company that Weinstein co-founded with his brother Bob, and The Walt Disney Company, which owned Miramax in the 90s, are being sued for negligent supervision and retention. (Numerous former Miramax and Disney executives are cited in the lawsuit, including Michael Eisner, who was Disney’s CEO, at the time, and Jeffrey Katzenberg, who was chairman of Disney, though they are not defendants. The Disney execs mentioned in the lawsuit are no longer working at the company.)

 

“The men at CAA who represented Ormond knew about Weinstein. So too did Weinstein’s employers at Miramax and Disney,” the lawsuit states. “Brazenly, none of these prominent companies warned Ormond that Weinstein had a history of assaulting women because he was too important, too powerful, and made them too much money.”

 

CAA, Disney and Miramax did not immediately respond to Variety’s request for comment.

 

Weinstein — who has been convicted of rape in two jurisdictions, and has been accused by more than 100 women over the course of decades — denies Ormond’s allegations.

 

In a statement to Variety, his attorney, Imran H. Ansari, says: “Harvey Weinstein categorically denies the allegations made against him by Julia Ormond and he is prepared to vehemently defend himself. This is yet another example of a complaint filed against Mr. Weinstein after the passing of decades, and he is confident that the evidence will not support Ms. Ormond’s claims.”

 

In a phone interview, Ormond tells Variety that she is speaking out because she wants to be part of the change that can make Hollywood and other workplaces safer from sexual predators.

 

“I am coming forward with my story now publicly because I feel as if we still need systemic change, and I feel that we need accountability from enablers, in order to get there,” Ormond tells Variety. “I feel that this is what happened with me.”

 

Ormond is filing her suit under the Adult Survivors Act, which creates a look-back window outside the statute of limitations. The Adult Survivors Act was passed after the #MeToo movement, and Ormond says she’s able to share her story because of the courage of other women and survivors. Ormond hopes that by sharing her story, she can make an impact in corporate transparency regarding reporting structures in the workplace and the use of non-disclosure agreements to silence victims.

 

“Obviously, Harvey Weinstein is in jail and is going to be in jail for a very long time. I personally don’t believe that Harvey could have done this without enablers. And for me, that is the layer that you have to get down to, in terms of the root cause,” Ormond says.

 

“If you think about it,” she continues, “If there had been best practices and Harvey Weinstein had been called out at the start after his first sexual harassment or his first sexual assault, he could have learned different behaviors, and potentially all of the people that followed wouldn’t have been harmed. But he wasn’t. And there’s a reason for that.”

That is what matters in elections. Not whether Speaker Kevin McCarthy is replaced a year beforehand. Where do we go from here?

 

Oh, no! McCarthy … For the first time in history … And the House is in chaos … And the Republicans cannot govern … And Matt Gaetz just handed the 2024 presidency to Joe Biden.

 

Get real.

 

The November 2024 election will be decided by specific discrete things:

 

Events that unfold in the last 4 weeks before November 2024.

Whether the GOP can do better at getting out an early turnout.

How the GOP deals with vote harvesting, unsupervised drop-box voting, and six-week election windows.

How the GOP handles poll watching and vote counting.

 

Th-th-the-that’s all, folks.

 

It won’t matter how many more indictments are filed against Donald Trump or how many convictions juries have handed down by then, or even whether he is in prison by then. The months of no baby formula in America won’t matter. Supply-chain disasters won’t matter. The catastrophic derailment in Palestine, Ohio, won’t matter. All the times Biden talked to himself, walked in circles, nibbled on children, and got led around by a bunny rabbit won’t matter. And certainly the House speakership change won’t matter.

 

All that will matter are the above delineated factors.

 

I have been following politics closely since 1971, when, as a high school kid, I campaigned for my local city councilman in Brooklyn. That’s more than half a century of being a political hawk and junkie. In those days, I used to think that every cataclysmic event would impact an election. I have been a youth, and I have aged, and I have learned that it does not. If it did, there really would have been a Republican wave in 2022 after economic chaos, food prices through the roof, no baby formula, Kamala moronic, and Biden catatonic. But in the end, Afghanistan did not matter. Kamala’s insane giggling did not matter. Rather, what mattered was getting out the early vote. Ron DeSantis understood this in Florida, as did Brian Kemp in Georgia.

 

And it mattered to run acceptable candidates. Dr. Mehmet Oz is a dignified guy, a media celebrity like the sort Trump loves. But he was a carpetbagger from neighboring Jersey. If the GOP had run the other guy, David McCormick, they would have defeated that partly demented, disgusting zhlub in the hoodie, shorts, and sneakers without socks. Likewise, in Georgia, Trump’s terrible error in December 2020 urging Georgian Republicans not to bother voting because the system is rigged led to the election of Raphael Warnock, and that gave him the advantage of incumbency in 2022 when he ran against a thoroughly unacceptable opponent, who had fathered more kids than do most goats and had a terrible hidden history that was bound to come out at election time. But, again, Trump — whom I heartily endorse for reelection, as you will read in my next column — goes for celebrities. Alas, not all voters do.

“Trump’s comments were offensive. They were baseless. Mayorkas suddenly decides that walls work

 

Mayorkas declares ‘immediate’ need for border wall in Texas, waives 26 environmental laws

 

Homeland Security Secretary Alejandro Mayorkas said Wednesday there is an “acute and immediate need” to build border wall in southern Texas, and issued an order waiving some of the country’s most iconic environmental protection laws to speed up construction.

 

Mr. Mayorkas identified dozens of miles of border where he plans to build a barrier and roads, and where he indicated those environmental laws would be a hindrance.

 

“There is presently an acute and immediate need to construct physical barriers and roads in the vicinity of the border of the United States in order to prevent unlawful entries into the United States in the project areas,” Mr. Mayorkas said in an official filing in the Federal Register. “In order to ensure the expeditious construction of the barriers and roads in the project areas, I have determined that it is necessary that I exercise the authority that is vested in me by section 102(c) of IIRIRA.”

 

The Illegal Immigration Reform and Immigration Responsibility Act gives the Homeland Security secretary the power to waive laws when necessary to facilitate border construction.

 

Mr. Mayorkas’s waiver covers 26 federal laws, including the Endangered Species Act, the Clean Air Act, the Clean Water Act, the Eagle Protection Act and the Native American Graves Protection and Repatriation Act.

 

The secretary had previously announced he would build miles of wall, countering President Biden’s 2020 campaign promise that there would “not be another foot of wall constructed” by his administration.

 

Mr. Mayorkas said his hands were tied by the spending bills Congress passed, which required money be used for border wall construction. The administration delayed for several years, and pleaded with Congress to revoke the money, but those efforts failed.

 

But to declare the wall an “immediate” need and to waive the laws was too much for environmental groups.

 

“It’s disheartening to see President Biden stoop to this level, casting aside our nation’s bedrock environmental laws to build ineffective wildlife-killing border walls,” said Laiken Jordahl at the Center for Biological Diversity. “This is a horrific step backwards for the borderlands.”

 

The center said this is the first time the Biden administration has used the wall waiver authority.

 

The Trump administration was prolific with waivers as it built more than 450 miles of wall, drawing fierce condemnation from environmentalists.

 

A Government Accountability Office report last month said wall construction caused “significant damage” to sites sacred to Native Americans living along the border. The GAO dinged the government for failing to consult with communities about mitigating the impacts of the wall.

 

But GAO also took issue with Mr. Biden’s 2021 decision to halt construction, pointing out it also stopped remediation efforts to repair lands that had been disturbed during the building.

Rep. Steny Hoyer (D-MD) was also asked to vacate his hideaway office. House Republicans are getting what revenge they can get for Democrats working with Matt Gaetz. In the meantime, Republicans must sprint to find someone for speaker who can get 218 votes unless they want to own this political disaster in the House
