President Trump Lawyers File Motion for Dismissal in DC J6 Case on First Constitutional Grounds – Presidential Immunity

As expected, the first legal motion to dismiss the DC January 6 case is based on the first constitutional application, presidential immunity. [Full Filing pdf HERE]

 

President Trump’s attorneys John Lauro and Todd Blanche say within their first filing that special prosecutor Jack Smith’s case against President Trump is an attempt to criminalize actions that were well within his White House duties, such as enforcing federal election laws.

 

“The Constitution, the Supreme Court, and hundreds of years of history and tradition all make clear, the President’s motivations are not for the prosecution or this Court to decide. Rather, where, as here, the President’s actions are within the ambit of his office, he is absolutely immune from prosecution.”

It is a strong and compelling argument, citing numerous prior cases and rulings on the plenary power of the executive and the constitutional establishment of the President as the absolute power within the executive branch. The argument hits one of three core tenets that Jack Smith has used to establish his case.

 

Even left-leaning Politico seems to accept the foundation of the DC Smith case weakens when contrast against the executive power of the president.

 

[The] prosecutors’ case is really about distinct powers that the president has: communicating with the public, organizing his administration, talking to Congress, enforcing election laws and ensuring the Constitution is faithfully executed. Whether Trump genuinely believed that the election was stolen — which his attorneys say he did — is irrelevant in assessing his immunity from prosecution, they argue.

 

“This conduct is manifestly part of the President’s responsibilities in our constitutional tradition, and the question whether the President has a formal role in the election certification process makes no difference,” the attorneys wrote.

“The Impeachment Clauses provide that the President may be charged by indictment only in cases where the President has been impeached and convicted by trial in the Senate,” the attorneys wrote. “Here, President Trump was acquitted by the Senate for the same course of conduct.”

 

The Senate acquitted Trump despite a 57-43 majority favoring his conviction because of a two-thirds requirement in the Constitution. At the time, Trump was charged with one count — inciting insurrection — related to his speech to a rally crowd that later became the mob that stormed the Capitol on Jan. 6, 2021. President Trump NYC Attorney Alina Habba Gives Great Breakdown of NYC Trial Status

Alina Habba is one of the key attorneys on the civil case in New York City. Within this interview with Larry Kudlow, Habba gives a great overall status update on the case and draws some interesting points that I was unfamiliar with.

 

The New York AG is using a “consumer fraud statute” as the cornerstone of the case. If you think about it, when it comes to the lender/borrower dynamic, Donald Trump is the consumer in the transaction. The statute that was created to protect the consumer from predatory lenders is being twisted by Lawfare against the consumer, presumably under the auspices of protecting the lenders. The case is built upon a fraudulent premise, reversing the intent of the statute being used. WATCH:

Obviously,I do not personally like this idea, as I think it’s just another bondo and spray paint applicationupon the Republican wing of the UniParty. However, oddly enough when John Boehner stepped down, I wanted to see Jim Jordan instead of Paul Ryan. Goes to show how rapidly the machinery in DC can compromise someone.

 

Ukraine will get funded. Jordan will be the arbiter of which DC inhabitants will be protected from subpoenas; theHouse will change the rules to protect him. The door nameplates change, and everyone goes back to business as usual. Meh, I wonder who will be placed as chair of the Judiciary Committee and Weaponization Committee?

 

(I agree Jordan only got the light from Nunes, Kash and Col. Henry. His patriotism has reduced significantly since they left. He is a parrot for the uniparty now. Jordan knew exactly what McCarthy was doing, but Jordan was compromised, that’s why he has no bravery left.)

He did clarify he has not run out of money, but he will never settle.

A recent Gallup poll found that Americans trust the GOP more than the Democrats on the economy by the largest margin in more than three decades. More than half of Americans, 53%, trust the GOP, compared to 39% who say they trust the Democrats. It wasn’t the only issue Republicans had a significant advantage on, either, but the economy tends to be one of the most, if not the most important issue that tips an election one way or another.

 

And as bad as things look for Joe Biden and the Democrats now, next year could be even worse. According to a Fox Business report, “a growing amount of data indicates that a gigantic economic crisis could be right around the corner,” and one such indicator suggests a crash comparable to the Great Depression.

 

“When President Biden entered the White House in January 2021, it appeared that the economic crisis caused by the pandemic lockdowns would end soon. A COVID-19 vaccine had been developed, and many states had already started re-opening or preparing to re-open their economies,” writes Justin Haskins at Fox Business. “But rather than return spending to normal levels, Biden and congressional Democrats – with the blessing of the Federal Reserve – opted to keep government expenditures significantly higher than they had been prior to the pandemic.”

 

Because of that, inflation reached historically high levels, causing the prices of almost everything to skyrocket. In an effort to “fix” the problem, the Fed started increasing interest rates last year, but the Biden administration hasn’t reduced spending. “As a result of these policies, the inflation rate has dropped, but not enough to deflate prices. Most consumer goods and services, as well as rent and housing prices, remain much higher than they were before the pandemic started,” Haskins explains. “Incredibly, however, the money supply – the amount of cash, checkable deposits and bank savings accounts – has substantially decreased. That means even though prices are still going up, the amount of money available is continuing to drop, putting an unprecedented strain on American families.”

 

The last time that the money supply dropped this sharply was in the early 1930s, during the Great Depression. However, there’s a key difference this time.

 

In the 1930s, when the money supply annual rate turned negative, prices dropped as well. In our current situation, prices are still going up despite the collapse in the money supply. To the extent we’re seeing it today, this has never occurred before.

 

Economists have been predicting a recession is coming either later this year or in 2024 for some time now, but these indicators suggest things could be even worse than previously predicted. Economic downturns are typically blamed on the party that has the White House, and considering Biden has been taking ownership of the economy with his whole “Bidenomics” push, it’s hard to see how Biden and the Democratic Party won’t be creamed in the 2024 elections if there’s an economic downturn in 2024.

 

And make no mistake about it, in the event of a recession in 2024, Joe Biden will attempt to blame Republicans.

German opposition party leader was attacked, medical exam suggests

A medical examination of Tino Chrupalla, the co-chair of the right-wing party Alternative for Germany (AfD), has confirmed the politician was attacked with a syringe, the party said in a statement on Friday.

 

Citing a letter from the Ingolstadt Clinic, the party said the politician sustained a syringe puncture on his “right upper arm.” The medical examination also indicated the politician was injected intramuscularly with a “yet unknown substance.”

 

“Forensic toxicology analysis is ongoing,” the party added.

 

The incident occurred at a campaign event in Ingolstadt on Wednesday, when the politician collapsed after taking selfies with the participants of the rally. The AfD immediately alleged Chrupalla had been assaulted during the event. The politician ended up in the intensive care unit of Ingolstadt hospital.

 

Shortly after the alleged attack, sources confirmed it to RT.de, claiming the party’s co-chair suffered anaphylactic shock, apparently caused by the substance from the syringe. A party spokesperson further elaborated on the matter on Thursday, stating that Chrupalla had sustained a “puncture wound” and was being tested for “substances in his body.”

 

That account of events, however, has been disputed by German authorities, who stated on Thursday that there was “no evidence” of an attack on Chrupalla.

 

“At this time, there is no evidence that Mr. Chrupalla was tackled or attacked,” the Ingolstadt public prosecutor’s office and police said in a joint statement.

 

Chrupalla’s personal security detail did not witness any physical assault on the politician, authorities claimed. Local media reports also said no needles or similar objects were recovered from the scene by police except for two push-pins.

Russian authorities charge former top Ukrainian officials

The criminal cases center on Kiev’s military action against Donbass in 2014, according to the Investigative Committee

 

Russia’s Investigative Committee has announced it is bringing charges in absentia against several former top Ukrainian officials, over their role in military attacks on Donbass in 2014. Their alleged actions led to the death or injury of over a thousand people in the then-breakaway Donetsk and Lugansk People’s Republics, Russian officials have claimed.

 

In a statement released on Friday, the Investigative Committee stated that former secretary of the National Security and Defense Council Andrey Parubiy, former Prosecutor General Oleg Makhnitski, and chairman of the State Border Guard Service Nikolay Litvinov had all been charged. In April 2014, the three officials voted in favor of conducting an ‘anti-terrorist’ operation in the Donetsk and Lugansk People’s Republics, which joined Russia after referendums in 2022.

 

Protests broke out in Donetsk and Lugansk Regions – then part of Ukraine – soon after the Maidan coup in Kiev in February 2014, which overthrew the country’s democratically elected government. Locals in the predominantly Russian-speaking eastern regions expressed concern that the far-right elements that had come to power in the country would discriminate against them. Activists calling for autonomy or secession began seizing administrative buildings and erecting barricades.

 

In April of that year, several leaders of the movement proclaimed the creation of the Donetsk People’s Republic in parts of the region, with similar events unfolding in neighboring Lugansk Region.

 

In the following months, Ukrainian forces carried out numerous strikes on the self-proclaimed Donetsk and Lugansk People’s Republics, killing and maiming more than 1,200 people and damaging over 140 pieces of infrastructure, the statement said. Russian investigators said that “measures are being taken to search for and arrest the suspects.”

 

The Donetsk and Lugansk People’s Republics were incorporated into Russia after referendums last fall along with Kherson and Zaporozhye Regions.
