3 black senators introduce bill to make lynching a federal hate crime. Sponsored by Sens. Kamala Harris, D-Calif., Cory Booker, D-NJ, and Tim Scott, R-SC.

 

The proposed legislation cites more than 4,700 lynchings reported in all but four states between 1882 and 1968, calling lynching the "ultimate expression of racism in the United States following Reconstruction" and noting that "99 percent of all perpetrators escaped punishment by state or local officials."

Section 249 of title 18, United States Code, is amended by inserting after paragraph 3 the following:

 

“(4) OFFENSES INVOLVING LYNCHING.—Whoever, whether or not acting under color of law, willfully, acting as part of any collection of people, assembled for the purpose and with the intention of committing an act of violence upon any person, causes death to any person, shall be imprisoned for any term of years or for life, fined under this title, or both.”.
