Rs currently have a 51-49 majority in the senate.
Pence only votes if there is a tie.
If No name doesn't vote, Rs could still take it 50-49
1 other R would have to not vote as well in order to even trigger a Pence tie-breaker (win).
If you had every Democrat and 1 R vote no, that would trigger a Pence tie-breaker (win).
In order for the confirmation to fail, you'd need to see a minimum of:
-Every D vote no
AND
-1 R not voting, and 1 R voting no
[or]
-2 Rs voting no
In reality with this being before the midterms, they will probably get a few D votes from R states, and so should have the votes no matter what.
