Like I said, This Law from 1991 was never legally challenged, but I can tell you for a fact that it is unconstitutional. A judge renders judgements which cause executable actions to be carried out by the executive law enforcement branch of government. If a judge thwarts the right to a jury or any of it's verdicts and becomes "the sole trier of fact" then the judge is essence has become the "Judge, Jury, and Executioner". Just as if someone laid a shotgun trap for intruders inside his house and that intruder gets shot, it is as if the home owner shot the intruder himself, and by the law, there is no distinction between the twp, fact. Therefor if a judge's judgment renders actions by law enforcement that must be carried out it is equally the same as if the judge was the executioner in fact, in the same there is no distinction between the two.
