I am thinking each sealed indictment represents one set of facts with generally multiple defendants. We have speculated before that there could be many defendants per sealed case. Now I am thinking that is most certainly true. With so many, it makes sense to try groups who participated in the same activities together (RICO). Defense lawyers will try to sever the cases claiming it's needed for a fair trial for their client, but my guess is the military judges in the tribunals will expedite the cases and not try them sequentially one defendant at a time.

 

So I am more confident than before, that 40,000 represents the number of factual situations with criminality, each case having multiple, sometimes many many, defendants.

We shall see.
