a little digging indicates that we had the right to privately prosecute federal criminal cases before 1981, but the SC struck that right down.

 

some states still allow it - and there are cases wherein a federal prosecutor can specify private individuals.

 

it's little used, and would seem odd - but it's the kind of end-around play that i'd expect in this amazing dance we're watching unfold.

and using wikipedia as a terrible source, i count eight states which would allow for at least procedings to be filed/kicked off by private citizens.

 

Idaho, Kentucky, Maryland, North Carolina, Ohio, Pennsylvania, Texas, and Virginia.

 

there are several states which don't seem to have a precedent ruling against it, but this might not be the time to test.
