The CMB’s (California Medical Board) investigation against Dr. Gold is a flagrant abuse of power to silence license-holders who might otherwise speak out
Our legal team and Dr. Gold recently completed a grueling three-day long medical licensing hearing against the California Medical Board (CMB).
Throughout the proceedings, the CMB's mid-level prosecutor made multiple attempts to delegitimize Dr. Gold, but faced formidable resistance from this seasoned ER doctor, lawyer, and advocate for freedom.

This case will determine the range of free expression and professional licensure in California. When unchecked, California winds up pulling the nation toward disastrous national policies.
The Hearing
The California Medical Board sought to portray Dr. Gold as lacking professional ethics and judgment without presenting any witnesses at all.
Notably, the prosecutor did not assert any negative actions by Dr. Gold related to patient care. Instead, her inquiries focused on Dr. Gold's political opinions and viewpoints, alleging a lack of "remorse" for her health freedom speech on J6.
Dr. Gold clarified that she complied with all judicial orders, her advocacy on J6 was unrelated to medical practice, and the CMB was targeting her for political beliefs, constituting illegal viewpoint discrimination.
Our attorneys objected to the irrelevant political questioning, emphasizing Dr. Gold's First Amendment right to freedom of expression on J6.
We presented evidence that the Board has never attempted to revoke a medical license over a non-medical misdemeanor and revealed the CMB's numerous attempts to punish Dr. Gold.
Dr. Gold's impeccable decades-long career, supported by character witnesses and sworn testimony and declarations from many other licensed physicians, further undermined the CMB's dubious claims.
A former ER colleague, when questioned about the complaint, couldn't connect the allegations to the practice of medicine, echoing the confusion expressed by other character witnesses.

The decision of the hearing now rests with the Administrative Law Judge, and he has thirty days to tailor his decision. Incredibly, however, the CMB has the ultimate legal authority to accept, reject, modify, or even overrule the ALJ’s decision.
