It is way past time to address the elephant in the room.
Unconstitutional rulings at any level need to count as "strikes" against a judge keeping their position on the bench. Three strikes within a period of say, 5 or 10 years, and the judge is out! Resume generating event!
Just like moving violations against a drivers' license, the strikes will be allowed to age out, so good judges having a few bad rulings can recover and stay on. Bad judges who regularly rule contrary to the constitution will be looking for their golden parachute in short order.
A similar type of program needs to be instituted against activist prosecutors. If one loses a case due to lack of evidence or a jury ignoring the facts, no foul. If a prosecutor even files a questionable case that is later thrown out on constitutional grounds, then it is a "strike."
