The courts and the DA are suing on behalf of the "People of NYS" and the banks using 63-12 of which:

a: They cannot sue on behalf of private banks especially when the banks haven't brought suit.

b: "The People of NYS" are not affected by the agreements of banks and Mr Trump's private financial transactions. They are not made a dime richer or poorer whether there is a default or not.

c. The case is moot for lack of standing under the identity of "The People of NYS", as the people are not affected. And because they denied Mr Trump impartial jury that violates his 6th Amendment right to a fair jury, making the case moot also according to the Supreme clause of the USA.
