Toddler sexually assaulted in bathroom by former Galleria employee

HOUSTON - A former Galleria employee was arrested and charged for recording the sexual assault of two toddlers involving at least six other men.

Arthur Hector Fernandez III, 29, is charged with the sexual exploitation of children after the FBI said videos were found on a forum on the dark web by the Australian Centre to Counter Child Exploitation (ACCCE) and provided to them.

In disturbing and graphic court documents, four videos were described in which two toddler males were seen being sexually assaulted by multiple men in different settings.

In one specific video, FBI documents say one of the toddler males was seen in what appeared to be a public restroom lying on a changing table being assaulted by one man while Fernandez is allegedly the person recording.

The assault of the second toddler in the other three videos provided by ACCCE was described in court documents and seemed to be during different instances, one of which the child was seen on what appeared to be a changing table. There are different men seen in each of the three videos, with Fernandez being in at least two of them.

The toddlers were later discovered to be between the ages of two and three years old.

According to the FBI, they were able to identify Fernandez through relatives of the two male toddlers who identified the clothes the children were wearing in sanitized images from the videos.

The relatives of the two toddlers also recognized the silver bracelets seen on one of the man's wrists in the videos, now identified as Fernandez, which were a chain-style bracelet with a dolphin charm and a solid beaded bracelet.

In one of the videos, a pair of white, low-top Converse All-Star shoes were seen on the floor, records state. When FBI Houston conducted a search warrant on the address listed for Fernandez, they found three pairs of white, low-top Converse All-Star shoes, electronic devices that could store child sexual abuse material, and other electronics.

Court documents say the relative of the first toddler had been called into work at the Galleria on her day off but did not have time to find care for the young boy, so she brought him with her to the mall. Fernandez, who also worked at the Galleria Mall at the time, offered to watch the toddler while she worked. This is the only time Fernandez has been alone with the child.

This incident appears to have happened on May 6, 2023, officials say. It is also assumed to have occurred in a bathroom at the Galleria Mall, as court documents state, "The Galleria Mall has public restrooms, private stalls, and changing tables."

The relative of the second toddler described a similar situation where she brought the young boy to work when she couldn't find a babysitter and Fernandez would offer to watch the toddler and walk around the mall with him.

According to the relative, Fernandez also watched the toddler two other times without her present, once in December 2022 and again on Oct. 31, 2023, to go trick-or-treating.

"I think as parents you want to go with your gut, but also as policymakers, people need to start figuring out how do we figure out we have safe environments for our kids so parents don't have to wait on a creepy uncle or a neighbor they think is safe," Dr. Bob Sanborn.

He says parents should look out for certain telltale signs that their child may have been abused.

"Kids, after they’ve been out with someone who you thought you trusted them, they will sort of withdraw. They’ll be more quiet. Look for those changes in your children; bedridden, not eating. All these things are sort of signs that something’s not right with your child. In this case, we’re talking about toddlers. They really couldn’t communicate. They don't know what’s right and wrong," Dr. Sanborn said.

Rabbi Nuchem Rosenberg recently sat down with me to explain what he described as a "child-rape assembly line" among sects of fundamentalist Jews.

Seven years ago, Rabbi Rosenberg started blogging about sex abuse in his community and opened a New York City hotline to field sex abuse complaints. He has posted appeals on YouTube, appeared on CNN, and given speeches across the US, Canada, Israel, and Australia. Today, he is the lone whistleblower among the Satmar. For this he is reviled, slandered, hated, feared. He receives death threats on a regular basis. In Yiddish and Hebrew newspapers, advertisements taken out by the self-described "great rabbis and rabbinical judges of the city of New York" have denounced him as "a stumbling block for the House of Israel," "a public rebuker and preacher of ethics" who "persists in his rebelliousness" and whose "voice has been heard among many Jewish families, especially young people in their innocence… drawn to listen to his poisonous and revolting speeches." Leaflets distributed in Williamsburg and Borough Park, the centers of ultra-Orthodoxy in Brooklyn, display his bearded face over the body of a writhing snake. "Corrupt Informer," reads one of the leaflets, followed by the declaration that Rabbi Rosenberg's "name should rot in hell forever. They should cut him off from all four corners of the earth."

When Rabbi Rosenberg wants to bathe at a mikvah in Brooklyn to purify himself, none will have him. When he wants to go to synagogue, none will have him. "He is finished in the community, butchered," said a fellow rabbi who would only talk anonymously. "No one will look at him, and those who will talk to him, they can't let it be known. The pressure in our community, it's incredible."

On Manhattan’s Upper East Side, home to some of the most expensive real estate on earth, exists the crown jewel of the city’s residential town houses. With its 15-foot-high oak door, huge arched windows, and nine floors, it sits on—or, rather, commands—the block of 71st Street between Fifth and Madison Avenues. Almost ludicrously out of proportion with its four- and five-story neighbors, it seems more like an institution than a house. This is perhaps not surprising—until 1989 it was the Birch Wathen private school. Now it is said to be Manhattan’s largest private residence.

Inside, amid the flurry of menservants attired in sober black suits and pristine white gloves, you feel you have stumbled into someone’s private Xanadu. This is no mere rich person’s home, but a high-walled, eclectic, imperious fantasy that seems to have no boundaries.

The entrance hall is decorated not with paintings but with row upon row of individually framed eyeballs; these, the owner tells people with relish, were imported from England, where they were made for injured soldiers. Next comes a marble foyer, which does have a painting, in the manner of Jean Dubuffet … but the host coyly refuses to tell visitors who painted it. In any case, guests are like pygmies next to the nearby twice-life-size sculpture of a naked African warrior.

Despite its eccentricity the house is curiously impersonal, the statement of someone who wants to be known for the scale of his possessions. Its occupant, financier Jeffrey Epstein, 50, admits to friends that he likes it when people think of him this way. A good-looking man, resembling Ralph Lauren, with thick gray-white hair and a weathered face, he usually dresses in jeans, knit shirts, and loafers. He tells people he bought the house because he knew he “could never live anywhere bigger.” He thinks 51,000 square feet is an appropriately large space for someone like himself, who deals mostly in large concepts—especially large sums of money.

Guests are invited to lunch or dinner at the town house—Epstein usually refers to the former as “tea,” since he likes to eat bite-size morsels and drink copious quantities of Earl Grey. (He does not touch alcohol or tobacco.) Tea is served in the “leather room,” so called because of the cordovan-colored fabric on the walls. The chairs are covered in a leopard print, and on the wall hangs a huge, Oriental fantasy of a woman holding an opium pipe and caressing a snarling lionskin. Under her gaze, plates of finger sandwiches are delivered to Epstein and guests by the menservants in white gloves.

Upstairs, to the right of a spiral staircase, is the “office,” an enormous gallery spanning the width of the house. Strangely, it holds no computer. Computers belong in the “computer room” (a smaller room at the back of the house), Epstein has been known to say. The office features a gilded desk (which Epstein tells people belonged to banker J. P. Morgan), 18th-century black lacquered Portuguese cabinets, and a nine-foot ebony Steinway “D” grand. On the desk, a paperback copy of the Marquis de Sade’s The Misfortunes of Virtue was recently spotted. Covering the floor, Epstein has explained, “is the largest Persian rug you’ll ever see in a private home—so big, it must have come from a mosque.” Amid such splendor, much of which reflects the work of the French decorator Alberto Pinto, who has worked for Jacques Chirac and the royal families of Jordan and Saudi Arabia, there is one particularly startling oddity: a stuffed black poodle, standing atop the grand piano. “No decorator would ever tell you to do that,” Epstein brags to visitors. “But I want people to think what it means to stuff a dog.” People can’t help but feel it’s Epstein’s way of saying that he always has the last word.

But it hasn't been all private islands and 7,000-acre ranches for the half-billionaire. For decades Epstein has run some of his operations quietly out of a squat Second Avenue residential building owned by his brother, Mark Epstein, and frequently visited by the former Israeli Prime Minister Ehud Barak.

According to property records and court filings, Jeffrey Epstein has long housed girlfriends, associates, employees, and businesses in a handful of units at 301 East 66th St. There are 200 units at the address, and the majority of them are owned on paper by his brother's development firm, Ossa Properties. While Ossa nominally owns the units connected to Jeffrey Epstein, the aforementioned records and filings show that Epstein effectively controls them.
