From my understanding, there is a difference between a consensual and non-consensual interaction with police. If you consensually speak to the police, then they assume, correctly, that you are not invoking your right to remain silent.

 

From watching the First Amendment audit videos, I am waiting for someone to tell the police to put their questions into writing so I can consult with my attorney to answer them. We will get back to you… Eventually…

That works, too. I have seen auditors have pre-written out responses that they show the police and they include citations to the legal standards. I have seen drivers get waived through DUI checkpoints after showing such paperwork. It is like the police do not want to deal with them. Lol.
