Raymond Kethledge of Michigan, U.S. Court of Appeals for the Sixth Circuit

IMHO - interesting rulings, top notch caliber

β€” born 1966;

β€” He attended the University of Michigan, graduating in 1989 with a Bachelor of Arts degree

in history. He then attended the University of Michigan Law School, graduating magna cum laude (and second in his class) with a Juris Doctor in 1993.

β€” clerked for Sixth Circuit Judge Ralph B. Guy Jr and Anthony Kennedy

β€” judiciary counsel to Michigan Senator Spencer Abraham

β€” The court held, based on Bennett v. Spear, that the citizen-suit provision does not permit a citizen to sue a state for its failure to perform a regulatory duty. Kethledge wrote that, β€œ[i]n construing a statute, the words matter.”

—– To resolve the case, Kethledge applied the relevant Supreme Court precedent. In re Winship, the SC held: β€œ[T]he Due Process Clause protects the accused against conviction except upon proof beyond a reasonable doubt of every fact necessary to constitute the crime with which he is charged.”

– Judge Kethledge explained that the Commission had the authority to fix criminal penalties only because Congress had given the Commission that authority.

β€” The Sixth Circuit affirmed. In an opinion by Judge Kethledge, the court held that a crime’s penalty is normally the one on the books when the crime was committed, and Hughes could not point to anything that overcame that presumption.

– Judge Kethledge wrote; instead, β€œa decree may remain in force only as long as it continues to remedy a violation of federal law.”

β€” Kethledge teaches a course at the University of Michigan Law School called "Fundamentals of Appellate Practice," which focuses on the elements of good legal writing.

β€” "legal staff of George W. Bush" traveled with him

– A protΓ©gΓ© of Kenneth Starr, Kavanaugh played a lead role in drafting the Starr report, which urged the impeachment of President Bill Clinton

Amy Coney Barrett of Indiana, U.S. Court of Appeals for the Seventh Circuit

IMHO - potential conflicts of interest w/ husband's duties as a U.S. Attorney;

and prejudicial religious opinions (esp. in the eye of public opinion)

β€” born 1972; former Professor of Law at Notre Dame Law School

β€” practicing Catholic and a member of People of Praise

β€” married to an Asst United States Attorney for the Northern District of Indiana

β€” has 7 children (can we assume she does not believe in family planning techniques?)

β€” has stated that members of the Senate Judiciary Committee misconstrued her writing

Amul Roger Thapar (born April 29, 1969) is a United States Circuit Judge of the United States Court of Appeals for the Sixth Circuit. He is a former United States District Judge of the United States District Court for the Eastern District of Kentucky and former United States Attorney for the Eastern District of Kentucky.

Thapar received a Bachelor of Science degree from Boston College in 1991 and a Juris Doctor from UC Berkeley School of Law in 1994.

While an Assistant U.S. Attorney, he was appointed to the Attorney General's Advisory Committee (AGAC) and chaired the AGAC's Controlled Substances and Asset Forfeiture subcommittee. He also served on its Terrorism and National Security subcommittee, Violent

Crime subcommittee, and Child Exploitation working group.[8]

Thapar also led the Southern Ohio Mortgage Fraud Task Force, which successfully prosecuted approximately 40 perpetrators of mortgage fraud. He led the successful investigation and prosecution of a conspiracy ring to provide illegal aliens with fraudulent driver's licenses.

On May 10, 2013, Thapar cited the definition of the federal crime of terrorism to keep the protesters in jail until their sentencing on February 18, 2014. Thapar sentenced one of the defendants, 84-year-old nun Megan Rice, to 35 months in prison for breaking into the U.S. nuclear weapons complex and using blood to deface a bunker holding bomb-grade uranium, a demonstration that exposed serious security flaws;

On appeal, the Sixth Circuit reversed the most serious convictions against the protesters and, in May 2015, ordered their immediate release from custody,

Thomas Hardiman of Pennsylvania, U.S. Court of Appeals for the Third Circuit

IMHO - too entangled in politics, hard line positions, animal cruelty, twisted analyses

β€” born 1965;

β€” previously a United States District Judge

β€” – Hardiman married Lori Hardiman (nΓ©e Zappala), an attorney and real estate professional,

in 1992. The Zappala family, which includes Stephen Zappala and Stephen Zappala Sr., are prominent Democrats

β€” His private practice consisted mainly of civil and white-collar criminal litigation

β€” was a finalist to succeed Antonin Scalia

β€” In Florence v. Board of Chosen Freeholders (2010), Hardiman held that a jail policy of strip-searching everyone who is arrested does not violate the prohibition of unreasonable searches and seizures in the Fourth Amendment. The Supreme Court affirmed this decision in 2012.

β€” – As a student, Hardiman participated in an exchange program in Mexico, and he later volunteered with the Ayuda immigration legal aid office in Washington, D.C., representing immigrants.

– Hardiman is a board member and former president of Big Brothers Big Sisters of Greater Pittsburgh
