FBI informant accused of lying about $10M Biden bribery allegation rearrested under ‘bizarre circumstances’

The FBI informant accused by special counsel David Weiss of fabricating a $10 million bribery allegation against President Biden and first son Hunter was rearrested Thursday under what his lawyers called “bizarre circumstances” two days after his release from jail.

 

Alexander Smirnov, 43, was taken into custody at the downtown Las Vegas law offices of his attorneys, David Chesnoff and Richard Schonfeld, as he consulted with them on his case, court documents show.

 

US Magistrate Judge Daniel Albregts had granted Smirnov’s motion for pretrial release on Tuesday under various conditions, denying a Justice Department effort to keep the dual US-Israeli citizen in custody.

 

The government filed a motion to reopen Smirnov’s detention hearing in the Central District of California, where a federal grand jury indicted him on charges of making a false statement and creating a false and fictitious record earlier this month.

 

“Despite Judge Albregts’s prior ruling, denial of the stay request, and Mr. Smirnov’s prior release from custody, on the morning of February 22, 2024, Mr. Smirnov was arrested for a second time – on the same charges and based on the same indictment … while at the undersigned counsel’s law office for meetings with counsel,” his lawyers wrote in an motion for an emergency detention hearing in the US District Court for the District of Nevada.

 

“It should further be noted that the fact that [Smirnov] was attending a legal consultation meeting at his attorneys’ office contradicts the notion that he is a risk of flight,” they added.

 

Chesnoff and Schonfeld argued that the re-arrest conflicts with their client’s Sixth Amendment rights.

“There are no provisions for the re-arrest of Mr. Smirnov in this District after being Ordered released,” the attorneys wrote, noting that the new arrest warrant came out of the Central District of California.

 

Smirnov’s motion demands that the Nevada court hold his “second initial appearance” and that he be released “without unnecessary delay,” citing the “bizarre circumstances” of his re-arrest.

 

Alternatively, his lawyers asked for an “emergency hearing” before the Nevada court’s chief judge and that the US Marshal Service keep Smirinov in Nevada until after another detention hearing.

Smirnov was initially arrested on Feb. 14 after flying into Harry Reid International Airport in Las Vegas from overseas.

 

The two felony charges against him are related to the alleged false statements documented by the FBI in a June 2020 FD-1023 form that House Republicans last year battled for access to read.

 

Weiss alleges that the corruption accusations against the Bidens are false because Smirnov wasn’t working with Ukrainian energy giant Burisma when he claimed to have had conversations with a key company figure who told him about the bribes.

 

The indictment also accuses Smirnov of holding a bias against the 81-year-old president, and federal prosecutors argued on Tuesday that the former FBI informant is “actively peddling new lies that could impact US elections after meeting with Russian intelligence officials in November.”

House Oversight Republicans have yanked a reference to their major flop of an FBI informant on the committee website, where it previously had pride of place as part of the impeachment inquiry into Joe Biden.

 

Republicans have hinged their Biden investigation on accusations from a supposedly credible but confidential FBI source that Biden and his son Hunter accepted bribes from a Ukrainian oligarch. But the Justice Department has since charged that source, former FBI informant Alexander Smirnov, with making false statements and revealed his accusation may have been Russian disinformation.

It’s not going great for House Republicans after their star Biden impeachment witness was indicted.

 

As of Thursday, the House Oversight website displays a list of key evidence in the committee’s Biden family investigation, including an error-ridden timeline of the president’s supposed corruption, the family’s bank records, and a transcribed interview with a witness who actually debunked all of the Republicans’ claims.

 

But an archived version of the website shows the key evidence list used to include a link to “FBI Form 1023 alleging then-Vice President Joe Biden engaged in a bribery and extortion scheme and ultimately received $5 million from a Burisma executive.”

 

FD-1023s are forms that the FBI uses to record anonymously sourced, unverified information. The form in question alleges that a source reported Biden and his son Hunter each accepted a $5 million bribe from an executive at Burisma, a Ukrainian energy company on whose board Hunter served.

 

Republicans have repeatedly cited this form as concrete proof that Biden is guilty of corruption, despite the fact that the FBI could not prove the information was credible. GOP leadership was warned as much, but they still pushed forward with the investigation into the Bidens.

 

As it turns out, the story was totally made up. Last week, the Justice Department charged the source, businessman Alexander Smirnov, with making a false statement and creating a false record related to the bribery allegation. And on Tuesday, the department revealed Smirnov confessed that Russian intelligence officers helped him smear Hunter Biden.

 

With the investigation going up in smoke around them, Republican leaders have started to erase references to Smirnov. House Judiciary Chair Jim Jordan and Oversight Chair James Comer, who have spearheaded the probe, sent a letter Tuesday evening to former State Department official Amos Hochstein requesting an interview. The GOP has accused Hochstein of advising Hunter Biden at Burisma.

 

The original letter, which was obtained by The New Republic, included a section explaining the reason for the Biden investigation, with a paragraph that described a credible, confidential source’s accusation that a Ukrainian gas company executive had bribed the president. This background information has been standard for Republicans’ interview request letters during the impeachment inquiry thus far.

 

But an hour later, Republicans sent out a second version of the letter, also obtained by TNR. This time, the entire paragraph about the informant had been deleted.

Man Indicted Over Allegedly Leaking Infamous Anti-Semitic Kanye West Rant With Tucker Carlson

A man accused of hacking into Fox News—eventually obtaining and leaking— footage of a now-infamous anti-Semitic conversation between Kanye West and Tucker Carlson was indicted Thursday on a dozen charges of criminal activity more than six months after FBI agents searched his home and seized his computers.

 

Tim Burke, a freelance media consultant and journalist, was arrested Thursday and charged with one count of conspiracy, six counts of accessing a protected computer without authorization and seven counts of intercepting or disclosing wire, oral or electronic communications, according to documents on file in federal court for Florida's middle district.

 

The indictment accuses Burke of hacking into computers owned by “a multinational media company headquartered in New York City" and obtaining unaired clips "which included interview discussion between show host and guest.”

 

Though the court documents don’t explicitly mention Fox News, Tucker Carlson or Kanye West by name, the Tampa Bay Times has confirmed the charges relate to the obtaining of behind-the-scenes footage of the "Tucker Carlson Tonight" show that were leaked to, and published by, Vice and Media Matters in October of 2022.

 

The clips feature unaired segments of an interview with West that included his making antisemitic comments and repeating conspiracy theories, including that “Planned Parenthood was made… with the KKK to control the Jew population” and referencing the theory that Jewish people control the nation’s financial institutions.

 

Leaks also included footage of Carlson making inappropriate comments to an on-set makeup artist (he asked if “pillow fights ever break out” in the women's bathroom) and referring to a woman as “yummy” (Carlson was fired by Fox News in April 2023).

 

Mark Rasch, Burke's attorney, did not immediately respond to Forbes’ request for comment Thursday but told Rolling Stone Burke was acting as a journalist when he legally obtained the Fox News clips, and his actions are therefore protected by the First Amendment.

Fox News aired a friendly, two-part interview with Carlson and West in October of 2022, which included claims by the rapper that the body-positive movement is a "genocide of the Black race" and that he was pressured into staying quiet about his support of Donald Trump ahead of the 2016 election. Speaking about the interview, Carlson told his audience, “We’ve rarely heard a man speak so honestly and so movingly about what he believes.” Days later, Vice obtained and published parts of the interview that were edited out of the broadcast, including his comments about Jewish people. The news broke at the same time West’s Instagram and Twitter accounts were frozent for antisemitic posts that were soon deleted. Carlson and Fox News were swiftly criticized for editing out West's "antisemitic meltdown.” The incident revived criticism of the network, including the resurfacing of an investigation by the New York Times that found Carlson had created “the most racist show in the history of cable news” in his time with Fox. Over the years, Carlson’s controversies have included claims he made comments that likened women to dogs and defended statutory rape and theories that the storming of the U.S. Capitol on Jan. 6, 2021 was a “false flag” FBI operation intended to make conservatives look bad. Days before his departure, Fox had agreed to a $787.5 million settlement in a lawsuit by Dominion Voting Systems over the network’s coverage of the 2020 election.

The investigation against Burke has sparked a wave of support from First Amendment advocates. After the FBI raid of Bruke's home was revealed, more than 50 organizations signed onto a letter to the Department of Justice demanding transparency into the investigation, which they called an infringement of protected journalistic activity. Burke has said he obtained the clips from public websites used by Fox News to upload unencrypted live streams, and that the URLs would have been available to anyone with publicly accessible login credentials. But federal prosecutors have questioned whether Burke is a journalist, according to the Tampa Bay Times.

Donald Trump called WikiLeaks “disgraceful” and suggested there be a “death penalty” for their actions during a 2010 interview.

 

Speaking on camera to preview Brian Kilmeade’s radio show, the Fox News anchor brought up the topic of WikiLeaks. At the time, WikiLeaks had published hundreds of thousands of classified documents and videos that were leaked to the organization by Pfc. Chelsea Manning, known at the time as Pfc. Bradley Manning.

 

“I think it’s disgraceful, I think there should be like death penalty or something,” Trump said during the quick exchange uncovered online by CNN’s KFile.

 

His 2010 comments are in sharp contrast to his decision Wednesday morning to invoke WikiLeaks founder Julian Assange, who claimed in a new Fox News interview that the Russian government was not the source of the hacks during the presidential campaign.

 

Following the interview, Trump tweeted: “Julian Assange said ‘a 14 year old could have hacked Podesta’ - why was DNC so careless? Also said Russians did not give him the info!”

 

The president-elect has repeatedly questioned the U.S. intelligence community’s assessment that Russia was the source of the hacks, which took place during the 2016 presidential campaign and targeted Hillary Clinton’s campaign chair John Podesta and the Democratic National Committee. During the campaign, Trump cited information released by WikiLeaks to attack Clinton and the DNC.

 

A Trump transition team spokesperson did not return a request to comment on the record for this story.
