Trump’s lawyer confirms his concern about Supreme Court ballot ruling

Former President Trump’s attorney Alina Habba on Wednesday said the former president is concerned the U.S. Supreme Court justices may “shy away from being pro-Trump,” and rule against him in regard to the recent decisions in Colorado and Maine that kicked him off the states’ 2024 primary ballots.
Responding to New York Times reporter Maggie Haberman’s recent comments about Trump’s concerns, Habba during an interview on Fox News said, “That’s a concern he’s voiced to me, he’s voiced to everybody publicly, not privately. And I can tell you that his concern is a valid one.”
“You know, Republicans are conservative, they get nervous. They unfortunately … sometimes shy away from being pro-Trump because they feel that even if the law is on our side, they are swayed much like the Democratic side, right?” Habba told Fox News anchor Martha MacCallum. “So they’re trying so hard to look neutral that sometimes, they make the wrong call.”
Colorado and Maine both removed Trump from their 2024 state primary ballots last month, ruling he is ineligible to run for president under the 14th Amendment’s insurrection clause.
Trump on Wednesday appealed Colorado’s ruling to the U.S. Supreme Court, one day after he appealed Maine’s decision — which came from Maine’s Secretary of State Shenna Bellows — in the state’s superior court, though the dispute could ultimately also reach the U.S. Supreme Court, which currently has a 6-3 conservative majority.
Three of the justices on the nation’s highest bench were appointed by Trump, a point of concern Haberman addressed last week.
“They believe, generally speaking, he and his advisers, that they will have success at the Supreme Court, but he has also voiced some concern that a court that has — he appointed three of the justices at the Supreme Court and gave the conservatives a supermajority — he is concerned that they are going to look as if they’re trying not to rule in his favor and might rule against him,” Haberman said during a CNN appearance last week.
“It’s a very clean cut,” she said. “There’s no … politics that should be involved in this. It’s just simply American, and if the justices read the law, as I do, as most Americans and attorneys do, even [Alan Dershowitz] — who’s a known liberal — it’s just a simple decision, and it should have nothing to do with if you’re Republican or Democrat.”
Habba was making an apparent reference to attorney Alan Dershowitz’s comments against rulings from Colorado and Maine. Dershowitz last month called Colorado’s decision “an attempt to totally manipulate an amendment that was never designed to disqualify people in future election,” Forbes reported.
A number of legal experts have thrown out varying predictions for how the nation’s highest court could rule if it decides to hear the case. Former Attorney General Bill Barr called Colorado’s case “legally wrong and untenable,” while former federal Judge Michael Luttig said the Centennial State’s ruling is not “anti-democratic,” but rather the conduct that prompted the disqualification was anti-democratic.
Former White House lawyer Ty Cobb predicted the U.S. Supreme Court could rule “9-0” in favor of Trump if he appeals the Colorado Supreme Court decision, saying last month he believes the “law is clear.”

"Nonpartisan" Supreme Court watchdogs demanding conservative justices disclose more about their finances hauled in millions of dollars combined in 2022 from the largest Democratic-allied dark money network in the United States, tax forms show.
The cash transfers, which became public Wednesday upon the release of new financial disclosures, underscore how groups leading a campaign targeting Supreme Court Justices Clarence Thomas and Samuel Alito over trips and gifts they accepted, but did not report, rely on influential left-wing grantmakers to help keep their lights on. Several of these self-described watchdogs took heaps of cash from nonprofit organizations managed by Arabella Advisors, a consulting firm overseeing an anonymously-funded network that spent over $1 billion last year propping up liberal causes.

Washington D.C. Attorney General Brian Schwalb (D) is investigating Arabella Advisors and its offshoots, including New Venture Fund and Sixteen Thirty Fund, and his office issued subpoenas to the network in September for information on financial mismanagement allegations. The consultancy also manages Hopewell Fund, North Fund, and Windward Fund, which, like others in the network, sponsor little-known groups that aren't required to file their own tax forms with the IRS.
"Arabella Advisors and the dark money groups it advises specialize in cultivating pop-up front groups to make their extreme agenda sound locally-run or nonpartisan," Carrie Severino, president of the conservative Judicial Crisis Network, told the Washington Examiner. "It’s no surprise they’re behind the campaign to discredit originalist justices."
JCN, the judicial advocacy group also known as Concord Fund, is affiliated with Federalist Society co-chair Leonard Leo, a conservative activist who, along with GOP businessman Harlan Crow, could face congressional subpoenas over their ties to Thomas and Alito. Senate Judiciary Committee Democrats decided against a vote on the matter last week after Republicans, including Sen. Josh Hawley (R-MO), dangled the idea of an Arabella subpoena.
But Schwalb also recently opened an investigation into tax-exempt organizations linked to Leo. It came after Campaign for Accountability, a "nonpartisan watchdog" helmed by left-wing activists, alleged in an April IRS complaint that the nonprofit groups Concord Fund, Rule of Law Trust, Wellspring Committee, 85 Fund, Federalist Society, Freedom and Opportunity Fund, and Marble Freedom Trust paid excessive compensation to Leo.
Campaign for Accountability, a former Hopewell Fund project, pocketed $450,000 in 2022 from New Venture Fund, tax forms show. That donation adds to the more than $2.3 million New Venture Fund wired between 2016 and 2021 to CFA, which has received hundreds of thousands of dollars from Open Society Foundations, the vast liberal grantmaking network bankrolled by Democratic megadonor and philanthropist George Soros.
In September, CFA joined over 40 "Supreme Court watchdog and accountability organizations" in sending a letter to Chief Justice John Roberts demanding he "ensure" Thomas and Alito recuse themselves from cases purportedly tied to conservative hedge fund manager Paul Singer and the right-libertarian Koch Network.
CFA Executive Director Michelle Kuppersmith sits on the board of Fix the Court, a "transparency" Supreme Court watchdog that unwittingly leaked its donors, including New Venture Fund, to the Washington Examiner in May. Fix the Court, which was previously a project of New Venture Fund, admitted to failing to disclose lobbying after tax attorneys said in July that Fix the Court likely violated federal law.

Senate Judiciary Committee Chairman Dick Durbin announced Tuesday that the committee would vote on Thursday to subpoena Harlan Crow, a billionaire real estate developer, and Leonard Leo, the co-chairman of The Federalist Society, to testify about their relationships with Thomas, who has been accused in a series of investigative reports by ProPublica of unethically accepting gifts from Crow. While the vote on the subpoenas was abruptly canceled, Graham and his colleagues vowed that Republicans would propose subpoenas to left-wing groups in response. Supreme Court’s new ‘Code of Conduct’ is about appearances, not about ethics11 20 2023
On Nov. 13, the US Supreme Court — presumably motivated by bad publicity after the exposure of bribery schemes involving justices Clarence Thomas, Samuel Alito, and Neil Gorsuch, use of judicial aides to promote justice Sonia Sotomayor’s books, and other unsavory activities — announced what it calls a “Code of Conduct,” and what most media outlets describe as an “ethics code.”
The new code goes off the conduct/ethics rails before finishing its short opening statement, asserting that its purpose is to “dispel” the “misunderstanding” that the justices “regard themselves as unrestricted by any ethics rules,” rather than to actually restrict the justices with any ethics rules.
Because the document — 15 pages, including the opening statement, the “code” itself, and commentary/notes — doesn’t provide for any penalty or punishment whatsoever should a justice violate it, the justices remain as unrestricted after its publication as they clearly regarded themselves before.
Even ignoring the absence of consequences, the code itself is full of lofty and often ambiguous “shoulds” and “should nots” rather than specific and well-defined “shalls” and “shall nots.”
As codes go, this one’s far more Emily Post than Exodus 20. It’s not about what the justices may or may not do, it’s about how the court wants or doesn’t want to look.
Does anyone find this surprising? Letting government agencies regulate themselves always results in government agents (especially those who regard themselves as enjoying tenure for life) leaving themselves room to do whatever they like.
In theory, Congress can impose binding rules on the Supreme Court. Contra justice Samuel Alito (“No provision in the Constitution gives them the authority to regulate the Supreme Court — period”), Article III of the U.S. Constitution specifies that the justices hold their seats “during good Behaviour,” and that the court operates in its appellate capacity “under such Regulations as the Congress shall make.”
In practice, impeaching individual justices seems like the best way of imposing the “good Behaviour” requirement, but that remedy’s only been applied once, and threatened once more, in 240 years. In 1804, justice Samuel Chase was acquitted by the Senate. In 1969, Abe Fortas resigned from the court under impeachment threat.
The “checks and balances” system seems, unsurprisingly, to not work very well. The Supreme Court remains at least potentially on the take … if you’ve got the money to buy the rulings you want.

Sen. Ted Cruz blasted the Left’s attacks on Federalist Society Board Co-Chairman Leonard Leo and other conservative friends of Supreme Court justices as an attempt to undermine the Constitution itself.
“From Franklin Delano Roosevelt’s court-packing scheme to the attacks on Justice Clarence Thomas, and from the smear tactics used to defame Justice Brett Kavanaugh to the libels against Leonard Leo, Democrats will stop at nothing to delegitimize the Supreme Court,” Cruz, R-Texas, told The Daily Signal in a statement Wednesday.
Leo, as co-chair of The Federalist Society’s board of directors, helps lead a premiere legal organization advocating for an originalist and textualist interpretation of the Constitution.
Former President Donald Trump consulted with The Federalist Society to select his Supreme Court nominees.
“See these Democrat attacks for what they are—a full-on assault on our Constitution,” Cruz added. “Democrats hate our system of separation of powers, and they are willing to burn down the Supreme Court to accomplish their goals.”
Senate Majority Whip Dick Durbin, D-Ill., and Sen. Sheldon Whitehouse, D-R.I., announced Monday that the Senate Judiciary Committee will vote to authorize issuing subpoenas to Leo and wealthy Republican donors Harlan Crow and Robin Arkley II.
Crow has provided flights and lodge stays for Supreme Court Justice Clarence Thomas, and Arkley has hosted Justice Samuel Alito and Leo at his own lodge.
Durbin, who chairs the committee, and Whitehouse, who chairs the Senate Judiciary Subcommittee on Federal Courts, Oversight, Agency Action, and Federal Rights, condemned Supreme Court justices for purportedly accepting “lavish, undisclosed gifts” and thereby enabling “their wealthy benefactors and other individuals with business before the court to gain private access to the justices.”
“The Supreme Court is in an ethical crisis of its own making,” the Democrats said.
“Thanks to investigative reporting, we now know that for decades, some justices have been joining billionaires with business before the Court on their private planes and yachts or receiving gifts such as private school tuition for a family member.”
Durbin and Whitehouse referred to a series of articles “exposing” the personal relationships between Supreme Court justices and conservative leaders like Leo.
The opening salvo, ProPublica’s article about Thomas’ failure to disclose a transaction with Crow, a billionaire real estate tycoon, exaggerated Thomas’ mistake, which the justice went on to correct.
The Wall Street Journal’s James Taranto noted that the left-leaning outlets running breathless “ethics” stories on the Supreme Court create a “heads-I-win, tails-you-lose” situation.
“If you follow the rules perfectly, ‘ethics experts’ will fault you for failing to disclose when it isn’t required and for what you disclose when it is,” Taranto noted.

Critics have noted that the ethics attacks appear to be an orchestrated campaign to undermine the court as it moves in an originalist direction.
Pro-abortion activists opposed the Supreme Court’s ruling in Dobbs v. Jackson Women’s Health Organization (2022), which struck down Roe v. Wade (1973) and allowed states to make their own laws on abortion.
LGBTQ campaigners have demonized the court’s rulings upholding free speech and religious freedom in cases where Christians have refused to grant their artistic support to celebrate same-sex weddings.
After Joe Biden won the 2020 presidential election, Democrats in the House and Senate drafted legislation to appoint new Supreme Court justices.
Biden created a presidential commission on the court to analyze judicial reform, but that effort appears not to be headed toward any concrete changes.
In lieu of structural changes to the Supreme Court, it seems many on the Left have resorted to attacking the court’s current members by insinuating impropriety without highlighting any clear quid pro quos.
Critics, among them Cruz, claim that Democrats’ real concern isn’t with corruption but with the court’s rulings on hot-button issues like abortion.
Yet those rulings are rooted in constitutional principles. Dobbs, for example, did not amend the Constitution to repeal a right to abortion.
Rather, in that case, the court concluded that Roe v. Wade was wrongly decided and that the Constitution does not bar state laws on abortion.
By contrast, previous Supreme Court majorities twisted the Constitution to find new rights, such as the Roe right to abortion, where they do not exist in the plain text of the document, originalists claim.
The Left revolted against the court when it abandoned this practice in favor of dedication to the original public meaning of the Constitution, originalists say.
As such, by insinuating corruption on the Supreme Court, the Left is undermining not only the justices appointed by Republican presidents such as Donald Trump, but the Constitution itself, Cruz says.
