The Fani Willis disqualification attempt might not be over yet

The judge would need to grant permission for his order to be appealed. That could bring yet more delay to the already-delayed Trump case in Georgia.

UPDATE (March 18, 2024, 4:21 p.m. ET): Donald Trump and several of his co-defendants moved for a certificate of immediate review from Judge Scott McAfee, seeking permission to appeal his disqualification ruling.

 

Judge Scott McAfee said Friday that Fani Willis can stay on the Georgia prosecution of Donald Trump and his co-defendants. But the ruling can potentially be appealed pretrial, so it might not be the last word on a subject that has already delayed the case.

 

It's important to note that there isn’t an automatic right to appeal at this stage. Rather, McAfee would need to grant permission to do so within 10 days of his ruling, and then the state appeals court would need to agree to hear the case. If that happens, it could bring yet more delay to the prosecution that doesn’t even have a trial date yet and has already been sidetracked by the disqualification motion that led to McAfee’s ruling.

 

It’s unclear if the judge would grant such permission to appeal at this stage. In a recent unrelated ruling in which he dismissed some of the indictment’s counts, McAfee said he’d be inclined to permit an appeal of that ruling. But he didn’t say that in his disqualification order. That doesn’t automatically mean he wouldn’t permit an appeal, but he didn’t go out of his way to signal his openness to the idea like he did in his dismissal ruling.

 

In his disqualification order, McAfee said that the defense failed to prove an actual conflict of interest, but that the appearance of impropriety meant that either Willis (and her whole office) or special prosecutor Nathan Wade had to go. Wade resigned that same day. Though he deemed a speech she gave improper, McAfee declined to disqualify Willis because of alleged “forensic misconduct” based on it. If defendants are allowed to mount an appeal, they could cite the damning facts McAfee found to argue that he reached the wrong legal conclusion by not disqualifying Willis.

 

But first, we’ll see if McAfee even grants permission for the appeal at this pretrial stage.

Navarro’s bid to stave off jail sentence denied at Supreme Court

His sentence is set to begin Tuesday.

 

Navarro’s emergency application to head off his four-month jail term was directed to Chief Justice John Roberts, who serves as circuit justice for the D.C. Circuit and oversees the Washington, D.C. court where the former Trump trade adviser was charged and tried.

 

Departing from the practice in most serious or high-profile legal fights,Roberts ruled on Navarro’s request himself, without referring it to the full court. The chief justice noted that a D.C. Circuit Court of Appeals panel found that Navarro failed to raise several challenges to the fairness of his conviction when he first sought to remain free pending appeal.

 

“I see no basis to disagree with the determination that Navarro forfeited those arguments in the release proceeding, which is distinct from his pending appeal on the merits,” Roberts wrote in his one-page order, emphasizing that the door remains open to the ex-Trump aide to challenge his convictions themselves.

 

An attorney for Navarro declined to comment on the chief justice’s ruling.

 

The House select committee subpoenaed Navarro in early 2022, and he quickly turned down its demand, claiming that Trump’s “executive privilege” barred him from cooperating. The committee emphasized that it had asked him about many subjects not related directly to his conversations with Trump and that could not conceivably be subject to executive privilege. But Navarro still refused to appear or turn over records.

Keith Olbermann suggests 'hope' for Trump's assassination in X post

Former MSNBC host Keith Olbermannappeared to "hope" that former President Trump would be assassinated in a recent X post that prompted calls for his banishment from the social media platform.

 

Olbermann was referring to the Biden-Harris HQ X account flagging a clip of Trump saying he had been persecuted worse than any president in history, including Abraham Lincoln.

 

"Trump says he has been treated worse than Abraham Lincoln, who was assassinated," the Biden campaign account posted on Saturday.

 

"There's always the hope," Olbermann wrote, linking to the post.

 

Olbermann, a far-left personality known for his inflammatory comments, has also recently called for the dissolution of the Supreme Court.

 

One account that responded to Olbermann's post suggested the commentator's account should be "permanently suspended" for appearing to endorse someone killing Trump, the presumptive nominee for the 2024 Republican nomination. Trump is trying to become only the second president since Grover Cleveland to win another White House term after losing a previous re-election bid.

 

Multiple major media outlets and political figures have criticized Trump in the wake of an Ohio campaign speech in which he argued that the American auto industry would experience a "bloodbath" if Biden were to be re-elected in November.

 

While speaking to CNN "State of The Union" host Dana Bash on Sunday, former House Speaker Nancy Pelosi stressed that Trump cannot win the upcoming election and spun his "bloodbath" remark as possibly being a threat to Americans.

 

"We have – we just have to win this election because he‘s even predicting a bloodbath. What does that mean? He‘s going to exact a bloodbath?" she asked.…

Judge Allows Infamous ‘Access Hollywood’ Tape Into Evidence For Trump Hush Money Trial

A judge ruled that a famous tape of former President Donald Trump could be admitted into evidence at his upcoming trial Monday, according to multiple reports.

 

The so-called “Access Hollywood” tape, featuring Trump’s discussion with then-host Billy Bush, will be admitted into evidence, New York Judge Juan Merchan ruled. Merchan also said that former Trump attorney Michael Cohen and porn star Stormy Daniels would also be permitted to testify at the trial.

 

“Defendant’s motion to preclude is DENIED subject to strict limitations as more fully discussed in this Court’s Decision on the People’s motions in limine,” Marchan wrote.

 

The tape, released in the last weeks of the 2016 election, featured Trump talking with Bush about how he tried to seduce women, including a suggestion to “grab them by the pussy.”

 

“The steps taken to secure the stories of Sajudin and McDougal complete the narrative of the agreement that was reached at the meeting,” Merchan wrote. “To wit, stemming the flow of negative information that could circulate about Defendant before it teaches the public eye. Locating and purchasing the information from Daniels not only completes the narrative of events that precipitated the falsification of business records but is also probative of the Defendant’s intent. Further, the evidence and testimony surrounding these individuals is inextricably intertwined with the narrative of events and is necessary background for the jury.”

 

Manhattan District Attorney Alvin Bragg secured a grand jury indictment against Trump on 34 felony counts of falsifying business records in a case centered around a $130,000 payout to porn star Stormy Daniels in 2016, during Trump’s successful run for the White House.

 

Merchan agreed to delay Trump’s trial until at least mid-April after the United States Attorney’s Office for the Southern District of New York delivered tens of thousands of documents to Trump’s attorneys.
