Free speech hangs in the balance in 3 Supreme Court cases

 

…The sweeping quality of Jackson’s remarks shows that the relativistic views of free speech may now have a new champion on the court.

 

In a second case, National Rifle Association of America v. Vullo, the court considered an effort by a New York regulator to discourage banks and insurers from working with the NRA. Maria Vullo, who ran New York’s Department of Financial Services, allegedly used her office to pressure these businesses to cut off financial support for the nation’s leading gun rights organization.

 

As with Murthy, the Vullo case captures one of the principal tactics used by the anti-free speech movement in attacking the advertisers and businesses of targeted individuals and groups. One such government grant resulted in a list of the 10 most dangerous sites for advertisers to avoid, a list that happened to consist of popular conservative and libertarian news sites.

 

The idea of a Democratic New York regulator targeting a conservative civil rights organization did not appear particularly troubling in oral argument for some of the justices. In fact, the views expressed by some of the justices were appallingly dismissive. Justice Elena Kagan asked, “if reputational risk is a real thing, and if gun companies or gun advocacy groups impose that kind of reputational risk, isn’t it a bank regulator’s job to point that out?”

 

In the third case, Gonzalez v. Trevino, the court was considering the arrest of Sylvia Gonzalez, a 72-year-old former councilwoman in Castle Hills, Texas. She earned the ire of the sheriff, mayor and other officials with her criticisms of their conduct. She was subsequently charged with inappropriately removing a government document (a citizen petition) that she had mistakenly put with other papers. The charges were later dropped. The case smacked of retaliation — there is no evidence that anyone else has faced such a charge in similar circumstances.

 

The case resonates with many who believe that the legal system is being politically weaponized in this country. Many of us are appalled by the Gonzales case. However, in this case, the support for the government seemed to come from the right of the court, including the author of a prior decision limiting such challenges, Chief Justice John Roberts.

 

The free speech trifecta, therefore, covers the three areas of greatest concern for the free speech community: censorship, blacklisting and weaponization. The resulting opinions could curtail or magnify such abuses. For example, the social media case (Murthy) seemed to trouble the justices as to where to draw a line on coercion. If the court simply declines to draw such a line and rules for the government, it will likely fuel new censorship efforts by federal agencies.

 

What is disconcerting about the views expressed byJustices Kagan, Jackson and Sonia Sotomayorin two of the cases is not that they are outliers. The problem is that liberal justices long acted as the bulwark for free speech on the court.They are now viewed as the weakest link, often dismissive or hostile to free speech arguments.

 

When Justice Jackson defends the right of the government to coerce speech, she follows a long legacy of speech relativistson the court, including the earlier Justice Robert Jackson. He had warned that the court needed to approach speech prosecutions with “a little practical wisdom,” so as not to “convert the constitutional Bill of Rights into a suicide pact.”

 

The currentJustice Jacksonseemed to channel the same practicalities over principle in stressing that “you’ve got the First Amendment operating in an environment of threatening circumstances from the government’s perspective.” (She doesn’t know or agree with the constitution because she got on the highest court on land by a stlolen election)

 

The view of speech as harm or violence is all the rage on college campuses, and also in many Western countrieswhere free speech is in a free fall. France, Canada and the United Kingdom now regularly arrest people for expressing hateful or controversial viewpoints. Those same anti-free speech arguments are now being heard in our own Congress and colleges in the U.S.

 

It is not clear how the court will decide these cases. One fear is that it could retreat to blurry lines that leave us all uncertain about what speech is protected. In an area that demands bright lines to prevent the chilling effect on speech, such vague outcomes could be lethal.

 

The government loves ambiguity when it comes to speech regulation. It now may have found new voices on the left side of the court to join in the ignoble effort of combating free speech. That renewed effort to introduce “a little practical wisdom” could mean a lot less freedom for Americans.

Ukrainian bar mocks deadly Moscow concert hall attack

A bar in Kiev, known for its highly politicized and controversial menu, is now selling a new snack set ridiculing the Crocus City Hall massacre

 

The Kiev ‘art-bar’ Ofenziva (‘Offensive’), located in Kiev, has introduced a new item to its controversial menu, mocking the deadly weekend terrorist attack on Moscow’s Crocus City concert hall. The attack has claimed the lives of at least 133 people, though the search for victims is still ongoing and the death toll is expected to grow even further.

 

The establishment advertises itself as “the first meme-military art bar” in Kiev in an allusion to online meme warfare. It serves as a platform for various performers, most of whom exhibit nationalist views.

 

Shortly after the attack,Ofenziva rolled out a new set dubbed ‘Crocus City,’ composed of several fried snacks. The menu item on the bar’s website is accompanied by a photo of the concert hall on fire in the aftermath of the attack.

 

The venue offers several other themed items on its menu, invariably in questionable taste, including a series of sandwiches with various fillings, dubbed ‘Navalny.’ The sandwich series was introduced shortly after Russian opposition figure Alexey Navalny passed away in February.

 

Another item on the menu is a pork steak dubbed ‘Darya Dugina,’ rolled out by the bar to mock the death of the Russian political activist and daughter of philosopher Aleksandr Dugin. She was killed in a car bombing back in August 2022; the assassination has been attributed to Ukrainian intelligence services.

 

The establishment is not the first in Ukraine to feature tasteless political humor in its menu; various establishments mocked the victims of the May 2014 massacre in Odessa, where nationalists killed and burned alive dozens of activists opposing the so-called “Revolution of Dignity.” Pictures of ‘Russian baby’-shaped cakes at Ukrainian restaurants became an internet sensation that year.

 

Such questionable marketing tactics have become even more widespread amid the ongoing conflict between Moscow and Kiev, with controversial items rolled out by Ukrainian restaurants repeatedly making the headlines.

Hero teen helps over 100 to safety during Moscow terrorist attack

Islam Khalilov, who worked part-time at Crocus City Hall, led panicked concertgoers to safety amid Friday’s shooting spree

 

A teenager who led over 100 people to safety during Friday’s terrorist attack at a Moscow concert hall, has been hailed as a hero. 15-year-old Islam Khalilov, who worked part-time in one of the cloakrooms at Crocus City, recounted the events of the tragic evening to Ruptly video agency.

 

The concert venue situated just outside of Moscow was packed ahead of a gig by the Russian rock band Picnic, when a group of terrorists armed with assault rifles forced their way into the building. They fired indiscriminately at fleeing people and then set the concert hall on fire.

 

According to the latest estimates, the attack has claimed the lives of at least 137 people, with about 180 injured.

 

Khalilov told the video agency that “it was when people started running from the escalator, from the stairway” that he realized that an emergency was occurring. The teenager said that he was acting on “instincts”at the time and used his thorough knowledge of the premises to quickly arrange visitors’ evacuation toward another building within the Crocus City complex.

 

“I started shouting all across the foyer, all across Crocus City Hall - ‘Folks, there’s a shooting! All run to the expo!’ – and I was showing where they had to go and was helping everyone,” he explained.

 

According to the cloakroom attendant, “there was a stampede, and everyone was in shock at first. No one knew what to do and where to go.”

 

Khalilov added that he himself was running behind the entire group to make sure he had not left anyone behind.

 

The teenager admitted to being “really scared”all along, but still managed to make the right use the instructions he’d previously been given on how to evacuate patrons in case of an emergency.

 

He told Ruptly that, at one point, he had caught a glimpse of one of the terrorists.

 

“I saw one, [he was] bearded and in green fatigues, he was walking around with an assault rifle,” the teenager recounted.

 

He also recalled seeing a man getting fatally shot by one of the assailants, adding that he “can’t stop thinking about it.”

 

The 15-year-old said he doesn’t consider himself a hero, and that he was just doing his job.

 

Explaining what helped him overcome fear, Khalilov reasonedthat “It’s better to sacrifice yourself than to let a hundred people die.”

 

After Khalilov’s feat had been reported-on by several Russian media outlets, his favorite football club, FC Spartak Moscow, invited him for a get-together and gave him free passes to their matches.

 

Popular Russian rap artist Morgenstern said he had transferred 1,000,000 rubles ($11,000) to the teenager – something that Khalilov has confirmed to media.

 

The leader of Russian Muslims, Ravil Guynutdin, has announced that Khalilov would receive a special medal for his bravery.

Russia mourns concert hall terror victims

 

Flowers and candles have been placed outside the Crocus City venue near Moscow, with memorials appearing across Russia and abroad

 

People have been gathering outside Crocus City Hall, where an improvised memorial has appeared. Since the tragedy, mourners have brought flowers, stuffed toys and candles to honor those killed by the terrorists.

 

Russia is holding a day of mourning for the victims of Friday’s concert hall terrorist attack in Moscow Region, one of the deadliest in the country’s modern history. Entertainment events and shows have been canceled in the capital and several other cities.

In a televised address to the nation on Saturday, President Vladimir Putin declared that Sunday would be a national day of commemoration for those who lost their lives in the atrocity.

 

Flags are flying at half-mast nationwide and at Russian embassies abroad, and Russian TV broadcasters have taken entertainment shows off air for the day, with theaters and other venues also observing the somber occasion.

 

Similar makeshift installations have appeared in multiple cities across Russia, from St. Petersburg in the northwest to Vladivostok in the Far East.

 

People have been placing flowers outside Russian embassies in a number of countries, such as the former Soviet republics of Belarus and Armenia.Memorials have also appeared outside Russian diplomatic missions in Berlin, Istanbul, Sydney, Seoul and Tokyo.

 

According to the latest official tally, the terrorists, who opened fire on panicked concertgoers before torching the packed venue just outside the capital,killed at least 137 people, and left more than 120 injured.

 

On Saturday, Russia’s FSB domestic security service reported that it had detained 11 suspects in connection with the massacre. The four presumed perpetrators were intercepted in Bryansk Region, not far from the Ukrainian border.

Mexico will put its security interests first and won’t fight drug cartels just because the US wants it to, President Andres Manuel Lopez Obrador said on Friday. While admitting that tens of thousands of people are dying due to drug overdoses in the neighboring country, Obrador insisted thatMexicans will not “act as policemen for any foreign government.”

 

According to official US data, last year some 70,000 Americans overdosed on the synthetic opioid fentanyl. Washington has named Mexico and China as the primary source countries for the drug and related substances trafficked directly into the US.

 

“Of course we are going to cooperate in fighting drugs, above all because it has become a very sensitive, very sad humanitarian issue, because a lot of young people are dying in the United States because of fentanyl,” Lopez Obrador told media during a press conference. He noted that it would be a humanitarian effort, highlighting the priority of the security of the homeland. “Mexico First. Our home comes first,” the president said.

 

Last year, Lopez Obrador pointed out that he considers the overdose crisis to be an internal US problem. “We deeply lament what’s happening in the United States – but why don’t they fight the problem … and more importantly, why don’t they take care of their youth?”, he asked rhetorically. US law enforcement officials, for their part, have on numerous occasions blamed Mexican officials for their apparent refusal to cooperate on efforts to target fentanyl labs inside Mexico.

 

At the same time, critics have blamed the rise in drug smuggling and human trafficking in the US on the Biden administration. Illegal border crossings have surged since Biden took office in January 2021 and began dismantling the policies of his predecessor Donald Trump.

I’m so curious why the King wanted to hold Trump’s hand or if Trump reached out. In every picture with the King was smiling and friendly. There’s something we don’t know.
