(KRON) — The Sonoma County District Attorney’s Office said Thursday that it has not filed charges against former Windsor mayor Dominic Foppoli. Foppoli was accused of sexual assault by multiple women.

 

The accusations came nearly three years ago, prompting Foppoli to resign from being Windsor’s mayor.

 

Reality TV star Farrah Abraham accused Foppoli of “non-consensual acts” in Florida. Town council member Esther Lemus reported that Foppoli drugged and assaulted her twice. In total, more than 12 women have made accusations, nine of which have done so publicly. The allegations range from rape to groping.

The DA’s office said that it does not have significant evidence to charge Foppoli, but its investigation remains open.

“At this time, we don’t have enough evidence to warrant filing charges on the cases not barred by the statute of limitations. However, our investigation remains open, and we urge anyone who believes they may be a victim or who has evidence to come forward,” the DA’s office said.

 

The Sonoma County Sheriff’s Office raided Foppoli’s home in November 2021, seven months after the accusations against him were publicized. Some items were taken, but attorney Traci Carrillo, who represents seven women claiming to be victims, says authorities waited too long to do the raid.

 

“The search warrant wasn’t done until approximately seven months after the initial report, and I find that inexcusable,” she said. “And the sheriff’s office from the beginning, I felt was for some reason protecting Mr. Foppoli. There was not an urgency in the case which I certainly knew they were capable of, having worked with them in the past.”

 

The potential victims allege that the sex crimes happened between 2002 and 2021. Four women say they were assaulted while Foppoli was acting as mayor.

 

Foppoli has denied the allegations, saying all encounters were consensual.

 

“I have my head held high because I know deep in my heart that I have done nothing wrong,” he said in April 2021.

 

While there have been no criminal charges filed, Carrillo says a civil lawsuit continues to move forward.

 

“It doesn’t matter that the sheriff’s office failed them in a criminal case because our civil case runs independent of any failures by a law enforcement agency,” she said.

 

Foppoli resigned in May and has reportedly moved to Italy. KRON4 was unable to contact him for this story

SAN DIEGO (FOX 5/KUSI) — Forty-one-year-old Charles De Freitas made his first appearance in court Thursday afternoon on charges of possessing and distributing child pornography.

 

The counts include: (1) harmful matter sent depicting adult(s) engaged in sexual conduct, (2) contact of minor with intent to commit a sexual offense and (3) possessing matter depicting person under 18 in sexual conduct.

 

De Freitas, the associate principal at Hover High School, denied the allegations and pleaded not guilty through an attorney.

De Freitas is out of custody on a previously posted $25,000 bail bond.

 

“As a matter of the defendant being able to stay out of custody — he did post bail earlier — he has to stay 100 yards away from all San Diego County schools and all San Diego County parks,” said Deputy District Attorney Ramona McCarthy.

 

He must also submit to random searches with or without warrant and provide passwords for various devices.

 

San Diego police say an investigation was launched after a minor came forward alleging De Freitas had sent and requested illicit images via social media.

Deputy District Attorney Ramona McCarthy says there is a full criminal protective order for the victim in the case.

 

“The defendant must stay 100 yards away from the victim in this case. he cannot contact him. He cannot have any third parties contact him as well on the defendant’s behalf,” McCarthy said.

 

De Freitas has worked for San Diego Unified School District for more than 13 years, previously working as a teacher at the San Diego School of Creative and Performing Arts, according to police.
