All of the laws in the US Code and the legal codes of the laws of the individual states have already been deemed constitutional, Anon. There are a few exceptions currently before the USSC, of course. Otherwise, unless a law is deemed repugnant to the constitution - by a judge (not a citizen, unless successful in a case before the USSC) - the law under which you will be judged is the law 'on the books' in the jurisdiction in which you were charged.
