Palm Beach County State Attorney Says Jack Smith Close to Using ‘Nuclear Button’ to Remove Judge Cannon From Trump Classified Docs Case Over Her Jury Instruction Order

Palm Beach County State Attorney David Aronberg says Jack Smith is close to using a ‘nuclear button’ to remove Judge Aileen Cannon from the Trump classified documents case over her jury instruction order.

 

“He is close to pushing the nuclear button,” said Palm Beach County State Attorney David Aronberg, according to NBC News.“It is a high burden to reach, and it is rarely done, but her proposed jury instructions may have pushed him to the breaking point.”

 

Last month Judge Aileen Cannon issued a jury instruction order in Jack Smith’s classified documents case andthe leftist legal analysts went apocalyptic.

 

Cannon gave two options for jury instructions.

 

The first option:

 

In a prosecution of a former president for allegedly retaining documents in violation of 18 U.S.C. § 793(e), a jury is permitted to examine a record retained by a former president in his/her personal possession at the end of his/her presidency and make a factual finding as to whether the government has proven beyond a reasonable doubt that it is personal or presidential using the definitions set forth in the Presidential Records Act (PRA).

 

The second option is:

 

A president has sole authority under the PRA to categorize records as personal or presidential during his/her presidency. Neither a court nor a jury is permitted to make or review such a categorization decision. Although there is no formal means in the PRA by which a president is to make that categorization, an outgoing president’s decision to exclude what he/she considers to be personal records from presidential records transmitted to the National Archives and Records Administration constitutes a president’s categorization of those records as personal under the PRA.

 

Jack Smith earlier this week threatened to take the jury instruction fight to the appellate court.

 

OnThursday Judge Cannon declined Jack Smith’s demandsof her jury instruction order as “unprecedented and unjust.”

 

“Separately, to the extent theSpecial Counsel demandsan anticipatoryfinalization of jury instructions prior to trial, prior to a charge conference, and prior to the presentation of trial defenses and evidence,the Court declines that demand as unprecedented and unjust,” Cannon wrote.

 

She continued, “The Court’s Order solicitingpreliminary draft instructions on certain counts should not be misconstruedas declaring afinal definitionon anyessential element= or asserted defense== in this case. Nor should it be interpreted as anything other than what it was: a genuine attempt, in the questions to be submitted to the jury in this complex case of first impression.”

 

Palm Beach County State AttorneyDavid Aronbergand other defense attorneys are nowencouraging Jack Smith to go nuclearand remove Judge Cannon from the case.

 

“Cannon seems to be daring Smith,” Aronberg said, according to NBC News.

Special counsel Jack Smith could soon seek to have the judge presiding over former President Donald Trump’s classified documents case recused, prosecutors and defense attorneys warn, describing Smith as being pressed to the “breaking point” over arguments his office said could taint a trial irrevocably.

 

Smithfaulted JudgeAileen Cannon in a scathing rebuke for seeming to take atface value Trump’s “fundamentally flawed” claimaround a president’s official and personal records when she asked both sides to put forth competing versions of instructions for jurors in the case and saidher request would “distort” the trial. But instead of backing away, Aronberg said that Cannon, including in a court filing on Thursday explaining her proposed jury scenarios, has stoked these tensions, so Smith may see no option but to appeal. (When does an attorney tell the judge what to do, thats not how it works)

 

(Smith doesn’t want Trump’s defense to be considered, and the Judge should eliminate his argument and defense. Lawmakers in more than a half-dozen U.S. states are pushing laws to define antisemitism,triggering debates about free speechand bringingcomplicated world politics into statehouses.

 

Supporters say it’s increasingly important to add a definition that lays out how to determine whether some criticism of Israel also amounts to hatred of Jewish people. In so doing, lawmakers cited the Oct. 7 attacks in which Hamas killed some 1,200 people, mostly civilians, and took about 250 hostages back to Gaza, which sparked a war that has killed more than 26,000 Palestinians.

 

“For anybody that didn’t think that anti-Zionism could cross into antisemitism, the rest of the world could see that it had,” said Democratic Rep. Esther Panitch, the only Jewish member of Georgia’s Legislature and one of the sponsors of a bill that the state Legislature passed last week. Republican Gov. Brian Kemp is expected to sign.

 

Defined in 2016 by the the International Holocaust Remembrance Alliance,antisemitism is “a certain perception of Jews, which may be expressed as hatred toward Jews. Rhetorical and physical manifestations of antisemitism are directedtoward Jewish or non-Jewish individualsand/or their property, toward Jewish community institutions and religious facilities.”

 

But Kenneth Stern, the author of IHRA’s definition, said using such language in law is problematic.

 

“There’s an increasingly large number of young Jews for whom their Judaism leads to an antizionist position,” said Stern, director of the Bard Center for the Study of Hate. “I don’t want the state to decide that issue.”

 

Over the past three months, there has been a rise in protests around the country calling for a cease-fire in Gaza and the release of Israeli hostages. A coalition of organizations, including Jewish Voice for Peace and CAIR, issued a joint statement saying that theGeorgia bill “falsely equates critiques of Israel and Zionism with discrimination against Jewish people.”

 

Measures using the same definition of antisemitism — but in anti-discrimination laws — have advanced in legislative chambers in Indiana and South Dakota. A report from the Anti-Defamation League last year found major increases in antisemitic incidents in Georgia and Indiana, but not in South Dakota, where fewer than 10 a year were recently reported.

 

Other legislation with the definition is pending in at least five other states this year.

 

Bill supporters say that more than 30 states have adopted the definition in some way over the years. Before now, the legal definitions — including in New York, the state with the largest Jewish population — came primarily through resolutions or executive orders rather than forceful laws.

 

In other parts of the country, Iowa incorporated the definition into law in 2022 and Virginia did the same last year, among others.

 

Lawmakers say their bills are in response to the Oct. 7 attacks, though before that, the problem of antisemitism has been on the rise in the U.S. and globally. Since the Israel-Hamas war erupted, several states have passed resolutions condemning Hamas and voicing support for Israel.

 

Thousands of entities around the world, including the U.S. State Department, major companies and colleges, have officially recognized the definition, with groups including the American Jewish Committee supporting it…

However the U.S. Congress and American Bar Association have declined to do so.Among those urging lawmakers to vote no are chapters of the ACLU.

 

“There is fundamental First Amendment harmwhenever the state tries to silence pure speech on the basis of its viewpoint,” said said Brian Hauss, an ACLU lawyer.

 

Backers of the laws emphasize that they’re not trying to ban speech but rather decipher between actions that amount to discrimination or hate crimes, which carry different degrees of severity.

 

“This bill is entirely about conduct — adverse or unequal treatment that’s prohibited in state law,” said South Dakota state Rep. Fred Deutsch, a Republican whose father was a Holocaust survivor. “This bill doesn’t limit a person or organization’s freedom of speech or expression.” This week the chamber passed a measure by a 53-14 vote.

 

Lara Freidman, president of Foundation for Middle East Peace, said the laws could elevate charges, such as those against a protester for property destruction to the level of a hate crime if the perpetrator is seen with a Palestinian flag. Georgia State Rep. Ruwa Romman, a Democrat of Palestinian descent, said that the definition, when adopted by colleges, has stifled students’ right to free speech.

 

“When they attempted to host a Palestinian poet or Palestinian culture night, the administration has preemptively canceled the events for fears of being antisemitic,” she said.

 

Some protesters gathered in the capitol in Indiana this month before the House unanimously advanced a bill incorporating the definition there.

 

“I don’t need to feel like as a student I’m going to be either censored or attacked or harassed,” said Yaqoub Saadeh, president of the Middle Eastern Student Association at Indiana University – Purdue University Indianapolis.

 

How colleges are acting to prevent or stop antisemitism on campus has become a hot-button issue across the country. Last year, fallout from campus presidents’ testimony before Congress led to the resignation of presidents at Harvard and the University of Pennsylvania.

A federal appeals court blocked one of Joe Biden’s student loan bailout programs.

 

The Fifth Circuit Court of Appeals on Thursday blockedBiden’s plan to cancel loans for borrowers who claim they were victims of ‘misleading information’ by colleges.

 

A three-judge panel – one Reagan appointee and two Trump appointees – said Biden’sprogram was ‘almost certainly unlawful.’

 

ABC News reported:

A Biden administration plan to provide student debt relief for people who say they were victims of misleading information by trade schools or colleges is “almost certainly unlawful” a federal appeals court said in a rulingblocking enforcement of the policy against a group of privately owned Texas institutions.

 

The 5th U.S. Circuit Court of Appeal ruling, dated Thursday, came in a court challenge filed by Career Colleges and Schools of Texas. The panel sent the case back to a lower court, saying the judge should issue an injunction against enforcement while the appeal continues.

 

At issue are rules that broadened existing policy, affecting students who borrowed money to attend colleges and universities that are determined to have misled them on matters such as whether their courses would actually prepare them for employment in their field or the likely salary they would earn upon obtaining a degree.According to the opinion, if a federal student loan is discharged under the policy, the government can seek reimbursement from the school accused of the misleading practices.

 

Biden has used a series of workarounds to circumvent the Supreme Court’s decision to strike down his student loan bailout program.

 

Last year the Supreme Court ruled 6-3 against Joe Biden’s student loan relief program so the Department of Education rolled out a workaround forbearance program to cancel $39 billion in student loans by counting non-payments as payments for a period of time.

 

Only it isn’t your typical forbearance program. Borrowers won’t have to pay back ‘missed’ payments or make up the difference of ‘reduced’ payments. No interest will accrue on any of the missed payments.

 

In January Biden unilaterally canceled another $5 billion in student loan debt for 74,000 borrowers in his latest vote-buying gimmick.

 

“The latest round of student debt cancelation brings thetotal amount canceled under Biden to $136.6 billion for more than 3.7 million Americans, according to the Department of Education. It comes after the U.S. Supreme Court blocked Biden’s initial student loan handout last year, which would have cost more than $400 billion.” Fox Business reported.

 

Joe Biden also announced he would cancel student loans for borrowers who took out less than $12,000 and have been in repayment for 10 years.

 

Biden recently bragged about forcing hardworking middle-class Americans to pay for other people’s student loans.

 

Biden falsely claimed his debt cancellation is free during a campaign in Vegas earlier this year.

 

Anybody with a basic understanding of economics knows this is a lie.
