Images are not patented, they are copyright. Copyright is automatic upon creation.
There is no such thing as “open source” on art unless the creator specifies that it is open source.

Here is how it works, if you want to use an image, for this type of application, you need to determine the license status.
If there is none, or you cannot find one, you cannot use it.
If you want to make a shirt for yourself, many artists over a personal use license that allows you to make one for yourself.
If you plan on selling, you need to purchase a commercial license.
