Supreme Court: Shadow Docket, what it is, the fight against the shadow docket, destruction of Trump doctrine and his success, attack on the Supreme Court, and the Conservatives.
Anons, since we found out theBrunson Case was accepted by the Supreme Court and was put on the “Shadow Docket”, I’ve been researching on the Shadow Docket all morning. And come to find out, there has been political, scholarly and legal outrage about this “docket” starting in Trumps term, and even more recently, even though the docket has been used since the 1800’s. (I’ll post a number of excellent articles from University of Virginia Law school, Virginia History website etc. I’ll also post definition of the “Shadow Docket”, that term made up by a liberal law professor to make it sound sinister). The only reason why there is so much outrage, and there’ s a lot, in the last couple of years is:
-
President Trump got elected
-
Every Attorney General, lawyer, org and liberal opposition by using Lawfare with multiple lawsuits against his Admin, to his presence in the WH, started their attacks even before he took office.
-
Their attacks legally started on the Muslim ban and there were 1,000’s of cases filed against Trump, in all courts in the land and in the SC.
-
Due to that the Admin could get nothing done, Solicitor General Noel Francisco under Trump, had to by pass a lot of the courts and filed 41 cases, with 28 being approved, appealing directly to the SC Shadow Docket.
-
What made it worse was PDJT appointed three conservative judges to the Court. At that point Lawfare fight was not only towards Trump, but all the justices that were conservative. They specifically are now trying to get rid of Alito and they have been trying to get rid of Thomas for 30 years, but it accelerated greatly under Trump.
-
There are a lot more triggers and actions, but you get the gist. (is the CiC using the "shadow docket", I'm sure that's a conspiracy theory)
Quote from next article, interesting:On April 6, 2022, the Supreme Court issued a 5-4 opinion that reinstated a policy from the Trump administrationthat restricted states’ ability to regulate how projects might impact water quality in their jurisdiction. The decision, unsigned and without any accompanying explanation, prompted a dissent from Justice Kagan that was signed by three other Justices, and was joined by the Chief Justice, John Roberts. It was issued under the emergency, or shadow docket, which made us want to know – what is the Court’s shadow docket, and how does it work?
