Nominating 3 while 1 of 9 spots is vacant only expands to 11 seats.

 

That would mean the SC would be split 7/4 split with the advantage leaning originalist/constitutionalist/conservative.

 

If the rumors are true that RBG is nearing the end and what's-her-face's diabeetus are going to force her out within Trump's presidency, that would expand that swing to 9/2 in conservative favor for at least 30 years.

There's precedent. In the 19th century, when a 10th circuit was added, the spots were expanded to 10. When it was removed, it went back to 9.

 

There's nothing mandating it be 9. It's within the president's power to expand. It would probably be a good safe guard to pick an odd number, somewhere between 9-19, and then have a constitutional amendment solidifying it.
