Federal judge makes key rulings ahead of Hunter Biden’s trial on gun charges in June 1/2

The judge in Hunter Biden’s gun case issued a series of pretrial rulings Friday, handing wins to both sides and setting the contours of the upcoming trial.

 

Federal Judge Maryellen Noreika sided with prosecutorson a key question about what they need to prove about Biden’s drug use when he bought a gun in 2018.

 

To win a conviction,she said they’ll need to show that he was generally using drugs at the time, and not that he specifically used drugs on the day he bought the gun. Biden has advocated for the narrower scope of the law to be applied.

 

But she also decided to allow Biden’s lawyers to challenge the authenticity of specific texts from his infamous laptopthat will be presented to the jury by special counsel David Weiss’ team. (they got to her, she wants to live with her family)

Biden’s lawyers maintain that there are=serious questions about the legitimacy of the material.

 

Prosecutors said in court that they only want to introduce a small slice of the laptop material at trial. (Weiss has to intentionally fuck up)

 

“What we’re using from the laptop are messages that will be corroborated by a witness who will testify that she sent those messages,” prosecutor Derek Hines said. “This isn’t some vast array of messages.”

 

The issues were among the more than a dozen questions before the judge at Friday’s hearing about what evidence could come in during the trial, which will begin June 3. Biden was present at the hearing, as was Weiss.

 

The president’s son faces three charges in the case brought by the special counsel in Delaware. (The easiest state to get off)

 

Prosecutors accuse Biden of buying and possessing a firearm while addicted to illegal drugs, which is a violation of federal law, and of lying on a form he submitted during the purchase about his drug use. Biden has pleaded not guilty.

 

Lawyers said the trial could last up to two weeks(why not 5-8 weeks, hoe do they know how long it will be?), including jury selection, with the potential to go longer.

 

Biden recently secured a delay in a separate, tax-evasion trialhe is facing from the special counsel’s investigation in California, which was originally slated for late June but is now expected to kick off in September.

The parties also tussled over the forms from the Bureau of Alcohol, Tobacco, Firearms and Explosives that were filled out when Biden bought the revolver in a Wilmington gun shop in October 2018.

The forms are a key piece of evidence because Biden is charged with making a false statement by checking a box that said he wasn’t using illegal drugs. That’s one of the boilerplate questions on the form that every gun buyer is required to fill out. (Oops they lost the original form)

 

But some credibility issues have emerged about the forms and the staff at the gun store, who are expected to be called as witnesses by Weiss.

 

There are apparently two versions of the form involving Biden: The initial version that was emailed to the ATF not long after the purchase, and a paper copy that contains additional written information that the gun store staff added a couple years later.

 

“They tampered with it,” Biden’s attorney Abbe Lowell saidFriday, noting that the employees added details about how they verified Biden’s identity in order to comply with federal law.

 

At the time of the purchase, the store verified Biden’s identity by using his passport. They later added information about his car registration.

 

“They accepted an ID that they shouldn’t have accepted,” Lowell said, and now “the government is giving them a break” by offering them some immunity so they can testify against Biden.

 

The judge didn’t issue any decisions Friday on the matter. Prosecutors have asked her to exclude the second, altered form from the trial altogether.

 

Questions looming if Biden takes the stand

There was minimal disagreement between prosecutors and the defense teamon many of the 13 motions Noreika was considering Friday about what arguments a jury could hear.

 

They generally agreed that Biden could not bring up claims that the prosecution violated the Second Amendment and that information from his failed plea deal – and the July 2023 hearing where that agreement fell apart – should, in most circumstances, not come into the trial.

 

The judge also granted Biden’s request that the paternity case he faced in Arkansas be excluded, as should his 2014 discharge from the Navy over a drug incident. She also limited what references prosecutors could make at trial to his lavish spending habits at the time of the gun purchase, narrowing such evidence to spending connected to drug use.

 

She sided with Biden on whether prosecutors could refer to the tax charges.(they got to her)

However, the judge granted those requests with the caveat that she may need to revisit the questions about what a jury can hear if Biden decides to take the stand. His attorneys have not said whether the defendant will testify, and such a decision is usually not announced until the trial is well underway.

Ukraine might not join NATO – Biden (BaHaHaHahaHa…)

 

Peace doesn’t necessarily mean membership of the US-led bloc, the American leader has said

US President Joe Biden’s vision of peace for Ukraine does not necessarily NATO membership, according to his interview with Time magazine, published on Tuesday.

 

Biden sat down with Time’s editor in chief and Washington bureau chief at the White House on May 28, speaking about his policy on Ukraine, China, Israel and election-related matters.

 

“Peace looks like making sure Russia never, never, never, never occupies Ukraine. That’s what peace looks like.And it doesn’t mean NATO, they are part of NATO,” Biden said, when asked about the endgame in Ukraine.(Bidan very worried about the election, I can’t wait for Zelensky’s response)

 

“It means we have a relationship with them like we do with other countries, where we supply weapons so they can defend themselves in the future,” he added.“But it is not, if you notice, I was the one when–and you guys did report it at TIME–the one that I was saying that I am not prepared to support the NATOization of Ukraine.”

 

Biden then argued that the West is “on a slippery slope for war if we don’t do something about Ukraine,” and that if Kiev falls then “you’ll see Poland go, and you’ll see all those nations along the actual border of Russia, from the Balkans and Belarus, all those, they’re going to make their own accommodations.”

 

According to Biden, he approved the release of intelligence about the Russian “invasion” of Ukraine “to let the world know we were still in charge. We still know what’s going on.”(BaHaahaHa….)

 

“We are, we are the world power,” the 81-year-old Democrat told Time. As proof, he pointed to the June 2021 summit with Russian President Vladimir Putin in Switzerland, where the Russian leader allegedly said he wanted to see “the Finlandization of NATO.”

 

“I told him, he’s gonna get not the Finlandization [of NATO but], the NATOization of Finland. And everybody thought, including you guys, thought I was crazy,” Biden said. “And guess what? I did it. I did it. And we’re now the strongest nation.”

 

In December 2021, Russia sent the US and NATO two draft security treaties, seeking a pledge that Ukraine would never join the US-led bloc, among other things. In January 2022, Washington and Brussels snubbed Moscow’s proposal, insisting that NATO has an “open door” policy not subject to outside veto. The Russian military operation in Ukraine began a month later.

Kremlin calls US ‘an enemy’ for first time

Kremlin spokesman Dmitry Peskov has referred to the United States as an “enemy” while talking to reporters on Tuesday. However, it remains unclear if the change of rhetoric signals an official policy change as the spokesman had previously argued thatonly President Vladimir Putin can make such decisions.

 

Washington’s refusal to allow former US Marine, UN weapons inspector and RT contributor Scott Ritter to travel to St Petersburg was “the latest manifestation of the rabid campaign to prevent US citizens from interacting with the Russian Federation” – which would only be “understandable” if it was somehow related to his former intelligence status, Peskov told journalists on Tuesday.

 

“We are now an enemy country for them – much like they are for us,”Peskov said, noting that restrictions for former intelligence officers, especially on travel "to a hostile country,” are common all across the world.

 

The Kremlin previously called the United States and other Western countries that have supported and armed Kiev and imposed sanctions against Moscow as “unfriendly states” and “opponents.”The subtle change of rhetoric follows Washington’s decision to let Kiev use American weapons against targets deeper inside Russia, beyond what the US considers Ukrainian territory.

 

Back in March, Peskov noted that Moscow does not like US officials who keep insulting President Putin,but in general there are “no anti-American sentiments” in Russia, expressing hope that “sooner or later the realization that the peoples of America and Russia are not enemies will eventually come.”

 

Putin said in January that the elites of the collective West were actually the true enemy of Russia, while Ukraine is a mere tool in their hands.

 

The point is not that they are helping our enemy, but that they are our enemy,”the Russian president said, arguing that the conflict between Moscow and Kiev was orchestrated by Western elites who seek to inflict a “strategic defeat” on Russia.

 

Last month, Putin reiterated that the collective West and “the entire Western community is working for our enemy, dreaming about Russia ceasing to exist in its current form,” but stopped short of branding any particular Western state an ‘enemy’.

 

While former Russian President Dmitry Medvedev, who currently serves as the deputy chair of Russia’s Security Council, and several other hawkish officials repeatedly branded Moscow’s adversaries as “enemies” over the past two years – Peskov previously said that only President Putin can “formulate and state Russia’s official foreign policy position.”

Almost half of Ukrainians believe democracy in decline under Zelensky – study(there was never democracy there to start with)

Almost half of Ukrainians believe that democratic institutions have worsenedin the country during thefive years of Vladimir Zelensky’s presidency, a study has shown.

 

Zelensky remains in power in Ukraine despite his term in office having officially expired on May 20. The politician had earlier opted to scrap presidential elections, citing the fact that martial law had been imposed due to the ongoing military conflict with Russia.

 

On Tuesday, theKiev International Institute of Sociology(KIIS) published the results of a poll suggesting thatsome 43% of Ukrainians think that democracy has deterioratedin the country under Zelensky. Another 29% said that there was no change, and 19% expressed belief that the institution had actually improved during the period, according to the study.

 

Of those who noted adecline in democracy, 28% said the actions of the authorities were to blame. The number of respondents who believe that their freedoms are being curtailed because of the conflict between Moscow and Kiev stands at only 11%, with another 3% saying that both factors have played a role, the poll, which was carried out by phone among 1,002 people in May, revealed.

 

Some 49% also said that the Ukrainian economy- the creation of conditions for development, transparency of rules and the fairness of the government’s attitude towards business -has also worsened during Zelensky’s rule. Out of this number, 23% linked the problems to national policymaking, with 16.5% saying that the economy had suffered because of the military conflict, the study read.

 

In his comment regarding the poll, KIIS Executive Director Anton Hrushetsky said “it is possible to interpret Ukrainians’ perception of changes in democracy and the economy as a lack of outstanding encouraging advances, but also without harsh accusations of the authorities.”

 

The figures suggest thatZelensky still has “significant room… to maintain a fairly high level of support and optimism about the future among the population,” but only if he recognizes the problems faced by the country and addresses them, Hrushetsky stressed.(this guy is bullshitting Z because he doesn’t want to be executed)

 

Last month, Vladimir Putin argued that Zelensky’s legitimacy as president has “expired.” A few days later, he stressed that the Ukrainian constitution does not make any mention of the suspension of presidential elections, only explicitly prohibiting parliamentary elections under martial law.

 

While the Ukrainian mobilization legislation prohibits presidential elections in wartime, it says nothing about the possibility of extending the head of state’s term in office, Russia’s president said.

 

In Moscow’s view, the sole legitimate authority in Ukraine is now the parliament, Putin added.

Behind Closed Doors, Biden Shows Signs of Slipping

WASHINGTON—When President Biden met with congressional leaders in the West Wing in January to negotiate a Ukraine funding deal, he spoke so softly at times that some participants struggled to hear him, according to five people familiar with the meeting. He read from notes to make obvious points, paused for extended periods and sometimes closed his eyes for so long that some in the room wondered whether he had tuned out.

 

In a February one-on-one chat in the Oval Office with House Speaker Mike Johnson, the president said a recent policy change by his administration that jeopardizes some big energy projects was just a study, according to six people told at the time about what Johnson said had happened. Johnson worried the president’s memory had slipped about the details of his own policy.

 

Last year, when Biden was negotiating with House Republicans to lift the debt ceiling, his demeanor and command of the details seemed to shift from one day to the next, according to then-House Speaker Kevin McCarthy and two others familiar with the talks. On some days, he had loose and spontaneous exchanges with Republicans, and on others he mumbled and appeared to rely on notes.

 

“I used to meet with him when he was vice president. I’d go to his house,” McCarthy said in an interview. “He’s not the same person.”

 

The 81-year-old Biden is the oldest person to hold the presidency. His age and cognitive fitness have become major issues in his campaign for a second term, both in the minds of voters and in attacks on him by Republicans. The White House and top aides said he remains a sharp and vigorous leader.

 

Some who have worked with him, however, including Democrats and some who have known him back to his time as vice president, described a president who appears slower now, someone who has both good moments and bad ones.

 

For much of his career, Biden enjoyed a reputation on Capitol Hill for being a master negotiator of legislative deals, known for his detailed knowledge of issues and insights into the other side’s motivations and needs—and for hitting his stride when the pressure was on. Over the past year, though, with Republicans in control of the House, that reputation has diminished.

 

White House officials dismissed many of the accounts from those who have met with the president or been briefed on those meetings as motivated by partisan politics.

 

“Congressional Republicans, foreign leaders and nonpartisan national-security experts have made clear in their own words that President Biden is a savvy and effective leader who has a deep record of legislative accomplishment,” said White House spokesman Andrew Bates. “Now, in 2024, House Republicans are making false claims as a political tactic that flatly contradict previous statements made by themselves and their colleagues.”

 

This article is based on interviews with more than 45 people over several months. The interviews were with Republicans and Democrats who either participated in meetings with Biden or were briefed on them contemporaneously, including administration officials and other Democrats who found no fault in the president’s handling of the meetings. Most of those who said Biden performed poorly were Republicans, but some Democrats said that he showed his age in several of the exchanges.

 

The White House kept close tabs on some of The Wall Street Journal’s interviews with Democratic lawmakers. After the offices of several Democrats shared with the White House either a recording of an interview or details about what was asked, some of those lawmakers spoke to the Journal a second time and once again emphasized Biden’s strengths.

 

“They just, you know, said that I should give you a call back,” said Rep. Gregory Meeks, a New York Democrat, referring to the White House.

 

Bates, the White House spokesman, said: “We thought it was important that all perspectives be represented” to correct what he said were “false and politically motivated claims.”

 

Former President Donald Trump, who at 77 is 3½ years younger than Biden, also has faced questions about his mental acuity. Indeed, both candidates have been captured repeatedly on camera slipping up on facts or otherwise botching their public remarks, providing a steady stream of fodder for both Democrats and Republicans to attack the mental capacity of the opposing candidate.Fucking Liars

Birx says US making ‘same mistakes’ with bird flu as COVID-19

Deborah Birx, a physician who served as former President Trump’s coronavirus response coordinator, warned that the United States is making the “same mistakes” with the bird flu as it did with COVID-19.

 

“This is why I’m really concerned because we’re making the same mistakes today that we made with COVID. And what do I mean by that? We’re not testing to really see how many people have been exposed and got asymptomatically infected,” Birx told CNN’s Kasie Hunt on Tuesday.

 

Birx served as the coronavirus response coordinator in Trump’s administration and has since sounded the alarm bells on how the U.S. is not doing enough to prevent another pandemic.

 

A third human case of bird fluwas identified in the state of Michigan last week, according to the Centers for Disease Control and Prevention (CDC). Like other previous cases identified since March, the person is a dairy farm worker who had exposure to infected cows.

 

The CDC has maintained that thecurrent public health risk in connection to the bird flu is low, but that it will continue to monitor the situation.

 

Birx said thatevery cow should be getting tested weekly for the bird flu, adding that there are likely some undetected cases in humans.

 

“We have the technology. The great thing about America is we’re incredibly innovative and we have the ability to have these breakthroughs,” she said.

 

“We could be pool testing every dairy worker. I do believe that there’s undetected cases in humans, because we’re once again only tracking people with symptoms. When we did that with COVID, the virus spread throughout the Northeast undetected, because it took a long time to get to the vulnerable individuals,” she added.
