California Supreme Court Rules Against Taxpayers Right to Vote on New Taxes
Newsom and the Legislature sued to keep this off the ballot. Polling in favor of it was over 80%
The Taxpayer Protection and Government Accountability Act, a duly qualified initiative will not appear on the November ballot. Supreme Court claims that : (1) requiring all new or increased state taxes receive voter approval; (2) prohibiting the legislative branch of state and local government from delegating fee-setting authority to executive or administrative agencies; and (3) classifying fees for essential governmental services as “exempt charges,” not “taxes” for purposes of referendum.are revisions to the state constitution and not amendments.
