When [they] went to dark outside (non official) comms, a case can be made that they went outside of official acts.
Burner phones, private laptops, private phones, home servers, private email, private email drafts (used as a way of communicating without "sending"), xBox Live, Steam chat, Signal, etc. We've got mountains of evidence already "public" and I'm sure the NSA has most of the rest filed away.
