We Build the Wall is an organization that solicited donations to build private sections of the wall along the Mexico–U.S. border. It started as a GoFundMe campaign by United States Air Force veteran Brian Kolfage in December 2018.[2] Kolfage announced the formation of a 501(c)(4) non-profit organization in January 2019.[3] By mid-2020, over $25 million had been raised[4][5] and a 3-mile (4.8 km) section of fence had been built.[6] The organization was involved in the construction of walls along the border in Sunland Park, New Mexico and Mission, Texas.

 

Its advisory board included politicians and activists with a hard-line stance on illegal immigration, including former secretary of state of Kansas Kris Kobach;[7] former congressman Tom Tancredo;[8] Blackwater USA founder Erik Prince; former Milwaukee sheriff David Clarke;[9] and former Trump chief strategist Steve Bannon,[5][10] who is chairman of the board.[11]

 

In August, 2020 Brian Kolfage, Steve Bannon, Andrew Badolato and Timothy Shea were charged with a scheme to divert over a million dollars from We Fund the Wall, of which at least $350,000 illegally went to Kolfage for personal use. The men faced federal felony charges of conspiracy to commit wire fraud and conspiracy to commit money laundering.[12][5][13][14][15] Kolfage and Badolato pled guilty and were sentenced.[16] After Shea's first trial ended in a hung jury, he was convicted in October 2022 and received a 63 month sentence in July 2023.[17][18][16][19] Bannon was pardoned by then-President Trump but was indicted in September 2022 on state charges in New York.[20]

Two Sentenced To Prison For ‘We Build The Wall’ Online Fundraising Fraud Scheme

Damian Williams, the United States Attorney for the Southern District of New York, announced that BRIAN KOLFAGE and ANDREW BADOLATO were sentenced today by United States District Judge Analisa Torres. KOLFAGE was sentenced to 51 months in prison, and BADOLATO was sentenced to 36 months in prison, for their respective roles in carrying out a scheme to defraud hundreds of thousands of donors in connection with an online crowdfunding campaign known as “We Build The Wall” by soliciting donations using false statements and then stealing the resulting donations.

 

U.S. Attorney Damian Williams said: “Brian Kolfage and Andrew Badolato abused the trust of donors to We Build the Wall and stole hundreds of thousands of dollars in donations to line their own pockets. The defendants have now been held accountable for their criminal conduct.”

 

According to court filings and evidence introduced during court proceedings:

 

Starting in approximately December 2018, BRIAN KOLFAGE, ANDREW BADOLATO, their co-defendant TIMOTHY SHEA, and others orchestrated a scheme to defraud hundreds of thousands of donors, including donors in the Southern District of New York, in connection with an online crowdfunding campaign ultimately known as “We Build The Wall” that raised more than $25,000,000 to build a wall along the southern border of the United States. In particular, to induce donors to donate to the campaign, KOLFAGE repeatedly and falsely assured the public that he would “not take a penny in salary or compensation” and that “100% of the funds raised…will be used in the execution of our mission and purpose.”

 

Those representations were lies. In truth, KOLFAGE, BADOLATO, SHEA, and others received hundreds of thousands of dollars in donor funds from We Build the Wall, which they each used in a manner inconsistent with the organization’s public representations. For example, KOLFAGE covertly took for his personal use more than $350,000 in funds that donors had given to We Build the Wall. To conceal the payments to KOLFAGE from We Build the Wall, KOLFAGE, BADOLATO, SHEA, and others devised a scheme to route those payments through entities and bank accounts that they controlled. They took various steps to obscure or conceal these payments, including by using fake invoices and sham contracts — conduct for which SHEA was convicted at trial of obstruction of justice.

 

In imposing today’s sentences on KOLFAGE and BADOLATO, Judge Torres noted that “this was no ordinary financial fraud,” because when victims donated to We Build the Wall, “they were expressing their views about a political issue that was important to them.” Noting that the offense cast doubt on the efficacy of political involvement and that the scheme would “undoubtedly have a chilling effect” on political donations, Judge Torres remarked that “the fraud perpetrated by Mr. Kolfage and Mr. Badolato went well beyond defrauding individual donors. They hurt us all.”

 

KOLFAGE, 41, of Miramar Beach, Florida, and BADOLATO, 58, of Cocoa, Florida, each pled guilty to one count of conspiracy to commit wire fraud. KOLFAGE also pled guilty to tax and wire fraud charges originally filed by the United States Attorney’s Office for the Northern District of Florida.

 

SHEA, 52, of Castle Rock, Colorado, was convicted after trial of conspiracy to commit wire fraud, conspiracy to commit money laundering, and obstruction of justice, and is scheduled to be sentenced by Judge Torres on June 13, 2023.

 

In addition to the prison terms, KOLFAGE was sentenced to three years of supervised release and ordered to forfeit $17,872,106 and pay restitution in the amount of $2,877,414. BADOLATO was sentenced to three years of supervised release and ordered to forfeit $1,414,368 and pay restitution in the amount of $1,414,368. Judge Torres also separately ordered forfeiture of $1,376,597.39 of funds held by We Build the Wall and real property located in Sunland Park, New Mexico, on which We Build the Wall had constructed a portion of a wall.

 

Mr. Williams praised the outstanding investigative work of the United States Postal Inspection Service and the Special Agents of the United States Attorney’s Office for the Southern District of New York.

Steve Bannon's Trial Postponed

The trial for Donald Trump ally Steve Bannon over allegations he defrauded people who donated to a campaign to build a wall along the U.S.-Mexico border has been postponed by several months.

 

Bannon, a former White House senior adviser, has pleaded not guilty to several charges of money laundering, conspiracy and scheming to defraud in connection with $15 million in donations a "We Build the Wall" fundraising campaign received.

The trial at the New York Supreme Criminal Court was originally set to begin on May 27 by Judge Juan Merchan. However, the judge, who is also presiding over Trump's hush-money trial, which is expected to last several more weeks, has delayed the start of Bannon's proceedings until September, senior Courthouse News reporter Josh Russell first reported.

 

Bannon will next appear in court in connection to the fraud case on September 23.

 

In September 2022, Bannon was charged in connection with money laundering allegations that stemmed from a GoFundMe campaign to build a wall along the U.S.-Mexico border, a key 2016 campaign promise from Trump.

 

Bannon was previously charged in an almost identical federal investigation before being pardoned by Trump hours before the then-president left office in January 2021.

 

Manhattan prosecutors revived the investigation in September 2022 with state-level charges against Bannon, which are not covered by presidential pardons.

Bannon was also found guilty of two counts of contempt of Congress in July 2022 after defying a subpoena issued to him by the House Select Committee investigating the January 6 attack. He has not spent any time in jail, pending the result of an appeal.

 

In April 2023, Brian Kolfage, a U.S. Air Force veteran and founder of the We Build the Wall organization, was sentenced to over four years in jail after he pleaded guilty to conspiracy to commit wire fraud and other tax- and wire-fraud charges in connection with the millions donated to the campaign, the U.S. Attorney's Office for the Southern District of New York said in a press release.

 

Andrew Badolato, a co-defendant, also pleaded guilty to wire-fraud conspiracy and was sentenced to three years.

 

A third defendant, Timothy Shea, was found guilty at trial of conspiracy to commit wire fraud, conspiracy to commit money laundering and obstruction of justice. In July, he was sentenced to 63 months in prison and three years of supervised release. Shea was also ordered to forfeit $1,801,707 and pay restitution in the amount of $1,801,707.

 

All three men were found to have devised a scheme to move donations to the "We Build the Wall" campaign through entities and bank accounts they controlled, the office said. They then took steps to obscure or conceal the payments, including by using fake invoices and sham contracts.
