Former Oakland Army Base emerges as unexpected target in sprawling FBI probe

The former Oakland Army Base, a 422-acre expanse of land two miles west of downtown Oakland, has emerged as an unexpected focus of the FBI investigation that resulted in the raids of Mayor Sheng Thao’s home and properties connected to a politically influential family that operates the city’s curbside recycling program.

Lodged in a federal grand jury subpoena issued on June 26 to the Oakland city attorney was a request to hand over documents “related to the use or development of the former Oakland Army Base,” as well as documents related to “any proposal for a Declaration of a Local Emergency on Homelessness that was considered by the Oakland City Council between January 2023 and December 2023.”

Neither the FBI nor the subpoena indicated the reason for the queries into the Oakland Army Base or how it connects to the other named subjects of the probe.

The subpoena landed several weeks after the FBI raided Thao’s home, as well as those of California Waste Solutions CEO David Duong and his son, Andy Duong, and the company’s offices. Oakland contracts with California Waste Solutions for curbside recycling, and the Duongs have political connections to Thao and other elected leaders. California Waste Solutions and Oakland-based metal recycler, CASS, Inc. are in the process of moving their operations to an undeveloped portion of the base.

City Council Member Carroll Fife, who represents West Oakland, directed the city in 2022 to study the feasibility of moving 1,000 homeless people onto the same undeveloped portion of the base. But the city said the site is polluted by toxic chemicals and would cost more than $20 million a year to operate.

On Tuesday, Fife told the Chronicle that she’s been informed by the city attorney to hold onto emails and communications concerning Evolutionary Homes, a company owned by the Duongs and Mario Juarez, that builds modular housing. Fife said she is one of several council members asked to retain records. She said she has not been interviewed by the FBI.

Fife said the Duongs have never donated to her campaign and that she has never spoken to them about the Army base. She met them when she first got into office and they asked her how they could support her, but that was the extent of their interaction. She said a representative from Evolutionary Homes contacted her about a year ago.

“They were very persistent, and those are the emails I have to share with the city attorney,” Fife said, adding that she directed the company’s representative to go through the city’s normal contract bidding process.

There is no known connection between Evolutionary Homes and the former Oakland Army Base.

Oakland has spent the past two decades attempting to redevelop the former army base — larger than 335 football fields — located west of I-880 in the Port of Oakland.

The base was originally created in 1942 during World War 11 and was decommissioned and returned to the city in 1999. From 2011 to 2019, Oakland tried to use local, state and federal funding to redevelop the site, according to the city. Oakland installed roads, bike paths and Bay Trail connections, and completed design improvements to address sea-level rise as part of an effort to enable redevelopment, according to the city.

A 2021 city report noted that real estate investment group Prologis had built a new state-of-the-art warehouse and distribution facility on 72 acres of the Army base. In addition, the city said it has approved 15 acres of the site for truck parking and services.

The city has also been in litigation with a developer who wants to build a $250 million coal terminal on 33 acres of the Army base south of the Bay Bridge toll plaza. In January, a judge ruled in favor of the developer and said his contractors would have two-and-a-half years to decide whether to proceed with a coal storage and shipment terminal.

The only remaining vacant land at the Army base is at the North Gateway area, which is where CWS and CASS aim to move their facilities. The area is unpaved, has no onsite utilities and is subject to a land-use restriction that prohibits residential uses, according to the city.

CWS’s new facility is expected to receive, process and transfer up to 850 tons per day of residential and commercial recycling material, according to the city. In 2022, Oakland said in a report that CWS is in the process of getting entitlements for 12 acres on the western portion of the Northgate Parcel and expected to start construction in December 2022 or January 2023.

CWS has not yet started construction, but has received a permit from the state and submitted its building applications to the city, said Sean Maher, an Oakland spokesperson.

The report also said that the city entered into a one-year Exclusive Negotiation Agreement with CASS for the remaining 8 acre eastern portion of the site on Sept. 21, 2021 and was expected to have a development agreement by December 2022. CASS, the city and the port are still negotiating on a development agreement, Maher said.

“I want them to relinquish their lease on the land,” Fife said. “I want CASS and CWS to understand that we are in a homeless crisis and they haven’t developed the site for years. Until we get homelessness under control, then I want them to voluntarily say, ‘you know what, we care about Oakland and we are going to look for some other places to move our recycling businesses.’ ”
